Kuchel of California (R-Anaheim) on a bill providing Federal financial assistance for construction of water projects designed to increase municipal and industrial supplies. In a letter to Chairman Kerr of the Senate Rivers and Harbors-Flood Control Subcommittee considering the legislation, Kuchel asked for hearings in the near future on the measure he joined Senator Clair Engle of California in sponsoring. The senior California Senator noted that the proposal already has been widely endorsed and is in accord with recommendations made by President Kennedy recently in his message on natural resources. State Senator An estimated 100,000 letters or more poured into the state legislature recently on AJR 21, the proposed resolution to repeal income tax and get government out of business enterprises. But it had no effect on the Assembly Rules Committee which, you know, killed AJR 21 by tabling it last week. To those of you interested in the hearing, the legislative counsel's office had an opinion on AJR 21 as requested by Assemblyman Charles Conrad, a Republican member of the Assembly committee. He asked: "If AJR'21 was adopted and two-thirds of the states adopted identical applications to Congress, would Congress be forced to call a Constitutional convention or propose the (23rd) amendment forthwith?" The answer was a qualified "no." Article V of the United States Constitution provides for calling a convention for proposing amendments when two-thirds of the states adopt resolutions calling for a convention. The legislative counsel's opinion said all amendments to the constitution thus far have originated directly from Congress. In the absence of any precedent for calling a convention without the alternative fee present a political question the determination of Compton as to which the courts not take jurisdiction. Co. has paid the highest franchise payments in its 50-year history to eight Southland counties and 96 of their communities, according to Justin M. Kennedy, Orange County division manager of the utility. The record franchise payment totals $1,408,113. Kennedy said, up more than $257,000 from the sum paid last year. Payments to Orange County and 22 of its communities amount to a total of $413,838.97. Kennedy said. The County will receive $72,-537.35, while individual payments to Anaheim will be $56,849.81. But the opinion goes on to say that the constitution leaves such matters to the discretion of Congress when two-thirds of both houses deem it necessary.
