NOTICE TO CONTRACTORS
Santa Ana, California
Date: August 24, 1960
In pursuance of a resolution of the Board of Supervisors of the Orange County Flood Control District adopted August 25, 1960, directing this notice, NOTICE IS HEREBY GIVEN that the said Board will receive at its office in the Court House at Santa Ana on or before the hour of 10:00 A.M. of September 28, 1960, sealed bids or proposals for the construction of Carbon Creek Channel—Part II from the Pacific Electric Railway Bridge (Station 372+20+or-) to the Santa Ana Freeway (Station 359+02.25).
Bids must be made on the form provided for the purpose, addressed to the clerk of the Board of Supervisors of the Orange County Flood Control District, Room 201, Court House, Santa Ana, California, and marked "Bid for Construction of Carbon Creek Channel—Part II."
Bids shall be for furnishing all labor, equipment and materials (except materials specified to be furnished by the District) in accordance with Plans and Specifications therefor for the following work:

The foregoing quantities are approximate only, being given as a basis for the comparison of bids, and the Orange County Flood Control District does not expressly or by implication agree that the actual amount of work will correspond therewith, but reserves the right to increase or decrease the amount of any class or portion of the work, as may be deemed necessary or expedient by the said District.
All bids are to be compared on the basis of the foregoing schedule of work items.
Notice is hereby given bidders that in accordance with the provisions of Section 1770 of the Labor Code, the Board of Supervisors of the Orange County Flood Control District has ascertained the prevailing rate of per diem wages for each craft or type of workman or mechanic needed to execute the directive therewith, but reserves the right to increase or decrease the amount of any class or portion of the work, as may be deemed necessary or expedient by the said District.
WELDERS: same wage scale as craft to which welding is incidental (except as otherwise separately classified).

The rate of compensation for any classification not listed in the schedule, but which may be required to execute the proposed contract, shall be commensurate and in accord with the rates specified for similar or comparable duties.
Provided that not less than one and one half times the prevailing rate shall be paid for any working time in excess of eight ($) hours in any one

calendar day and for Saturdays, Sundays and seven legal holidays, to-wit:
Thanksgiving Day and Christmas. For less than eight (8) hours per day,
New Year's Day, Memorial Day, Fourth of July, Labor Day, Veterans Day,
the per diem rate shall be that fraction of the foregoing per diem rates that
the number of hours worked bear to eight hours.
Provided that notwithstanding the general provisions contained herein,
Flagmen, Guards, and Watchmen shall be paid not less than one cent,
half time the prevailing rate for overtime (overtime shall be kind worked in excess of eight hours per day or forty hours per week), and the straight
prevailing rate for time worked on Saturdays, Sundays, and holidays where
such time does not constitute overtime.
Bidders' attention is called to the above mentioned Statute which will
require them, if awarded the contract, to pay not less than said general per
diem rate of wages set forth in said resolution hereinbefore mentioned, to all laborers, workmen and mechanics employed in the execution of
the proposed contract.
The bidder must submit with his proposal a satisfactory check certified
by a responsible bank or a bidder's bond and payable to the order of
Orange County Flood Control District for an amount not less than ten (10)
percent of the aggregate sum of the bid, as a guarantee that the bidder will
enter into the proposed contract if the same is awarded to him, and in
event of failure to enter into such contract said check will become the property of the District.
The amount of the bond to be given to secure a faithful performance of
the contract for said work shall be fifty (50) percent of the contract price
thereof, and an additional bond in an amount equal to fifty (50) percent of
the contract price for said work, which bond shall provide that if the person
or his subcontractors fail to pay for any materials, provisions, or other supplies used in upon for or about the performance of the work constructed to be done, or for any work or labor thereon of any kind, or for amounts
due under the Unemployment Insurance Act with respect to such work or
labor, that the surety or sureties will pay for the same, and also in case suit
is brought upon the bond, a reasonable attorney's fee to be fixed by the
court.
The Contractor will also be required to furnish a certificate that he carries compensation insurance covering his employee upon work to be done
under the contract which may be entered into between him and the said
District for the construction of said work.
No bid will be accepted from a Contractor who is not licensed in accordance with the law under the provisions of Division III, Chapter # of the
Business and Professions Code of the State of California.
The Contractor must furnish the blank form furnished by
the Flood Control Engineer. The special attention of prospective bidders is
called to the "Information for Bidders" annexed to the blank form of proposal for full directions as to bidding, etc.
The work is to be done in accordance with the Plans and Specifications
on file in the office of the Orange County Flood Control District, Court
House Annex, Santa Ana, California. Plans, Specifications and other contract document forms will be available for examination without charge and
copies may be secured at the office of the Orange County Flood Control District, Court House Annex, Santa Ana, California, upon payment of $3.66 if
wicked up at the District's offices or payment of $4.65 if requested by mail.
In either case, upon payment of the appropriate purchase price, the Plans
and Specifications become the property of the purchaser and are not to be
returned to the District for refund.
The Board of Supervisors reserves the right to reject any and all bids
and to waive any informality in any bid received.
No bidder may withdraw his bid for a period of thirty (30) days after
the time set for the opening thereof.
