ORDINANCE NO. 1408
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDED CONDITION NO. 1 OF ORDINANCE NO. 1240 RELATING TO A CHANGE OF ZONE IN A CERTAIN AREA OF THE CITY.
WHEREAS, the City Council of the City of Anaheim did on May 6, 1958, adopt a CONDITION No. 1240 in Reclassification Proceedings No. F-57-28 changing the property therein described from R-A. RESIDENTIAL/AGRICULTURAL ZONE to C-1, NEIGHBORHOOD - COMMERCIAL and R-3, MULTIPLE FAMILY RESIDENTIAL ZONES, subject to the conditions set forth in said Ordinance; and
WHEREAS, Condition No. 1 of said Ordinance reads as follows:
"I That that portion of subject property reclassified C-1 shall be developed in accordance with precise plans submitted to the City Council, marked 'Exhibit A,' and on file with the City and by reference made a part of our own records."
AND WHEREAS, the owners of subject property have submitted revised plans for the development of the C-1 property to the City Council and have requested that said revised plans be approved and substituted for the precise plans, marked "Exhibit A," and mentioned in Condition No. 1 of said Ordinance; and WHEREAS, the City Council finds that said revision has been approved for that Condition No. 1 of Ordinance No. 1240 should be amended by substituting the revised plans dated September 29, 1959, signed by John Bello, and marked "Exhibit B" for the precise plans, marked "Exhibit A," mentioned in said Condition No. 1.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:

That the amended plans dated September 29, 1959, signed by John Bello and marked "Exhibit B" in Reclassification Proceedings No. F-57-28 be and same are hereby approved; and that Condition No. 1 of Ordinance No. 1240 be, and same is hereby amended to read as follows:

that workmen are employed less than eight hours per day the per diem wage shall be that fraction of the per diem wage herein established that number of hours of employment bears to eight hours.
The overtime rule establishing the rates of overtime and holiday work shall be in accordance with the following: Where a single shift is employed, eight hours of continuous employment, except for lunch periods shall constitute a day's work beginning on Monday and continuing through Friday each week. Where work is required in excess of eight hours in any one day or during the interval of time from 8:00 o'clock P.M. Friday and 12:00 o'clock midnight Sunday, such work shall be provided for at the minimum rate of one and one-half times the basic rate of wages, and on Sundays and holidays such work shall be paid for at the minimum rate of double the basic rate of wages, except as otherwise provided in the May, 1958 revision of the A.G.C., B.C.A., H.B.L., E.G.C.A., A.F.L.-C.I.O., Southern California Master Labor Agreement Holidays, as herein referred to. In December 1949 the case may be in the United States pursuant to the provisions of Sections 4200 to 4205, both inclusive, of the Government Code of the State of California.
Pursuant to the provisions of Sections 4330 and 4331 of the Government Code of the State of California, and price fitness and quality being equal, the successful bidder and any subcontractors or contractors employed by him to do any part of the work at the above described public improvement shall be required to prefer supplies grown, manufactured or produced in the State of California and next to prefer supplies partially grown, manufactured or produced in the State of California.
Each bid shall be accompanied by a Non-collusion Affidavit, copies of which may be obtained from the City Clerk.
The successful bidder or bidders shall be required to enter into a contract with the City of Anaheim in the manner and form approved by the City Attorney of the City of Anaheim.
The City Council reserves the right to reject any all bids or to waive any informality to the extent permitted by law, and reserves the further right to make an award to the lowest responsible bidder found and determine the best interest of the City of Anaheim.

Such insurance shall be furnished by companies satisfactory to the City and subject to the approval of the City Attorney as to form and sufficiency.
The successful bidder and any subcontractor and contractors employed by him in performance of said work or any part of the work of said public improvement will be required to use only such manufactured articles, materials and supplies as have been manufactured in the United States substantially all from articles, materials and supplies mined or produced in the United States pursuant to the provisions of Sections 4200 to 4205, both inclusive, of the Government Code of the State of California.

Pursuant to the provisions of Sections 4330 and 4331 of the Government Code of the State of California, and price fitness and quality being equal, the successful bidder and any subcontractors or contractors employed by him to do any part of the work at the above described public improvement will be required to prefer supplies grown, manufactured or produced in the State of California and next to prefer supplies partially grown, manufactured or produced in the State of California.
Each bid shall be accompanied by a Non-collusion Affidavit, copies of which may be obtained from the City Clerk.
The successful bidder or bidders shall be required to enter into a contract with the City of Anaheim in the manner and form approved by the City Attorney of the City of Anaheim.
The City Council reserves the right to reject any all bids or to waive any informality to the extent permitted by law, and reserves the further right to make an award to the lowest responsible bidder found and determine the best interest of the City of Anaheim.

NOTICE INVITING SEALED PROPOSals FOR FURNISHING ALL PLANT, LABOR, SERVICES, MATERIALS AND EQUIPMENT AND THE PUBLIC ATTENTION TO THE OFFICE OF THE CITY CLERK OF THE CITY OF ANAHEIM AT THE COUNTY OF ASTRUM ON HAMMET STREET, JOHN NO. 486 together with the name and address of the bidder. The above mentioned check or bond shall be given as a guarantee that the bidder will enter into a contract, is awarded to him, and will be declared forfeited if the successful bidder refuses to enter into said contract with the portion of the work which will be done by each subcontractor. If any bid submitted fails to specify a subcontractor, as aforesaid, the contractor submitting such bid agrees to perform the work himself.
The successful bidder will be required to furnish a faithful performance bond in an amount equal to or more than 100% of the contract price, said bonds to be secured from a surety or bonding company satisfactory to the City Council of the City of Anaheim and shall be approved by the City Attorney as to form and sufficiency before acceptance.
Plans and specifications may be obtained from the City Engineer or the City Clerk of the City of Anaheim at the City Hall, Anaheim, California for the sum of Five Dollars ($5.00), if picked up at said offices, or the sum of Six Dollars ($6.00) if forwarded by mail.
The successful bidder will be required to continuously maintain adequate protection of all his work and defective property damage arising out of the performance of the contract and to furnish the City with public liability insurance in an amount not less than $100,000.00 for injuries including accidental death of any one person, $300,000.00 on account of any one accident, and property damage insurance in an amount not less than $50,000.00 and public liability insurance to cover vehicles by him whether on or off the premises in an amount of $50,000.00 for injuries to any one person or $100,000.00 for any one accident, and property damage in an amount of $100,000.00. Compensation and employer’s liability insurance shall be maintained during the life of the contract covering all employees on the project. The contractor shall be responsible that all employees of subcontractors are protected by such intection.

each of the various classifications of work shall be hereinafter set forth prevailing rates of hourly wages multiplied by sight. Eight hours shall constitute a day's work. It being understood that in the event that workmen are employed less than eight hours per day the per diem wage shall be that fraction of the per diem wage herein established that the number of employees to eight hours. Where work is required in excess of eight hours in any one day or during the interval of time from 5:00 o'clock P.M. Friday and 12:00 o'clock midnight Saturday, such work shall be paid for at the minimum rate of one and half times the basic rate of wages, and on Sundays and holidays such work shall be paid for at the above mentioned holidays other than Labor Day and Thanksgiving Day falls on Sunday, the following Monday shall be considered a legal holiday.
It shall be mandatory upon the contractor to whom the contract is awarded upon any subcontractor under him to pay no less than specified rates of wages to all laborers, workmen and mechanics employed by them in the execution of the contract.
Each Md shall be made out on a form to be obtained at the office of the City Clerk or the City Engineer of the City of Anaheim and shall be received by certified or cashier's check or bid bond for the per cent of the amount of the bid, made payable to the City of Anaheim, and shall be sealed and delivered to the City Clerk at the City Hall of the City of Anaheim before 2:00 o'clock P.M. on the 19th day of November, 1959, at which time sealed proposals will be opened in public by the City Engineer and the City Engineer Sealed proposals shall be permitted in sealed envelopes and marked in the upper left corner "Sealed proposals for construction"
Plans and specifications may be obtained from the City Engineer on the City Clerk of the City of Anaheim at the City Hall, Anaheim, California for the sum of FYs Dollars (45.00), if picked up at said offices, or the sum of Six Dollars (16.00) if forwarded by mail. Successful bids must be required to continuously maintain adequate protection of all his work and adjacent property from damage arising out of the performance of the contract and to furnish the City with public liability insurance in an amount not less than $100,000.00 for injuries including accidental death of any one person, $100,000.00 on account of any injury or accident, and $100,000.00 on account of any injury or accident.
Such insurance shall be furnished by companies satisfactory to the City and subject to the approval of the City Attorney as to form and sufficiency.
The successful bidder and any subcontractor and contractors employed by him in the performance of said public improvement will be required to use only such manufactured articles materials and supplies as have been mined or produced in the United States, and only such fabricated articles materials and supplies as have been manufactured in the United States substantially all from articles, materials and supplies mined, produced or manufactured, as the case may be, in the United States tendered to the provisions of Sections 4200 to 4205, both inclusive, of the Government Code of the State of California.
