LEGAL NOTICE (Pub. Anaheim Gazette Mar. 15, 1859.) ORDINANCE NO. 1334 AN ORDINANCE OF THE CITY OF ANAHEIM DECLARING THE INTENTION OF THE CITY COUNCIL TO AKE AND ABANDON A PORTION OF WINSTON ROAD AND AN EASEMENT FOR ROAD PURPOSES UPON, OVER, ACROSS, and ALONG THE HEREINAPTER DEScribed REAL PROPERTY; FIXING A TIME AND PLACE FOR A HEARING THEREON; AND DIRECTING THE POSTING OF NOTICES THEREOF AND THE PUBLICATION OF THIS ORDINANCE. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: Section 1: That the City Council of the City of Anaheim does hereby declare that it intends to vacate, abandon and close to public use a portion of Winston Road and an easement for road purposes upon, over, across and along the laying described property situated in the City of Anaheim, County of Orange, State of California, to wit: Beginning at the intersection of the center lines of West Street and Winston Road; thence Easterly along the center line of said Winston Road 149.22 feet; thence Southerly 20 feet, as measured at right angles from the mentioned center line to the true point of beginning; thence Easterly and Northern along a curve concave Northherly and having a radius of 503.74 feet through a central angle of 42.18° a distance of 50.16 feet to a point, said point being the beginning of a reverse curve also having a radius of 503.74 feet and a central angle of 42.18°; thence Anaheim shall reverse curve a distance of 503.16 feet to a point, said point being in the same parallel with and 15 feet South of the center line of said Winston Road; thence Easterly along the last mentioned center line 254.17° to the beginning of a curve concave Southherly and having a radius of 503.74 feet; thence Easterly along the last mentioned curve through a central angle of 42.18° a distance of 50.16 feet to a point, said point being the beginning of a reverse curve also having a radius of 503.74 feet and a central angle of 42.18°; thence Anaheim shall reverse curve a distance of 503.16 feet to a point, said point being in the same parallel with and 15 feet South of the center line of said Winston Road; thence Easterly along the last mentioned curve through a central angle of 42.18° a distance of 50.16 feet to a point, said point being the beginning of a reverse curve also having a radius of 503.74 feet and a central angle of 42.18°; thence Anaheim shall reverse curve a distance of 503.16 feet to a point, said point being in the same parallel with and 15 feet South of the center line of said Winston Road; thence Easterly along the last mentioned curve through a central angle of 42.18° a distance of 50.16 feet to a point, said point being the beginning of a reverse curve also having a radius of 503.74 feet and a central angle of 42.18°; thence Anaheim shall reverse curve a distance of 503.16 feet to a point, said point being in the same parallel with and 15 feet South of the center line of said Winston Road; thence Easterly along the last mentioned curve through a central angle of 42.18° a distance of 50.16 feet to a point, said point being the beginning of a reverse curve also having a radius of 503.74 feet and a central angle of 42.18°; thence Anaheim shall reverse curve a distance of 503.16 feet to a point, said point being in the same parallel with and 15 feet South of the center line of said Winston Road; thence Easterly along the last mentioned curve through a central angle of 42.18° a distance of 50.16 feet to a point, said point being the beginning of a reverse curve also having a radius of 503.74 feet and a central angle of 42.18°; All foremen, unless separately classified, shall be paid as provided in the May, revision of the A.G.C.B.C.A.H.B.I.L.E.G.C.A.A.P.F.-L.C.O.Southern California Master Labor Agreement. Apprentices may be employed in conformity with Section 1777.5 of the California Labor Code. The rates of per diem wages for each of the various classifications of work shall be the hereinbefore set forth multiplied by hourly wages multiplied by eight hours shall constitute a day's work in order that in the event that workers are employed less than eight hours per day the per diem wage shall be that fraction of the per diem wage herein established that the number of hours of employment bears to eight hours. For certain rule establishing the rates of per diem and holiday work shall be in accordance with the interval of time from clock P.M. Friday and 12:00 o'clock Saturday, such work shall be paid for at the minimum rate of one and one-half times the basic rate of wages. shall be maintained during the term of the contract covering all employees on the project. The contract shall be responsible that all employees of subcontractors are protected such insurance. Such insurance can be furnished by companies satisfied to the City and subject to any approval of the Court and sufficiency. The successful bidder and any contractor and contractors employ by him in the performance of a work or any part of the work of a public improvement will be required to use only such manufactured materials, materials and supplies as been mined or produced in the manufacture of articles, materials and supplies made in the United States substantially all from clays, materials and supplies mined or produced in the State of California and next to prefer supplies grown, manufactured or produced in the State of California. Each bid shall be accompanied by a Non-collusion Affidavit, copies which may be obtained from City Clerk. The successful bidder or bidder shall be required to enter into a contract with the City of Anaheim in manner and form approved by City Attorney of the City of Anaheim. The City Council reserves the right to reject any and all bids or to waive any informality to the extent warranted by the right to make an award to a lowest responsible bidder found determined to serve the best interests of the City of Anaheim. Eight hours shall constitute a day's work. It being understood that in the event that workers are employed less than eight hours per day the per diem wage shall be that fraction of the per diem wage herein established that the number of hours of employment bears to eight hours. The overtime rule establishing the rates of overtime and holiday work shall be in accordance with the following: Where a single shift is worked, eight hours of continuous employment, except for lunch periods, shall constitute a day's work beginning on Monday and continuing through Friday each week. Where work is required in excess of eight hours in any one day during the interval of time from 5:00 PM to 7:00 PM and 12:00 o'clock midnight Saturdays such work shall be paid for at the minimum rate of one and one-half times the basic rate of wages, and on Sundays and holidays such work shall be paid for at the minimum rate of double the basic rate of wages, except as otherwise provided in the Law Review of the A.G.C., B.C.A., H.B.I., E.G.C.A., A.P.L.-C.I.O.
