ORDINANCE NO. 1306
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE RELATING TO THE ESTABLISHMENT OF ZONES IN THE CITY OF ANAHEIM THEREIN REGULATING THE USE OF MANAGEMENT HEIGHT OF BUILDINGS AND THE SPACES; ADOPTING A MAP SHOWING THE BOUNDARIES OF SAID ZONES; DEFINING THE TERMS USED THEREIN; PROVIDING FOR ADJUSTMENT, AMENDMENT AND ENFORCEMENT; PRESCRIBING PENALTIES FOR VIOLATION AND BREACH OF SECTIONS OR PARTS OF SECTIONS IN CONFLICT THEREWITH.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:
WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt a resolution declaring its intention to change the boundaries of the zone where the city government mentioned and described and did the time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code and did duty hold and conduct said public hearing to consider such proposed change of zone or zones, and did receive evidence and reports from the city government therein, and did recommend a change for changes of zones as set forth in Resolution No. 29, Series 1956-57 of the City Planning Commission; and
WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did fix the 9th day of October 1958, as the time, and the Council Chamber in the City Hall of the City of Anaheim was placed for a public hearing upon said proposed change or changes of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and
WHEREAS, at the time and place used for said public hearing the City Council did hold and conduct such public hearing thereon did give notice evidence and reports, and did therefore:
THEREFORE; CREATING THE POSITION OF PARK AND RECREATION DIRECTOR; AND ESTABLISHING A RECREATION FUND.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:
SECTION 1. PARK AND RECREATION COMMISSION.
There is hereby created a Park and Recreation Commission consisting of seven (7) members: The Park and Recreation Commission may be appointed as follows:
a. Two members to be recommended by the Mayor for appointment by the City Council.
b. One member to be recommended from the City Council for appointment by the City Council.
c. One member to be recommended from the High School District Board of Trustees for appointment by the City Council.
d. One member to be recommended from the City School District Board of Trustees for appointment by the City Council.
e. One member to be recommended from the Magnolia School District Board of Trustees for appointment by the City Council.
f. One member to be recommended from the City Planning Commission for appointment by the City Council.
g. Ex-officio members, without vote, may be appointed by the City Council as follows: The Superintendent of the High School District; the Superintendent of the High School District; the Superintendent of the Magnolia Elementary School District, and the City Manager.
Members of the Commission shall serve for a period of three (3) years. The first Commission to be appointed shall at its first meeting, so classify its members by lot that two (2) shall serve for one (1) year; two (2) shall serve for two (2) years, and three (3) shall serve for three (3) years. At the expiration of each term so provided for, a successor shall be appointed by the City Council for a term of three (3) years. Vacancies in said Commission occurring otherwise than by expiration of term shall be filled in the manner herein set forth for the unexpired term of the Commissioner leaving this office.
SECTION 2. ORGANIZATION OF COMMISSION.
Within fifteen (15) days after their appointment, the members of the Commission shall meet in regular session and elect from their members a Chairman and Vice-Chairman. Their duties shall be respectively such as usually carried by such officers. Officers shall hold office for one (1) person unless they are elected. The Committee adopts rules and regulations to govern their duties upon request assistance technical skills to communicate agencies and organizations with problems relating to park recreation and leisure activities and assist them in providing recreation services.
Conduct studies of local conditions and needs for Park and Recreation services and assist with recruitment and training of recreation personnel.
Prepare a budget request for review of the Park and Recreation Commission and present this request to the City Manager and budget committee for consideration.
Provide for recreation services operating costs for the ensuing fiscal year.
SECTION 3. RECREATION FUND.
There is hereby established a Recreation Fund. All monies accrued said fund shall be deposited with City Treasurer of the City of Anaheim. The Recreation Fund is agreed that all contributions shall be made for the promotion of recreation activities and programs in following proportions, to-wit by the City of Anaheim; 15% by Anaheim City School District; 5% by the Anaheim Union High School District; and 5% by the Magnolia Elementary School District. Notwithstanding this section contained shall be held until acceptance of donations from individuals to said Fund. All fees collected and/or fines levied at recreation activities shall be deposited in the Recreation Fund with the City Treasurer.
The City-Treasurer shall be custodian of all monies belonging to Recreation Fund and no monies shall be held unconstitutional, unless unconstitutional should affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it will have passed this Ordinance and no sections, clause or phrase unconstitutional, in reason held unconstitutional, should be closed unconstitutional.
SECTION 4. The City Clerk shall certify to passage of this Ordinance and all related documents.
WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did fix the 9th day of October, 1956, at the time, and the Council Chamber in the City Hall of the City of Anaheim as the place, for a public hearing upon said proposed change or changes of zone, and did give notice thereof in the matter provided in said Article IX, Chapter II of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did therefore consider the recommendations on the City Planning Commission, and did threaten adopt Resolution No. 2499 finding and determining that a change or changes of state should be made as set forth in said resolution.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:
SECTION 1.
That Article IX, Chapter 2 of the Anaheim Municipal Code 'establishment in the City of Anaheim and therein regulating them in land, height of buildings and yard space; adopting a map showing the boundaries of said zone; defining the terms used in said Article and Chapter; providing for amendment and enforcement thereof; prescribing penalties for violation and repealing all sections or parts of section in conflict therewith be, and the same is hereby changed the boundaries of the zone and for said Article IX, Chapter 2 by adopting a sectional Zoning Map or Maps showing such change or changes as follows:
1. Thus all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit:
Lots 1, 2, 3, 4, 5, 6, 7 and 8 of Tract Mile 2000 on South Placenta Avenue on the East side of the street just south of East Santa Ana Street.
now is Zone R-1, SINGLE-FAMILY RESIDENTIAL, and that it be changed to and incorporated in R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE Subject to the following condition:
that appropriate R-3 Deed Restrictions be placed or record as required by the City of Anaheim and approved by the City Attorney, covering the type of dwelling to be erected on said lots and confining the same to one-story in height.
SECTION 2.
The City Zoning Map shall be, and the same is hereby amended and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones abovetherefore laid out and sold. City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map and inserted in the Anaheim Municipal Code showing the changes hereby approved and adopted.
SECTION 3.
The City Clerk shall certify to the passage of this Ordinance and shall commence printing once within fifteen (15) days after adoption, in the Anaheim Gazette, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final message it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and signed by me this 25th day of November 1958.

AN ORDINANCE OF THE CITY OF ANAHEIM ESTABLISHING A PARK AND RECREATION COMMISSION AND THE OFFICES OF THE MEMBERS THEREOF: DEFINING ORGANIZATION AND DUTIES

Provide upon request assistance of financial nature to community agencies and organizations having problems relating to park and recreation areas, facilities and programs.
Concil with officials of public private organizations and other interested groups concerning community recreation and leisure activities and assist them in promotion and assistance services.
Conduct studies of local conditions needed for Park and Recreation devices and assist with recruitment and training of recreational personnel.

Section 8. RECREATION FUND.

Section 7. Ordinances, sentence clause or any unconstitutional, such entitlement shall not affect the remaining portion of this Ordinance. The City Clerk shall certify that it would be issued this Ordinance and each sentence, clause or phrase irrespective of the fact that it or more sections, sentences, etc., should be de-constitutional.
Section 9. City Clerk shall certify to the City of Anaheim and shall provide upon request assistance of financial nature to community agencies and organizations having problems relating to park and recreation areas, facilities and programs.
WHEREAS, the City Council does find that by provision of the applause growth and expansion of the City of Anaheim and the extension of its territorial limits, the large areas rapidly being incorporated into the City Limits, the diversity of interests therein, the necessity of making maps, and the careful study and thorough analysis of all the factors necessary in the establishment of proper zones in said area could enable time will necessarily shape before a survey can be completed and zoning plans completed and regulations formulated and established for the proper zoning and development of said areas, and that certain regulations are necessary to be adopted at a time in order to protect the public health, comfort and convenience and to promote public peace, safety and welfare pending the preparation and adoption of zoning plans and the establishment of zoned areas in said territory; and WHEREAS the City Council further finds that the regulations and provisions hereafter set forth in this section contained shall provide for less than one hundred dollars for said Fund. All fees collected fines levied at recreation access shall be deposited in the said Fund with the City Treasurer.
City-Treasurer shall be the plan of all monies belonging to recreation Fund and no money designated for it does not benefit city finance Director in accordance with laws governing the City of Anaheim.
NOW, THEREFORE, THE CITY CLERK OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:
SECTION 1.
No person, firm, corporation, or association shall hereafter, within the following described area in the City of Anaheim, California:
Beginning at the point of intersection with the western prolongation of the north line of Tract No. 1635, as shown on a Map in Book 49, page 2 of Miscellaneous Maps in the Office of the County Recorder of Orange County and the center line of Piscataqua County, northerly along the center line of Placenta Avenue to a building upon request assistance of financial nature to community agencies and organizations having problems relating to park and recreation areas, facilities and programs.
The City Council hereby reserves the right and power to grant variance permits for non-conforming uses under this Ordinance where unusual circumstances justify issuance and to avoid hardship and unfairness applications shall be made to the City Planning Commission and granted or denied in accordance with the provisions of Section 200.15 of the Anaheim Municipal Code.
SECTION 2.
Any person, firm or corporation, whether as principal, agent, employee or otherwise, violating any of the provisions of this Ordinance shall be guilty of a misdemeanor, and upon application shall be punishable by a fine of not more than Three Hundred Dollars ($300), or by imprisonment in the County Jail for a term not exceeding three (3) months, or by both such fine and imprisonment. Such person, firm or corporation shall be deemed guilty of a separate offense for each and every infringement of any portion of which violation may occur by such person, firm or corporation, committed or permitted by such person, firm or corporation, shall be punishable as herein provided.
SECTION 3.
All ordinances or parts of Ordinance in conflict herewith are hereby reported.
SECTION 4.
The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Gazette, a newspaper of general circulation in printed, published and circulated in said City, and thirty (30) days from after it is final passage it shall be fact-tested by hanging boundaries of the zone on said Article IX. Chapter 2 by adding a section Zoning Map or Maps such change or changes as low:
1. That all of the area situated in the City of Anaheim, County of State, California, deserves follows: to-wait:
Lot 221 of Tract No. 2277; as per recorded in Book 75. Pages 29-31 inclusive of The County Bureau office of the County Board said Orange County. (Said property is located at 819 South Euclid n.e.)
now is Zone C-1, NEIGHBOURHOUSE COMMERCIAL, and that is changed to and incorporated into GENERAL - COMMERCIAL ZONE upon the following conditions:
1. That the owner of subject land on land 53 feet in width at center line of street Euclid Avenue for street widening purposes.
2. That all buildings erected on
City Clerk shall certify to the City of this Ordinance and shall have the same to be published once and inadoption, in the Anaheim Gla. newspaper of general citation, printed, published and circulated in the City of Anaheim, and (30) days from and after its passage it shall be in full effect.

NEW THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAheim DOES ORDAIN AS FOLLOWS:

HEREAS, upon receipt of the art and recommendation of the Planning Commission, the City Council did fix the 14th day of October, 1858, as the time, and the Council Chamber in the City Hall made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map and inserted in the Anaheim Municipal Code showing the changes hereby approved and adopted.
SECTION 2.
The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Gazette, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from that date. The final passage of such take effect and be in full force.
