Supreme Court Upholds PUC Water Decisions The Supreme Court of California has upheld the precedent making decisions by the State Public Utilities Commission, issued Oct. 1, 1956, in which the Commission decided the applications of three water utilities under its jurisdiction which sought permission to serve overlapping areas in 100 square miles of fast growing Orange County. Petitions for writs of review were denied without comment by the high state court. As a result, the Commission's decisions will become effective in 30 days unless rehearings are granted by the Supreme Court. In deciding the applications of Dyke Water Company, Pacific Water Company and Southern California Water Company, the Commission declared that a state of emergency adversely affecting the public interest existed in southwestern Orange County. It created definite "Spheres of Operation" to which it limited the service of each company and provided that none of the companies could expand its service beyond the area for which it was certificated without prior approval. Rates to be charged in the various areas were authorized. The Commission also urged that the three utilities voluntarily work out a program for sale or purchase of so-called "Island water systems, operated by our utility within the area assigned and certificated to another water utility. At the same time the Commission decided a complaint can be filed by Orange County and Orange County Water Works Districts against Dyke Water Company. Hanna represents a large group of landowners, whose lands were ultimately excluded and he is being called as a witness marily from his experience dealing with the actual hearings, up which the Public Utilities Commission ultimately made the findings.
