Senate Agricultural Committee OK's Bill Favoring Dairymen SACRAMENTO (CNS) — The California state senate agricultural committee a few nights ago gave the lie to the naive belief that the people of this state reside in a democracy where free enterprise is encouraged, progress is looked upon as an everyday objective and under a constitution which guarantees that all individuals be treated alike. For the senate agricultural committee, goaded by the powerful special interests of the dairy men of the state, with only one dissenting vote gave a do pass recommendation to a bill preventing the manufacture of any product which "has the appearance or resemblance of a frozen dairy product." The dissenting vote came from Sen. John A. Murdy of Huntington Beach, Orange county, who declared after the committee hearing that "If we're going to have free enterprise let's have' it all the way." There is an interesting story behind the committee's action, which hinged on an attitude that has become almost a tradition in this state. This attitude involves the protection and coddling of the dairy interests of California far and beyond the point of the interests of the consumer, at least by the senate agricultural committee. During the first half of the 1953 session, a bill was introduced in the legislature permitting the manufacture of a product called Mellorine, a frozen dessert manufactured from vegetable oils rather than butterfat. "The measure had the full support of the high priced dairy distributors' lobby which recognized the fact that competition for ice cream was inevitable, and as one lobbyist described it, 'we want to make that product ourselves.'" Then the representatives of the men who milk the cows, the Western Dairyman's association, got wind of the bill, and stormed Sacramento with so much opposition that Sen. Earl Desmond, Sacramento, and the distributor lobbied decided to drop the bill. Later, however, the dairymen got wind of the fact that a large distributor of canned vegetable, orange juice, and other frozen products, intended to erect a factory to manufacture and distribute the frozen dessert. At the present time it can be manufactured and distributed as long as none of the operation occurs in a dairy plant, or is sold where dairy products are sold. The dairymen rushed to Sacramento and picked up senate bill 470, also by Sen. Desmond. They amended this bill on March 25, and the amendments completely cut out the provision of the original measure.
