Billy Rupp yesterday was ordered transferred to San Quentin prison to await his execution. Rupp reportedly showed no emotion an Superior Judge Kenneth Morrison pronounced his death. The judge did not set a date for the execution, allowing time for the automatic appeal of Rupp's conviction to the state supreme court. William Francis Rupp, Sr., was in the courtroom when the order was given for his son's transfer to the death house. Later he talked for a short time to the youth before the latter was returned to his jail cell. The dynamic, red-haired President of the big CIO Auto Workers Union, was conceded as having whipped together enough votes to get the CIO presidency in any convention showdown. Top officials were trying to get forces backing CIO Executive Vice President Allan S. Haywood, a 64-year-old veteran union leader who came up from the coal mines, to back off and concede to Reuther. But Haywood and his chief supporter, David J. McDonald, president of the big CIO Steelworkers Union, were still pledging a finish fight that could spill over on the convention floor. Selection of officers is due Thursday. The Haywood forces held a wildly-applauded rally tonight at which Haywood, McDonald and Presidents Joseph A. Beirne of the Communications Workers Union. $180,000 Damage Suit Filed in SA A damage suit for $180,000 suiting from the death of Hatch last Oct. 4 was filed perior court yesterday by the ow and daughter of the deceased Mrs. Mable Hatch and J Hatch, 14. Rupp, 18, was convicted Nov. 18 of slaying 15-year-old Ruby Ann Payne on Aug. 8 in the William Perry Dyer ranch home in Yorba Linda, where the girl was baby-sitting. Rupp was employed by Dyer as a beekeeper. The jury found that Rupp had bledgged the girl, thus her trial, then indicted her. Following the crime, the youth fled and the county police officers and volunteers on a three-day chase through the Brow hills before his capture on Aug. 12. When the jury convicted Rupp, they failed to recommend lenency which made the death sentence mandatory. On Nov. 19 the same jury found Rupp guilty and responsible for his actions. Former Head of Revenue Bureau Is Indicted NEW YORK, Dec. 2 (UF)—Joseph D. Nunan, Jr., the nation's former chief tax collector, was indicted today on charges of income tax dodging amounting to $91,068. He quit as head of the internal revenue bureau in 1947 and went back into private law practice. The tax indictment covers the years 1948 through 1950. For nearly four years before he left his government job, Nunan collected hundreds of tax stamps who collected billions and enforced stera crackdowns on tax offenses who withheld taxes. Nunan's former son side, Daniel A. Belich, was indicted Sept. 11 on similar charges of evading $7,444 in taxes during the same 1946-1950 period. He has pleaded innocent and is awaiting trial. Target of a house subcommittee tax scandal probe earlier this year, Nunan faces a maximum of 25 years in prison and $25,000 in fines if convicted on all five counts of the tax dodging indictment. He was not available for comment. His office and his home both reported his whereabouts unknown. Beirne of the Communications Workers and Michael J. Quill of the Transport Workers Union pledged a fight to the end in Haywood's behalf. They adopted a resolution, supported by more than a score of smaller unions, refusing any quarter in the fight and insisting Haywood's name will be put in nomination against Reuther. Haywood made his speech reminiscing on his 50-year record as a union leader and work in behalf of many CIO unions, and concluded by saying: "As long as you stay in this fight, I stay—we'll slug it out. I don't go for this technique of deciding things in caucuses." Oakfield the rally in his thick Irish brogue that the Reuther group is "G——D—— afraid to stand up and be counted—they're just afraid to face the music." The Haywood group was considering foregoing a test on a proposal to change the CIO constitution so as to require the CIO presidency to be a full-time job. Approval of such a plan would mean Reuther couldn't fill the job as long as he retained the presidency of the Auto Workers. Navy Secretary Announces Budget Appropriation for Super Carrier WASHINGTON, Dec. 2 (AF) — Secretary of Defense Lovett said today the new Defense Department budget would include money for the Navy to start construction of a third super aircraft carrier. He made the statement in answering news conference questions about the prospects of beginning work on another 60,000 ton flattop. The budget includes the department's spending requests for the fiscal year beginning next July 1. Lovett said inclusion of the new carrier item does not require the formal approval of the Joint Chiefs of Staff in which the Air Force had been opposed to the super-carrier program but only the "advice" of the Joint Chiefs. He said he had that advice. The Navy now has work underway on one giant carrier, the Forrestal, and the keel for a second, the Saratoga, is to be laid this month. Lovett took issue with a statement by Undersecretary of Air Darkness Halts Search for Missing AF Transport SAN BERNARDINO, Dec. 2. (AF) — Darkness tonight halted search for an air force transport believed to have crashed last night in the San Bernardino mountain with 13 men aboard. Capt. Howard K. Hoover of March air force base said the 36 planes in the hunt would resume the search at daybreak. He said no lead was uncovered in the day-longerial search. Air force and sheriff's rescue squadrons concentrated their search on the 8000-foot level near Big Bear lake, where a sheriff's deputy reported sighting a fire last night. The plane, a C-47, was based at Offutt air force base, Omaha; Neb., and was en route to March AFB, Riverside, Calif., from Davis. Monthan AFB, Tucson, Ariz. The plane was last heard from at 1:51 p.m. somewhere over the desert east of here. Ground parties from March and George AFB at Victorville and sheriff's deputies logged through snow filled canyons, but reported slow progress. Six inches of snow fell during the night to add to the two feet on the ground. Poor visibility prevented search planes from spotting wreckage in the rugged mountains. March field had 12 planes in the air. Others came from Norton AFB here. Air force officials theorized the pilot may have attempted to sift the storm in the 10,805-foot San Jacinto area by heading no. The spot where the fire was slid is well off the normal course from Tucson to Riverside. Deputy Sheriff Loring Pole of Victorville said he saw a fire in the mountains, perhaps miles from Big Bear lake, at 4 a.m. He said it was still smoking at daybreak, well above snowline. The strategic air command Omaha said the plane carried crew of four from Offutt A plus nine military passengers for various stations. County Sewer Ordinance Due For Overhaul Orange county supervisors yesterday overruled the county planning commission and granted Henry Cox permission to go ahead with a large residential subdivision in Garden Grove without connecting to a sewer trunk. Their action was one of several instances in which the county ordinance requiring the sewer hookup has been bypassed. County Counsel Joel E. Ogile said the ordinance is too indefinite, leaving too much latitude for discretion, thus making it subject to overruling by the courts. Enforcement of the ordinance would have required Cox to lay 3000 feet of sewer pipe to the nearest main. He told the supervisors he was perfectly willing to lay the pipe if it were understood that the Garden Grove sewer district would repay him later. The supervisors ordered a new survey of the county sewer situation to be taken by the planning commission in cooperation with the county health department and the water pollution board. It was noted that the survey will be complicated and can be expected to take some time. Discussion of the freeway extension project was given primary attention at the meeting because development of the highway will help relieve beach traffic congestion and will tie Orange county with a fast and a direct route to Long Beach, the directors declared. The directors also proposed improvement of several county roads, including Gardent Grove blvd., from Huntington Beach blvd. west to the Los Angeles county line, and improvement of Lincoln blvd., westward from Anaheim. of Durkin "Incredible" IN ANAHEIM ETTE 50 Cents per Month No. 284 CIO Battle ged as Nation s, Snow, Cold Including Anaheim. The weather, in one bad form or Explosive Protest May Foreshadow Battle Between Two Wings of GOP. WASHINGTON, Dec. 2 (UP)—Sen. Robert A. Taft, in an explosive protest which could foreshadow a great legislative struggle between two wings of the GOP, today labelled President-elect Eisenhower's choice of a secretary of labor as "incredible." The Ohio senator's blast over the selection of Martin P. Durkin shattered the outward show of harmony which prevailed between Eisenhower and the man he beat out for the Republican nomination. In a statement from Cincinnati, Taft described Durkin, 58-year-old head of the AFL Plumbers union, as a "partisan Trump Democrat." He said the selection was an "affront" to labor voters who backed the GOP ticket and also to Democrats who jumped party lines. And he brought the matter down to more immediate political cases by asserting that Herbert Brownell has been "the key man in cabinet appointments." Brownell, picked by Eisenhower to be attorney general, has been closely associated with the Republican group around Gov. Thomas E. Dewey and was Dewey's campaign manager in 1948 when the New Yorker defeated Taft for the nomination. Taft's implication was that the Dewey wing has taken over patronage and perhaps a commanding position on policy issues. Taft said he had talked to Brownell and made "several recommendations" for appointments, adding: "It was never even suggested that a man would be appointed who has always been a partisan Truman Democrat, who fought Gen. Eisenhower's election, and advocated the repeal of the Taft-Hartley law." By The Associated Press Millions of Americans plodded and splashed through snow and slush Tuesday. The slippery coating on streets and roads put the brakes on travel and resulted in a rash of motor vehicle accidents. Big areas of snow or sleet or rain or fog were marked off on the weather map. The weather, in one bad form or another, was blamed for 13 deaths. Snow that ranged up to six inches pelted a huge section of the nation. It extended from Illinois to the Atlantic coast and from Washington, D. C., to New England. Seven inches of snow, the first of the season and the heaviest since last December, piled up in Spokane, Wash. The Pacific coast region was doused by rain. Rain also fell in much of the South. A brief storm unroofed some houses in Los Angeles, and an inch and a half of rain temporarily flooded many streets. Temperatures hovered around the freezing mark in most of the snow belt in the Midwest, and East, and some of the snow melted. Only the five Soviet bloc countries voted for the immediate ceasefire. Forty one, including the U.S., Britain, France and Nationalist China, opposed it. Twelve countries abstained. They were Afghanistan, Argentina, Burma, Egypt, India, Indonesia, Iran, Iraq, Lebanon, Pakistan, Saudi Arabia and Syria. Ecuador and Yemen were absent. The general assembly was called to meet tomorrow afternoon to consider the peace plan. When it is approved, Assembly President Lester B. Pearson is expected to send it to Peliping and Pyongyang for consideration of the Chinese and North Koreans. Soviet Foreign Minister Andrei V. Vishinik apparently intended to put the neutralis, such as India and other Asian and Arab countries, on the spot with his motion for a cease fire now. They voted for the Indian peace plan approved by the committee yesterday but they sustained today when the ceasefire plan was put up separately. Little hope is held here that Red China and North Korea will accept the peace proposals approved by the committee. Representations of the west said however that they wanted to make the attempt regardless of almost certain rejection. Orange County Rolled up 89% Vote Nov. 4, Final Tabulation Reveals General election fever and numerous "get out the vote" campaigns seem to have had a desirable effect on Orange county voters. It was indicated yesterday by the report of County Clerk B. J. Smith, which showed that nearly 89 per cent of the county's voters went to the polls Nov. 4. The vote, probably an all-time record, was disclosed at PUC Hearing Considers PE Rate Increase Pacific Electric Railway Co.'s request for an immediate rate increase of 5 cents in interurban fares went before the California public utilities commission yesterday. The exact percentage of the 127,547 persons registered who voted was 88.65. Other interesting facts disclosed by the final tabulation included: the Ike-Nixon ticket ran up a total of 77,548 votes against 32,530 for the Stevenson-Sparkman combination: Stuart Hamblen was next in the standings with 501 votes for his Prohibition Party ticket; IPP candidate Vincent Hallinan received 227 votes; MacArthur and Tenney had 86, and MacArthur and Vivien Kellems on the Constitutional Party ticket received seven. Sen. William Knowland received the highest popular vote with 94,599 compared with 8317 for Reuben W. Borough, IPP candidate. Taft's mention of the T-H labor law, and of the secretary-designate's stand on it, opened up the question of just how much cooperation Elsenhower can expect on legislative matters from the senators who usually follow the Obama's lead. Durkin makes no bones about wanting more revision of the T-H law than Taft is likely to accept willingly, and he already has suggested new powers for the labor department that Taft may not want in the hands of a man whose selection he has criticized so roundly. Truman Accepts Resignation of Phillip Jessup WASHINGTON, Dec. 2 UP—It was made official today that Dr. Philip C. Jessup, ambassador-at-large and prime target of Sen. Joseph R. McCarthy, goes out of government service the day before the Republican administration takes over. President Truman accepted his resignation, effective Jan. 19, with high praise for his services as an international trouble-shooter and State Department adviser. Jessup will go back to his faculty post at Columbia University, from which he has been on leave since 1948. There had been no doubt that he would get out of government with or before the change of administration. McCarthy, Wisconsin Republican, has sailed into Jessup repeatedly in his campaign of charges that the State Department is influenced by Red sympathizers. He has accused the professor of having a "strange affinity for communist causes" and of having backed policies which fit into Red plans. Company officials say they lost nearly two million dollars on interurban passenger operations last year and $1,324,346 the first nine months of this year. D. R. He emphasized that, although a public utility, PE is a privately operated business pay-in high taxes and receiving no government subsidy. Faith Can Be A Farce Rev. BOB KEVORKIAN "I believe that if a person is sincere in what he believes and has faith in this belief, he will find happiness and fulfillment to life." This seems to be a bad in modern thinking. It probably is very popular because it makes such a convenient rationalization by which to live. "Think of it! I can believe anything, and if I believe hard enough it will come to pass. Why I can even make white men black!" Imagine an intelligent human being leading himself into such a naive intellectual trap. Sincerity is no criterion for truth. One can be sincerely wrong. Faith is only meaningful when the object in which one puts his faith is valid. Some people are idolators. They put their faith in things. Blind fate is the only principle of such a belief, and the results all ways lead to disillusionment. The Bible says, "There is a way which seemeth right unto a man, but the end thereof is the way of death." Faith in God is the only answer, for God alone has the power of the universe. More than that, He alone has power to forgive sin. His son, Jesus Christ, came into this world to reveal His interest in us. He leaves us. He alone can meet our needs adequately.
