The statement, as played back to the jury, got the defense theory into the record, namely; that when Proctor left his apartment at 8 a.m. on Aug. 25, leaving Mrs. Schindler in bed, she was alive and unhurt; that when he returned about two hours later with some asthma medicine for her, he found her dead or dying, her face bruised and bloody. The defense contends that someone else must have entered the apartment during Proctor's absence and assaulted the woman. It is believed likely that Proctor will not take the witness stand in his own defense, since the tape recording told his own story. He would thus escape prosecution cross-examination. Efforts of the defense to throw suspicion on Henry Goff, whose association with Mrs. Schindler, including a two-day trip to San Juan Capistrano, touched off the quarrel in the Gould apartment were countered by the prosecution. Deputy District attorney James P. Devine introduced testimony accounting for Goff's movements on the night of Aug. 24, when he was in a Newport blvd. bar from 9 p.m. to between 1 and 2 a.m. The time between 8 a.m. and 10 a.m. on Aug. 25, however, remained to be accounted for. "I don't know much about airplanes," McPhail said. "But I still don't see how the pilot ever got us down. When we landed, they threw ropes out the doors and out of an emergency door on the left side of the plane. "Most of the men jumped down, but the women slid down the ropes. One of the women, who said she was 82, wrapped a magazine around the rope to protect her hands and slid right on down. "It seemed that we had no sooner got out of the plane than the whole thing burst into flames." The injured passenger was Miss Jesse Watts, Greensboro, N.C., who skinned a leg sliding down a rope.
