McCloy reported to Washington today that West Germans — spurred by socialist criticism — are "in a mood of impatient rebellion" against the occupation powers. But most Germans, McCloy said in his quarterly report to the State Department, "have made the choice, in their own hearts, to identify their lot with that of the west." "The difficulties which have arisen in Germany's relations with the occupation authorities do not spring from basic antagonism but are the normal outcome of protracted foreign occupation of a country which is rapidly recovering a sense of independent statehood," his report said, adding: "There is a strong and often disturbing tendency for the Germans to indulge in criticism of occupation policies with the attractive thought that these are solely responsible for Germany'sills." In their dealing with the Allies, McCloy said, the Germans are "inclined to exaggerate their burdens and grievances, to make excessive demands and even to display an attitude of intransigence quite inappropriate to the realities of Germany's present position and actual interest." Who Won What? CLEVELAND (UP)—Who won this fuss? Mrs. LaVerne Murphy, 35, obtained a divorce and custody of their five children yesterday on the grounds her husband was more interested in his ham radio station than supporting the family. Capping a courtroom performance yesterday that ranged tears to coughs, Miss Bankhead angrily left the trial for 20 minutes after defense counsel told the judge to make her "keep mouth shut." She told newsmen she was out because she was "disgusted with the tactics" of State trooper Fred J. Moritt, chief dept counsel. Moritt twice complained of Bankhead's "sounds and facial pressions." He said these actions "might be all right radio program" but not in a room. General Sessions Court J. Harold E. Stevens refused to mand her, saying he saw no disturbing in Miss Bankhead conduct. Sincere St. Cyr Relieved, Goes To Florida Club BEVERLY HILLS (AP) — Lill St. Cyr's dance, "Interlude Before Evening," is not inimical to the public morals, a jury has decided. The blonde strip dancer was acquitted yesterday of giving an indecent performance last Oct. 19 in Ciro's night club. The jury deliberated an hour and 18 minutes. "I'm really relieved," the glamorous Lill said after she had shaken hands with all the jurors. 10 women and two men. "It's wonderful and a real victory." Whereupon she threw her arms around her lawyer, Jerry Giesler, to the accompaniment of flashbulbs. Lill didn't mention it directly, but the verdict and the publicity attending the six days of her trial won't hurt her drawing power. She did say that she is leaving Friday for an engagement at a Miami Beach, Fla., night club, and that in March she may go to Paris to exhibit her talents. And only a few years ago Lill was dressing and undressing her way through her act four times a day in a burlesque theater on Main street, right in the heart of Los Angeles' skidrow. But as Attorney Giesler told the jury: "Lill has come a long way up the ladder to the very top of her profession. She's an artist." TELLS OF FAST PROFIT—Frank E. McKinney, Democrat national chairman (above), tells a news conference in Washigton D. C., that he and Frank M. The number compares with a total of 339,000 who took the test last spring and summer. The testing system was set up by selective service to give its local draft boards evidence of a student's ability to continue college study. The score on the test and the student's scholastic rank in his class may be used as a guide by the draft board for an educational deferment. The present yardsticks for deferment are a score of 70 or a ranking in the upper half of the freshman class, the upper two-thirds of the sophomore class, the scale." "My client took care of Miss Bankhead's gigolos (she had 'three lovers within three months that we know of')—that was the money for sex." "Tallulah Bankhead taught Mrs. Cronin how to roll marijuana cigarettes... I want to shield the names of those who smoked them, whom she paid and the parties." (He challenged the state to ask Mrs. Cronin the names.) "When Mrs. Cronin used to go to her for money, she used to beat her unmercifully." (Moritt said this made his client afraid to ask for money, so she paid out her own funds for Miss Bankhead.) "The language she (Miss Bankhead), used everyday—I won't tell you. My client will."
