The jury convicted McCracken of child stealing, acquitted him for kidnapping and disagreed on the murder charge.
Chula also filed a motion today for a delay of at least 30 days after the trial, to permit the defense raise funds for investigation, and also for payment for counsel fees. It has been understood that Chula was handling the defense without pay. That motion is likewise slated for hearing tomorrow.
The Fourth District Court Appeals at San Diego today denied a writ of prohibition asked by the McCracken lawyers to delay the second murder trial until after McCracken has had an insanity trial, in connection with his conviction of child stealing. He had pleaded not guilty by reason of insanity on all three counts against him. Judge Gardner denied a defense motion to hold the insanity trial ahead of the second murder trial.

Doctors Battling Wisconsin Town's Small Pox Threat
REEDSBURG, Wis. (AP) — A team of doctors worked towards a goal of 7,000 small pox vaccinations today as this small central Wisconsin community sought to complete its protection against an outbreak of the ancient scourge.
Six doctors, working in an improvised clinic set up in a high school, handled a constant stream of people all day yesterday. They expected to vaccinate 7,000 by noon today, completing the job. Although the population of Reedsburg is 4,300, medical officials decided families in the surrounding farm area also should be treated.
The campaign started yesterday after the illness of a 55-year-old rural woman was diagnosed as smallpox. Symptoms develop eight to 16 days after exposure.
