excused during the argument.
Monroe contended that in a case involving the death penalty, where the jury may recommend life imprisonment, the jury is in a quasi-judicial position of determining the punishment as well as the guilt, therefore should be in possession of "mitigating circumstances."
In this case, with McCracken charged with the kidnap-murder of Patty Hull, 10-year-old Buena Park girl, the fact that he has been declared by three psychiatrists to be a sexual psychoathist is information that the jury should have, Monroe argued.
The motion, which was believed to be preliminary to a move to have the criminal proceedings set aside and McCracken handled under the amended statute providing commitment of sexual psychoaths to an institution for medical care, brought a prompt objection from Deputy District Attorney Jones, who declared the motion was "premature", McCracken has not yet been convicted of a sexual charge, said Jones, and that requisite to the institution of proceedings under the sexual psychoathist law.
The prosecution, in fact, is known to have avoided charging McCracken with a sex crime, in order not to open the door to a sexual psychoathist proceeding even if McCracken is convicted. McCracken, the prosecution contends, is charged with murder and kidnapping.

through the early morning darkness and raised havoc with the Kang-Dong rail yards 15 miles east of Pyongyang.
Lt. Charles A. Williams of Tulsa, Okla., who led the strike, reported rails were twisted and ripped from their ties. Twenty rail cars were reported destroyed and another 20 damaged.
The Shooting Stars swept over the town so rapidly, Williams reported, that red antiaircraft didn't open up until the jets had dumped their bomb loads and were out of range.
Lt. Donald Vanderkarr of Kankakee, Ill., led a later jet strike on Kang-Dong. He said it destroyed a double-deck rail and road bridge with accurate bomb hits.
Four waves of B-29 superforts rained more than 1000 bombs on Sariwon, rail and highway town between Pyongyang and Kaesong, site of cease-fire talks. Half the bomb load was dumped by radar techniques.
Two Allied planes were lost Monday when 670 sorties were flown.

Marine and Air Force fighter planes hit communist troops near the center of the battle line.
F-51 Mustang pilots said they inflicted 75 casualties and knocked out 71 guns in strikes near Kumhwa.
"They were in the open when we sighted them," said 2nd Lt. Lewis F. Gred, Jr., flight leader from 228 Seville st., Fontana, Calif. "But when we started our attack they dove for some bunkers on the ridge."
"Our napalm (jellied gasoline bombs) covered the ridge and when they came out of the bunkers we caught them with our not yet been convicted of a sexual charge, said Jones, and this is requisite to the institution of proceedings under the sexual psychopath law.
The prosecution, in fact, is known to have avoided charging McCracken with a sex crime, in order not to open the door to a sexual psychopath proceeding even if McCracken is convicted. McCracken, the prosecution contends, is charged with murder and kidnapping, not a sex offense. Monroe argued yesterday, however, that regardless of this, there is a sex offense involved.
When Monroe concluded, Judge Gardner ruled that the motion was premature, and that, in any event, despite "adroit legal reasoning," to grant it would be flying in the face of the law on sexual psychopath proceedings.
In preparation for resumption of the trial tomorrow, Chula is understood to be seeking the testimony of a prominent Long Beach woman psychologist, as well as expert medical witnesses, to combat state testimony, particularly that dealing with the asserted mistreatment of Patty after she had been killed.
