Voluntary Plans For Disability Insurance Form Filling with the California secretary of state of regulations governing administration of the new unemployment compensation disability benefits program opens the way for prompt approval of voluntary plans of disability insurance coverage which many businesses will substitute for the state's plan. It was announced today by T. H. Mugford, vice chairman of the California Employment Stabilization Commission. The disability insurance system becomes operative December 1, when the state will accept first claims for benefits payable to persons who become unemployed because of illness or non-occupational injury. The program applies to all persons employed in occupations covered by the Unemployment Insurance Act. "Many of the business firms who are establishing voluntary plans have asked that they become effective on December 1," Mugford said. "The commission will approve promptly all qualified voluntary plans which desire to become effective on that date. Approval of other plans with later effective dates will be granted as quickly as possible." All regulations covering administration of the disability insurance system have been adopted with three exceptions, Mugford said. Absence of those three points will not prevent the program from going into effect on December 1. "Pending final determination of the definition of 'regular wages' benefit payments will not be made where they overlap wage payments," Mugford declared. If any section, subsection, paragraph, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity or constitutionality of the remaining portions of this commander. The Board of Supervisors hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that one or more of the sections, subsections, sentences, clauses or phrases thereof be declared unconstitutional or invalid. The system is a part of the state's unemployment insurance program and is financed entirely by the one per cent payroll tax which the employee formerly paid into the unemployment insurance fund. Since May 21 that tax has been paid into the disability insurance fund, and no additional tax will be levied against either the wage-earner or the employer to pay for the disability program. Voluntary plans may be substituted for coverage under the state system with the consent of the employees to be covered. The voluntary plan, to be approved by the employment stabilization commission; must provide greater benefits to employees than those provided by the state. In addition, the employee no longer pays the one per cent tax to the disability fund, although he may contribute up to one per cent of his wages to support of the voluntary plan. The packages are required to be carefully wrapped, fully addressed and labeled "Christmas package". Gifts for Army personnel must be sent by Friday because a written request from the soldier after that date is required.
