ORDINANCE NO. 496 AN ORDINANCE OF THE COUNTY OF ORANGE AMENDING ORDINANCE NO. 492 OF THE COUNTY OF ORANGE. The Board of Supervisors of the County of Orange, State of California, also acting as the Board of Supervisors of the Orange County Flood Control District, and other districts for which the Board of Supervisors are the governing body, do ordain as follows: SECTION 1. There is hereby added to Ordinance No. 492 of the County of Orange a new section to be numbered 3 (a) which shall read as follows: "Section 3 (n). Temporary Employees. Should it become necessary, advisable, or desirable for the Board of Supervisors of the County of Orange to employ a person on a temporary basis for which there is no classification, or for which there is an improper classification in this Ordinance provided, then in that event, said Board may employ any person at a salary to be determined by Minute Order of said Board and said employee shall be paid by warrant of the County of Orange; provided that, said employee or employees so employed and paid by warrant, shall be temporary in character and shall not become a member of the Retirement Association of the County of Orange, unless by Resolution of this Board said employee or employees are included in said Retirement Association." SECTION 2. That Section 7 of Ordinance No. 492 of the County of Orange be and the same is hereby amended to read as follows: "Section 7. Leave of Absence. (u) Whenever any person who is holding a position provided for by this Ordinance is compelled to be absent from duty on account of injury arising out of and in the course of his employment, such person shall receive full compensation during the first 7 days of such absence but thereafter compensation shall be paid in accordance with the provisions of the Workmen's Compensation Act of the State of California. (b) Whenever any person who is holding a position provided for by this Ordinance, the compensation for which is on a monthly basis, and who has performed one or more months of actual continuous service during the current fiscal year or the preceding fiscal years, is compelled to be absent from duty on account of illness or injury, other than injury arising out of and in the course of his employment, such person shall receive full compensation during the working days of such absence (Saturday considered one-half working day), on the following basis: Such employee shall only be entitled to one (1) working day with full compensation for each month of actual continuous service, cumulative up to but not to exceed thirty (30) working days. (c) Whenever any person who is holding a position provided for by this Ordinance, compensation for which is on a per diem basis, and who has performed one or more months of actual continuous service during the current fiscal year or the preceding fiscal years, is compelled to be absent from duty on account of illness or injury, other than injury arising out of and in the course of his employment, such person shall receive full compensation during the working days for such absence, on the following basis: Such employee shall only be entitled to one (1) working day with full compensation for each month of actual continuous service, cumulative up to but not to exceed thirty (30) working days. (e) No department head may employ a person from outside the county or from our department as a substitute regular employee who is on an absence with pay on account of time service, nor shall any person within the department substitute for any person who leave of absence with pay on count of overtime service, when assignment or transfer result increase in pay to such person or transferred. It being that of this provision that where there are allowed time off with overtime service the department perform the work of such person without additional cost or expense." SECTION 20 A. Saving Clause. If any paragraph, sentence, clause or phrase of this Ordinance, for any reason is held to be unconstitutional or invalid, such shall not affect the remaining portions of this Ordinance, and the Board of Supervisors hereby declares it would have passed each paragraph, sentence, clause and phrase thereof irrespective of the fact that any one or more than one sentence, clause or phrase be declared unconstitutional or invalid. SECTION 8. Enactment Clause. This Ordinance shall take effect and be in force 30 days from and after its passage, and prior to the expiration of 16 days after the passage thereof, this Ordinance shall be published for one week in the Anaheim Gazette, a newspaper printed in the County of Orange. This means a resolution setting out how it shall be debated and voted on. The rule allows so much time for debate; tells what amendments may be offered, and sets forth procedural details. The rules committee is the most powerful committee in the the congress, and is controlled strictly by the administration in power. The rules committee allowed us 16 hours general debate on the British loan, and 4 hours general debate on how to control the secrets of atomic energy. The administration allowed us only one hour on the report from the conference committee which brought us yesterday a completely changed ineffectively trying to hide the incompetencies of UNRRA, and with Mr. Bowels' obvious relief on getting away from the most monumental failure in the history of government, the former OPA. I admit frankly that I do not face those appointments with high hopes. There are improvements in the new measure, and some good things; there are more confusions and uncertainties. Prices are raising, with or without OPA. Price rises have been inevitable since President Truman broke the wage line after V-J Day. The problem has been to release the production power of America. These things will prevent inflation: A balanced budget, a brake on the pouring of money into an economy threatened with inflation. Press Preview Living Picture Set For Monday Prominent art critics, national magazines, souvenir newspapers other representatives on listing and allied fields verge at Laguna Beach on day evening for a press of the Pageant of the featured attraction of the Ed Laguna Beach Festival. A select group of tabluring the Last Supporter premiere scene of the presentations of the famous Flag Raising on will be given at the preceding attraction of Frederick Soo sky, director. Following the pageant pictures at Irvine Bowl later, adjacent to Laguna recreational park, a buff will be given at Don Ma Brazil on North Coast Lakes. That will give you some idea of relative values in Washington, at the moment. You will read in the papers, and hear over the radio, that this OPA extension protects free enterprise and allows the costs of production, but only in this column and others like it will you read the three lines, which immediately follows that section of the bill. Here they are; read them carefully: "Nothing herein shall nullify the power of the Administrator to make reasonable adjustments AND EXCEPTIONS in individual cases under the provisions, (just referred to.)" The new act provides divided authority, and sets up a "Decontrol Board," giving it more absolute power than congress has given any previous board of agency; witness this: "Orders of the Board shall not be subject to modification or review by any other department or agency or by any court." Who will be appointed to this decontrol board, at salaries of $12,000 each. I wonder. With memories of Harry Hopkins placed in charge of lend-lease, which we settled a few days ago by wiping off a 80-billion dollar loss; or Mr. Lehmann and Mr. LaGuardia. We had 23 days evidence of the power of production, before we decided to go back to the hair of the dog that bit us. We are now back where we were. The bill is in the senate. Black-market operators will rejoice if it goes to the White House. Subsidies would still be with us. The President vetoed a more workable bill. What will he do with this monstrosity? In the house, Mr. Lea of California moved to recommit the report and bring back only rent controls. The vote was 135 ayes; 219 noes; 2 paired and therefore voting "present," and 74 absent or not voting. There are 5 vacancies. Of the California delegation, 4 voted aye, 13 voted not to recommit, and 6 were absent. On the final vote, the house voted 210 in favor of accepting the report, that is, in favor of bringing back the OPA; 142 voted against it, the highest proportion yet to vote "no,"; 2 again voted "present," and 76 were absent or not voting.
