ORDINANCE NO. 479 AN ORDINANCE PROVIDING REGULATIONS FOR THE SUBDIVISION OF LAND IN THE UNINCORPORATED AREA OF ORANGE COUNTY, CALIFORNIA, AND FOR THE PREPARATION AND PRESENTATION OF SUBDIVISION MAP'S THEREOF; AND REPEALING ORDINANCE NO. 296. In order to promote the: (a) Public health, safety and general welfare, (b) Orderly growth and development of the County, (c) Proper use of land, (d) Conservation, stabilization and protection of the value of property, (e) Adequate provision for necessary utilities and conveniences, the Board of Supervisors of the County of Orange, State of California, do ordain as follows: SECTION 1. AUTHORITY. Pursuant to the State of California "Subdivision Map Act", the provisions of this Ordinance are supplemental to those of said Act and shall apply to all subdivisions hereafter made, of land entirely or partially within the unincorporated territory of Orange County, California; and, all terms used herein which are defined in the "Subdivision Map Act" shall have the same meaning as ascribed thereto. 2. Name and address of owner and subdivider. 3. Name and address of person preparing map. 4. Approximate acreage. 5. North point. 6. Scale. 7. Date. 8. Boundary line. 9. Location and name of streets. 10. Width of streets. 11. Name: location and width of adjacent streets. 12. Proposed street grades. 13. Street grades beyond tract. 14. Cross sections of proposed street improvements. 15. Width of alleys. 16. Width of easements. 17. Dimensions of reservations. 18. Existing structures. 19. Location of existing and proposed public utilities. 20. Existing sewers. 21. Elevation of sewers at proposed connections. 22. Existing water mains. 23. Existing culverts and drain pipes. 24. Land registered. B. PROCEDURE— 1. After noting the above, the subdivider should confer with the staff of the Planning Commission before preparing the tentative map of the proposed subdivision. 2. Prior to filing of a tentative map, a number shall be obtained from the County Surveyor upon deposit with him of $5,000, the final map recording fee. If the subdivision map is withdrawn prior to recordation, the fee will be returned. 3. The tentative map shall be pre- Campaign Started To Recruit 20,000 Waves Ensign Bertha Anderson The United States navy is urgently in need of recruiting 20,000 Waves and of this number 50 per cent of them are needed in the hospital corps to meet the increasing demands for hospital personnel and to care for the growing numbers of navy and marine wounded. In spite of the more favorable war picture navy and marine casualty lists have greatly increased and the wounded must be cared for for many months to come. To meet the requirement 2000 Waves must enlist each month and Orange county has a quota of 11 to meet during August. Ensign Bertha Anderson in charge of the recruiting party will be in the Anaheim Chamber of Commerce office on Aug. 22-23. NOTICE IS HEREBY GIVEN to the creditors of and all persons having claims against the said decedent or sold estate to file them with the necessary vouchers in the office of the Clerk of the Superior Court of the County of Orange, State of California, or to present the same, with the necessary vouchers, to the undersigned at the undersigned's place of business, to-wit: L. SECTION 2. STANDARDS OF DESIGN. The following shall be the standards of design except in those cases where the Orange County Planning Commission determines that the size of shape of the land, topographical conditions or proposed land use make compliance therewith impractical. STREETS A. The subdivision plan shall conform to the official or master plans of highways. B. The street system in the proposed subdivision shall relate to the existing streets in the area adjoining the subdivision. All existing local streets adjacent to the subdivision need not be carried into the new subdivision. C. Half-width streets shall not be permitted. D. Along major highways, a service roadway separated from the major highway by a 20 foot planting strip will be required for access to private property and local streets. E. Minimum widths for major highway, service road and planting strips shall be: Center planting strip...20 feet Roadway (2)...36 feet Planting Strip (2)...20 feet Service road (2)...32 feet Parkway (2)...5 feet Sidewalk (2)...5 feet F. General, local street rights of way shall be not less than 60 feet wide. G. Short, local street rights of way shall be not less than 50 feet wide. H. Steep hillside, local street rights of way shall be not less than 40 feet wide. I. Design of local streets where railroads, parkways, grade separations, freeways or hillside territory is involved shall receive special attention. J. Dead-end streets shall be terminated by a turn-around not less than 100 feet in diameter separated to the depth of one lot from the exterior boundary line or other topographical features of the subdivision. K. Street grades between 6 percent and 10 percent will be approved only for such distances as topographical conditions make a lesser grade impractical. A grade exceeding 10 percent will be approved only when conclusive evidence shows that a lesser grade is impractical. L. navy and marine casualty lists have greatly increased and the wounded must be cared for for many months to come. To meet the requirement 2000 Waves must enlist each month and Orange county has a quota of 11 to meet during August. Ensign Bertha Anderson in charge of the recruiting party will be in the Anaheim Chamber of Commerce office on Aug. 22-23 from 9 a.m. until 5 p.m. to meet prospective enrolees and answer all pertinent questions. Eligibility requirements are that applicants must be 20 to 36 years of age, in good health, at least two years of high school, single or married with no children under 18. They may volunteer for overseas duty and they may also state a preference for stations in this country and for type of duty. The navy's policy is to grant these requests as far as possible. On Aug. 20, 21, 24 and 25 Wave representatives will be at the Fullerton city hall while this week, Aug. 13 through 18, they are in Santa Ana at the post office building. Santa Ana Boy Confesses Forging Checks Here A 16-year-old Santa Ana boy was arrested last week in Santa Ana and accused with forging endorsements on checks totaling $921 and passing them on stores in Santa Ana, Anaheim, Fullerton and Orange since July 21. When confronted with the evidence the youth admitted forging the checks and said that he made good on some of the bad checks by cashing other forged checks. The police reported that the youth had made most of the checks good since the boy's arrest, using family funds to pay off the victims. Design of local streets where railroads, parkways, grade separations, freeways or hillside territory is involved shall receive special attention. J. Dead-end streets shall be terminated by a turn-around not less than 100 feet in diameter separated to the depth of one lot from the exterior boundary line or other topographical features of the subdivision. K. Street grades between 6 percent and 10 percent will be approved only for such distances as topographical conditions make a lesser grade impractical. A grade exceeding 10 percent will be approved only when conclusive evidence shows that a lesser grade is impractical. L. Curved streets in comparatively level locations shall have a centerline radius of 500 feet or greater and 300 feet or greater in steep hillside locations. M. Street corners shall have a minimum 25 foot curb radius with the property line designed so as not to reduce the parkway widths. N. All street connections shall be at approximate right angles. ALLEYS A. Improved alleys 20 feet wide shall be provided at the rear of all lots. B. All alley intersections shall have corner cut-backs of not less than 10 foot radius. C. Alleys in the rear of business, industrial or income property shall be designed and located according to the plan for the development of the particular use involved. UTILITIES A. Overhead utility lines shall be located at the rear of all lots. LOTS A. The minimum size of lots shall be 60 feet wide and 120 feet deep. B. Corner lots shall have a minimum width of 65 feet. C. No lot shall be divided by a city or county boundary line. D. Side lines of lots shall be approximately normal to the street line. E. When large lots are proposed, the shape, building locations and building lines may be required to be so established as to make it practical to resubdivide the lots into building sites approximately 60 feet wide by 20 feet deep without injury to adjoining lots. BLOCKS A. Blocks less than 1200 feet in length may be cause for disapproval of a tentative map. B. Pedestrian ways at least 10 feet wide may be required in long blocks. SETBACK LINES A. The front setback line for buildings on lots shall not be less than 25 feet. B. Residences shall not be built nearer than 5 feet to any lot side line. C. Setback lines in park areas shall be established so as to control recreational use and building locations. SECTION 3. TENATIVE MAP. A. REQUIREMENTS— 1. Title of subdivision and description of property. Within 30 days after a tentative map has been filed, the Orange County Planning Commission shall report in writing to the subdivider the approval, conditional approval or disapproval of the map and the conditions on which such action is based. On the official filed copy of the tentative map a statement shall be made covering such action. 9. As soon as the Orange County Planning Commission has approved, conditionally approved or disapproved the tentative map, a copy shall be sent by the Planning Commission to the Real Estate Commissioner of the State of California, together with the action taken thereon by the Planning Commission. SECTION 4. FINAL MAP. A. REQUIREMENTS— 1. If more than 3 sheets are used, an index showing entire subdivision, with lots numbered consecutively. 2. Title, name of tract, date, north point and scale. 3. Description of land included. 4. Location and names, without abbreviations of all: a. Proposed streets and alleys. b. Proposed public areas and easements. c. Adjoining streets. 5. Dimensions in feet and decimals of a foot. 6. Dimensions of all lots. 7. Center line data including bearings and distances. 8. Radius, tangent, arc and central angle of curves. 9. Suitable primary survey control points. 10. Location of all permanent monuments. 11. Tiles to and names of adjacent subdivisions. 12. Tiles to any city or county boundary lines involved. 13. Location of all setback lines. 14. Required certificates. 15. Net acreage of all lots of 1 acre or more. B. PREPARATION— After approval of a tentative map by the Orange County Planning Commission, the subdivider may cause a final map to be prepared in accordance with a completed survey of the subdivision and in substantial compliance with the approved tentative map, and in full compliance with the "Subdivision Map Act" and this Ordinance. 1. SIZES AND MATERIALS—The final map shall be clearly and legibly delineated upon tracing cloth of good quality. All lines, letters, figures, certificates, acknowledgments and signatures shall be made in black waterproof india ink, except that affidavits, certificates and acknowledgments may be legibly stamped or printed upon the map with black opaque ink. The size of each sheet shall be 18 by 26 inches. A marginal line shall be drawn completely around each sheet, leaving an entirely blank margin of one inch. TITLE SHEETS — Below the title shall be a sub-title consisting of a general description of all the property being subdivided, by reference to deeds, subdivisions or to sectional surveys. References to tracts and subdivisions shall be spelled out and worded identically with original records, with complete reference to proper book and page of the record. The title sheet shall show in addition the basis of bearings. Maps filed for the purpose of reverting subdivided land to adreage shall be conspicuously marked under the title "The Purpose of this Map is a Reversion to Acreage." 3. CERTIFICATES — Forms for certificates required by the "Subdivision Map Act" and this Ordinance may be secured from the County surveyor. 4. SURVEYING DATA FOR LOTS — Sufficient data shall be shown to determine readily the bearing and length of each line. Dimensions of lots shall be the net dimensions. No ditto marks shall be used. Lots containing one acre or more shall show net acreage to nearest hundredth. 5. SURVEYING DATA—The final map shall show the center lines of all streets, length, tangent, radius and central angle or radial bearings of all curves; and the bearing of radial lines to each lot corner of a curve, the total width of each street, the width of the portion being dedicated and the width of existing dedication, and the width each side of the center line, also the width of rights of way of railroads, flood control or drainage channels and any other easements appearing on the map. Surveys in connection with the preparation of subdivision maps as in this Ordinance provided shall be made in accordance with standard practices and principles for land surveying. A traverse of the boundaries of the subdivision and all lots and blocks shall close within a limit of error of 1 foot in 10,000 feet of perimeter. 6. RECORD OF EASEMENTS—The final map shall show the center line data, width and side lines of all easements to which the lots are, storm drains, sanitary sewers, permanent subdivision monuments or such other structures, or improvements, as recommended by the Orange County Planning Commission, and/or deemed by the Board of Supervisors to be necessary for the general use of lot owners in the subdivision and local neighborhood traffic and drainage needs. All improvements shall be installed to grades approved by the County Road Department. Plans, profiles and specifications of proposed street improvements shall be furnished to the County Road Department prior to the time of submitting the final map to the County Surveyor, and be approved by the County Road Department before the map shall be filled with the Board of Supervisors. These plans and profiles shall show full details of the proposed improvements, which shall be according to the standards of the County of Orange. If street lights, water mains, sanitary sewers, or storm drains are to be installed as a part of the improvements of the subdivision, plans, profiles, specifications and all necessary details of the proposed construction shall be submitted to the County Surveyor prior to the time of submitting the final map for checking, and be approved by him before the final map shall be filled with the Board of Supervisors. These plans and profiles shall show full details of the proposed improvements which shall be according to the standards of the County of Orange. If such improvement work be not completed satisfactorily before the final map is approved, the owner or owners of the subdivision shall immediately upon approval of the final map, enter as contractor into an agreement with the Board of Supervisors whereby, in consideration of the acceptance by the Board of Supervisors of the streets and easements offered for dedication, the contractor agrees to furnish the equipment and material necessary and to complete the work within the time specified in the agreement. To assure the county that this work will be completed, a bond shall be furnished guaranteeing the faithful performance of the work in the sum equal to the estimated cost. This bond may be furnished by a qualified surety company, except in cases where a cash deposit is required by the Board of Supervisors. E. The depart- Le Roy Harvill Merits 3-Grade Army Promotion With the 24th Infantry (Victory) Division on Minadao (Delayed)—Leroy M. Harvill, son of Mr. and Mrs. Henry Harvill of Route 3, Anaheim, has been given a jump from private first class to sergeant in a three-grade promotion for proven ability as rifle squad leader and his buddy, John A. Kujala of Fort Bragg, Calif., was likewise promoted. During the costly crossing of the Taloma river on this island by L Company of the battle-searred 34th Infantry regiment, several sergeants became casualties. Harvill and Kujala each completed the missions as squad leaders and continued in command in a manner that brought high praise from company officers and ultimately resulted in the promotions. In their 16 months overseas the two men have completed seven campaigns including those of New Guinea and Biak. During the fight for the liberation of the Philippines their unit made beachhead landings on Leyte's A-Day and on Luzon with a spearhead attack on Bataan. They were among those chosen to assault Corregidor which was followed by a 150-mile drive across Mindanao to the city of Davao. Most of the California canning tomato crop has been sold for delivery directly to the military forces. Substantial Gain In Gasoline Taxes California gasoline taxes for the half-year ending June 30, 1945, are $26,386,513, a gain of $2,184,-450 over the same period for 1944. This represents an increase of 9 per cent. R. E. Collins, chairman of the State Board of Equalization, made known this revenue increase today, following completion of June, 1945, tax assessments amounting to $4,708,465, based on distribution of 156,948,864 gallons of motor vehicle fuel. It is a gain of 12 per cent over June, 1944, during which month tax assessments totaled $4,204,161. California use fuel taxes assessed against diesel-operated trucks and buses continue the same trend of increased revenue as the gasoline tax. Chairman Collins disclosed that for the first six months of 1945 the tax collected was $852,031 as against $721,195 during the same period in 1944, a gain of 18 per cent. For the month of June, 1945, the tax collected was $150,920, a gain of 15 per cent over the same month in 1944, when $131,662 was collected.
