ORDINANCE NO. 659 AN ORDINANCE OF THE CITY OF ANAHEIM REGULATING THE BUSINESS OF SLAUGHTERING, PROCESSING, MANUFACTURING, SALE AND DISTRIBUTION OF MEAT AND MEAT PRODUCTS INTENDED FOR USE AS ANIMAL FOOD. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: Section 1. Definitions. For the purposes of this ordinance the following terms are defined as herein set forth. a. The terms ANIMAL FOOD and PET FOOD are hereby defined to be any fresh meat or fresh meat product actually or purportedly intended for sale or disposal for eventual use as food for pet animals. b. The term FRESH MEAT is hereby defined as any meat which has not been processed by cooking, smoking or dehydrating. c. The term FRESH MEAT PRODUCT is hereby defined as any product or substances containing fresh meat. d. The word MEAT is hereby defined to be the parts or the whole, of the flesh, organs, bones or substance of any mammal. e. The term ANIMAL FOOD PLANT INSPECTOR shall be deemed to include any deputy Animal Food Plant Inspector. Section 2. No person, firm or corporation shall slaughter, prepare or manufacture any meat or meat products for commercial distribution at wholesale or retail for use as animal food, or distribute or deliver any such meat or meat products to points within the City of Anaheim, without a permit therefor from the City Council of the City of Anaheim, which permit shall be known as an Animal Food Processor's or Distributor's Permit. Each permit issued hereunder shall, unless sooner revoked or suspended, expire one year after the date of issuance, but may be renewed from year to year upon application. Each application for such permit shall be accompanied by a permit fee of $25.00. Section 3. Each application for such permit shall state the nature and location of the proposed business, the facilities to be available, the facts of ownership and management of the business and such other information as the City Council may reasonably require. The City Council may deny the application, if within two years prior to the filing thereof a similar permit held by the applicant has been revoked, or if the applicant does not have available, or has not arranged for, adequate plant facilities to permit the conduct of the business in a sanitary and lawful manner, and the regular and proper inspection thereof. A separate application and permit shall be required for each separate location. No permit shall be transferable as to ownership, and no permit shall be valid except for the location specified therein. Section 4. When the City Council shall issue any such permit under the terms of this ordinance, such permit may be revoked by said City Council at any time thereafter. If said City Council becomes satisfied and finds that permittee's business under such permit is conducted in a manner contrary to the provisions of this ordinance or any regulation issued pursuant thereto, or in violation of any ordinance of the City of Anaheim or of any law of the State of California or of the United States, or in violation of any regulation of any officer, board, bureau or other governmental agency, or in a manner which constitutes a public nuisance. However, no such permit shall be revoked under this ordinance unless a hearing and notice of such hearing be first given the permittee. Such notice of hearing shall be deemed to be given if a registered letter containing notice of time and place of such hearing is deposited in the regular mail by the City Clerk at least ten (10) days before the hearing, addressed to permittee at his, her, their or its address given in the application for such permit. The permittee shall have the right to be represented by an attorney at such hearing. The findings and decision of the City Council upon such hearing shall be final. Section 5. There is hereby created the office of Animal Food Plant Inspector, and the person occupying such office shall be known as the Animal Food Plant Inspector. The Animal Food Plant Inspector shall be appointed by the City Council and hold office during its pleasure. Such Animal Food Plant Inspector shall have not more than two deputies who shall be appointed by the City Council and shall hold office at its pleasure, and shall be vested with all the power and authority conferred upon, and be chargeable with all the duties placed upon said Animal Food Plant Inspector. Servi Anaheim Gazette Legal Notice Inspector shall inspect the plant and operations of every holder of an Animal Food Processor's or Distributor's Permit at such times as may be required by the provisions of this Ordinance and at such other times as the City Council and/or said Animal Food Plant Inspector may reasonably require in order to insure compliance with all requirements of this ordinance. The Animal Food Plant Inspector shall have the right at any time to inspect the premises of permittee where any business is carried on which is covered and regulated by this ordinance. It is unlawful for any person to prohibit, hinder, delay or obstruct said Animal Food Plant Inspector in making any inspections contemplated by this ordinance, or to deny or prevent his immediate access to any portion of such premises described in the preceding sentence, upon demand made by him for such access. Section 7. Each holder of any Animal Food Processor's or Distributor's Permit shall pay to the City of Anaheim the following fees for inspection services rendered; $1.00 per hour for the time the Animal Food Plant Inspector is present on permittee's sald premises on official duty, plus a mileage fee of 5½ cents a mile for the distance travelled by such Inspector from and to the City Hall of Anaheim. Payment of such fees shall be made to the City Clerk of Anaheim each month not later than the 5th day of the month following such inspections. At the time of the issuing of an Animal Food Processor's or Distributor's Permit, the permittee shall deposit with said City Clerk and keep on deposit with him, during the term of such permit, the sum of $25.00, as security for payment of said fees for inspection services. The permit of any permittee who fails to pay said fees for inspection services, as herein provided, shall be suspended upon said Animal Food Plant Inspector posting a notice on permittee's sald premises, and it shall be unlawful for any person to slaughter, process, prepare or manufacture any meat or meat products for commercial distribution at wholesale or retail for use as animal food, or distribute or deliver any such meat or meat products from or at said premises during the time of such suspension. A penalty of 50% of all delinquent fees due for inspection services shall be added to such delinquent fees, and the payment of such delinquent fees and penalty must be paid to the City Clerk before the suspension of said permit shall be lifted. Proof of two suspensions of permit of any one permittee for failing to pay fees for inspection services shall constitute sufficient ground to revoke the permit of such permittee. No Inspection by the Animal Food Plant Inspector shall be required, and no inspection fees imposed under this ordinance need be paid, in the case of any animal food plant or establishment which is located outside of the City of Anaheim and which has been licensed to slaughter or prepare meat or meat food products, for use as animal food, by the Division of Animal Industry of the Department of Agriculture of this State or by the Board of Health of this State, or by the Bureau of Animal Industry of the United States Department of Agriculture, or by the department of health of any municipality or county of the State having authority to give such approval and which plant or establishment is regularly inspected pursuant to law by any one of those governmental agencies; provided however, that the foregoing exemption shall not absolve any permittee of the duty of complying locally with all of the other requirements of this ordinance pertaining to the slaughtering, and handling of meat and/or meat products intended for sale or disposal as animal food within the City of Anaheim. Section 8. It is unlawful for any person, firm or corporation in charge or control of any plant or establishment situated within the City of Anaheim for the operation of which an Animal Food Processor's or Distributor's Permit has been issued, to violate, or permit or allow the violation of, any of the regulations hereinafter in this section set forth. a. The Animal Food Plant Inspector must be notified in advance of any slaughtering. b. No slaughtering may be done without and no carcass or animal part may be brought into the plant or establishment except in the presence of said Animal Food Plant Inspector. c. All meat intended for use in animal food must be kept or stored in a room which is separate from that used for carcasses, animal parts or meat intended for any other purpose or disposal whatsoever. d. The carcass, flesh, or any part of any animal, dead other than that slaughter, shall not be brought into the plant or establishment. Any animal which, in the judgment of said Animal Food Plant Inspector, appears to have died otherwise than that slaughter, shall not be used for animal food purposes, and shall be immediately removed from any location where meat intended for use in animal food is kept or stored. e. All meat, meat food products and meat by-products when ready to distribution to retailers or to ultimate users, shall but cut into pieces dimension of which shall exceed three inches. Immediately upon such meat, meat food products and meat by-products being cut up as aforesaid it shall be characterized as intensive and fit for animal food by the action of powered charcoal at the rate of one pound of powdered charcoal one hundred pounds of meat, meat food products, and/or meat products. Such charcoal shall be medially thoroughly mixed with such meat, meat food products and/or meat by-products. No meat, meat food products or meat by-products should be removed from said plant or establishment, nor sold, distributed, given away or otherwise disposed of, without being so cut up and characterized. f. No meat, meat food products may be transported from the place of slaughter, processing or preparation, for the purpose of distributing the same to any container containing the same so that it have plainly labelled thereon words "UNINSPECTED MEAT." FIT FOR HUMAN CONSUMPTION. g. Records must be kept showing all sales of meat or meat products for animal food purposes or for manufacturing animal food, giving date of each transaction, the name and address of the purchaser and product sold. All meat, meat products meat by-products shall be cut up characterized as aforesaid, in presence of the Animal Food Plant Inspector and at no other time. i. The plant or establishment permittee shall be kept clean at times and shall be thoroughly cleaned at the end of each day when any slaughtering is done, and at other times as the Animal Food Plant Inspector shall require the same be done, when in the opinion of inspector such cleaning is necessary. Section 9. It is unlawful for person, firm or corporation to offer for sale, display or have the premises where food intended human consumption is handled, kept for sale or displayed, any or meat product actually or purportedly kept or offered for sale or posed as animal food or pet food, cept animal food or pet food in metically sealed containers. Section 10. It is unlawful in business place or commercial establishment, to keep or place in any friggerator, ice box, cooler, room, display case or other room container which contains any hu food, any animal food or pet food, cept where such animal food or food is in hermetically sealed tainers. Section 11. No person, firm or poration shall offer for sale, display or keep for sale or disposal any mal food or pet food which has been characterized by the adhere to, and the thorough m therewith, of powdered charcoal; the ratio of one pound of pow charcoal to one hundred pounds animal food or pet food. Upon all tainers containing animal food or food there shall be prominently played the following label: "USPECTED MEAT. NOT FIT HUMAN CONSUMPTION." Such shall also be prominently displayed to all display trays containing animal food or pet food. Section 12. In addition to any er remedy that may be provided this ordinance or any other whenever the Animal Food Plant spectror or any health officer of City of Anaheim observes any or meat product or meat by-pur which is being sold, offered for or displayed for sale for use as mal food, or kept or possessed for purpose, at any place of business violation of any provisions of ordinance, and the owner, operator or person in apparent offe of the premises falls or refuses to rect the violation without unsearly delay, the Animal Food Plant spectror and/or any such health cer shall forthwith condemn and possession of such meat, meat p and/or meat by-product and the same. Any person who violates any provision of this ordinance is guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed Three Hundred ($300.00) Dollars or by imprisonment in the City Jail not to exceed three months, or by both such fine and imprisonment. Section 15. This is an emergency ordinance and is required for the immediate preservation of the public peace, health and safety, and the following is the statement of the facts constituting such emergency: There exists a shortage of meat available for use in the preparation of food for animals and pets, and for that reason immediate precautions must be taken to protect animals and pets from being supplied with unwholesome food. There also exists a shortage of meat available for human consumption and there is a great and immediate danger that human beings may be supplied with food not fit for human consumption through deceit, contamination and negligence. For the foregoing reasons this Ordinance shall take effect and be in force immediately upon the date of its final passage. Section 16. NOT FOR HUMAN CONSUMPTION." Records must be kept showing dates of meat or meat products; animal food purposes or for manuring animal food, giving the name of each transaction, the name address of the purchaser and the sold. Such records shall be made at all times for inspection and Animal Food Plant Inspector the Chief of Police of the City Anheim. All meat, meat products and dairy-products shall be cut up and letterized as aforesaid, in the notice of the Animal Food Plant Inspector and at no other time. The plant or establishment of the plant shall be kept clean at all times and shall be thoroughly steam-dried at the end of each day when drenching is done, and at such times as the Animal Food Plant Inspector shall require the same to take, when in the opinion of such inspector such cleaning is necessary. 9. It is unlawful for any firm or corporation to sell, for sale, display or have upon premises where food intended for consumption is handled, sold, or sale or displayed, any meat that product actually or purportedly or offered for sale or disgasses animal food or pet food, excludes animal food or pet food in herlially sealed containers. 10. It is unlawful in any place or commercial establishment to keep or place in any restorer, ice box, cooler, cooking display case or other room or owner which contains any human any animal food or pet food, except such animal food or pet food in hermetically sealed containers. 11. No person, firm or corporation shall offer for sale, display, for sale or disposal any animal food or pet food which has not characterized by the addition of one pound of powdered meal to one hundred pounds of animal food or pet food. Upon all consents containing animal food or pet there shall be prominently displayed the following label: "UNINTESTED MEAT. NOT FIT FOR ANIMAL CONSUMPTION." Such label also be prominently displayed to all display trays containin- animal food or pet food. 12. In addition to any oth- ether that may be provided by ordinance or any other law, never the Animal Food Plant Inspector or any health officer of the Anaheim observes any meat product or meat by-product being sold, offered for sale displayed for sale for use as ani- food, or kept or possessed for any pose, at any place of business, in violation of any provisions of this statute, and the owner, operator, manager or person in apparent charge premises fails or refuses to cor- erte the violation without unneces- delay, the Animal Food Plant Inspector and/or any such health offi- halh forthwith condemn and take possession of such meat, meat product or meat by-product and destroy same.
