LEGAL NOTICE ORDINANCE NO. 399 AN ORDINANCE REGULATING THE USE OF WATER FROM WELLS AND TO PREVENT THE WASTE AND FLOW THEREOF, AND DEFINING THE WASTE OF SUCH WATER, AND DEFINING THE TERMS "WELLS", "BENE-TEARMS "WELLS", "BENEFICIAL USE", "BENEFICIAL PURPOSES", "IRRIGATION OF LANDS" AND "PROPAGA-TION OF FISH", AND PROVIDING PENALTIES FOR VIOLATION THEREOF. The Board of Supervisors of the County of Orange, State of California, does ordain as follows: SECTION 1. It shall be unlawful for any person, firm, co-partnership, corporation or association of individuals, either as owner, tenant, manager, agent or employee, to cause, permit or suffer any water well or wells, under the ownership, control or management of such person, firm, co-partnership, corporation or association of individuals, to be operated or used in such manner as to cause, suffer or permit the water from such well or wells to unnecessarily flow or be pumped therefrom or to go to waste. SECTION 2. For the purpose of this Ordinance the term "water well or wells" wherever used herein is defined as follows: An artificial hole made in the ground through which water naturally flows from subterranean sources to the surface of the ground, commonly known and designated as an artesian well; or any well from which water is obtained by means of a pump or other mechanical device, commonly known and designated as a pumping well. SECTION 3. For the purpose of this Ordinance the term "unnecessaryly flow" as used in this ordinance is defined to be the causing, suffering or permitting water flowing from an artesian well or pumped from a pumping well. SECTION 10. That Ordinance No. 349 of the County of Orange entitled "An Ordinance Amending Ordinance No. 340 of the County of Orange entitled: 'An Ordinance regulating the use of water from pumping wells and to prevent the waste and flow thereof, and defining the terms 'beneficial use', 'irrigation of lands', and 'Propagation of fish'; and providing penalties for violation thereof' and Ordinance No. 340 of the County of Orange entitled: 'An Ordinance regulating the use of water from pumping wells and to prevent the waste and flow thereof, and defining the terms 'beneficial use', 'irrigation of lands', and 'propagation of fish'; and providing penalties for violation thereof', and all other Ordinances in conflict herewith, be and the same are hereby repealed. SECTION 11. This Ordinance shall take effect and be in force thirty days from and after the date of its passage and upon the publication thereof within fifteen days from the date of its passage, as required by law, in the ANA-HEIM GAZETTE, a newspaper published and circulated in the County of Orange, State of California, together with the names of the Board of Supervisors voting for and against the same. For the purpose of this Ordinance "waste of water" is defined to be: (a) The causing, suffering or permitting of any water pumped or flowing from any well to run into any river, creek or other natural water course, or channel, or into any bay or pond, or artificial reservoir, or into any street, road or highway, unless it be used thereafter for a beneficial purpose; and where such water is caused, suffered or permitted to be run into any pond or artificial reservoir, such storing of water shall be deemed a waste of water, unless it is used thereon for the beneficial purposes of domestic use, and/or propagation of fish, and/or thereafter removed therefrom and used for the beneficial purpose of irrigation. (b) The causing, suffering or permitting any water pumped or flowing from any well to run upon the land of any person, or upon the public lands of the United States, or the State of California, unless it be used thereon for the beneficial purposes of irrigation thereof, or for the propagation of fish. (c) The causing, suffering or permitting any water pumped or flowing from any well to be used for the flooding of any land, pond, or artificial reservoir, for the purpose of attracting wild game and aquatic birds. SECTION 5. For the purposes of this Ordinance "beneficial use" or "beneficial purpose" is defined to be the causing, suffering or permitting of any water pumped or flowing from any well to be used for the purpose of irrigation of lands and/or for domestic use and/or for the propagation of fish. For the purposes of this Ordinance "irrigation of land" is defined to be the artificial application of water to lands whenever rainfall is insufficient to meet the full water requirements of crops, applied to lands in such quantities and in such manner, from time to time during the growing season of the trees or plants being irrigated, as will provide sufficient moisture to promote plant growth, having reference to the particular kind of crops grown and the particular type of soil involved. SECTION 7. For the purpose of this Ordinance "propagation of fish" is defined to be the breeding and/or propagating of edible or pet species of fish where such breeding and/or propagation is carried on as a commercial enterprise. SECTION 8. Every day's continuance of such waste of water shall constitute a new and separate offense under this Ordinance. SECTION 9. Any person violating any of the provisions of this Ordinance shall for each offense upon conviction thereof be punished by a fine of not less than $25.00 or more than $500.00, or by imprisonment in the County Jail for a period of not more than six months, or by both such fine and imprisonment. Santa Ana Trustee Enters Guilty Plea Santa Ana Councilman Joseph P. Smith late last week pleaded guilty to three counts of violating the corporate securities act. He asked for probation. Similar pleas were entered by two of his associates, George K. Linderman and Tom C. Johnson, president and sales manager of the Kinderman Oil company. The oil concern was charged with raising approximately $160,-000 from investors and then making loans to another corporation which failed. There were originally 36 counts against the men. King; 39, of Hansen road, west of Anaheim, faces federal prosecution on counterfeit charges following his arrest late last Friday by Orange county officers and a member of the federal bureau of investigation form Los Angeles. The man was taken into custody after officers staked out near his home and followed him as he left home in the company of a woman with whom he assertedly has been living as man and wife. In his pockets, officers found counterfeit 50-cent pieces and within the home they found parts of money-making apparatus. Officers quoted King as saying he had made $8 worth of the spurious half-dollar coins. He also assertedly has been living with the woman, not his wife, and her three children; has applied for state financial aid for himself, "his wife and three children;" had failed to register with the sheriff as an ex-convict, and has obtained electricity without bond by falsely describing himself as a property owner. King served a term of 18 months on McNeil island for forgery, following a conviction in 1933 on a counterfeit charge, officers said. Citrus Men Gather Here Friday Night Two officials of the California Fruit Growers Exchange, T. E. Powell and F. R. Wilcox, spoke more than 100 citrus growers and packing house officials Friday evening at the Elks club. All present were affiliated with the Northern Orange County Citrus exchange. Following the principal talkat problems of the current season were discussed. Manager A. H. Kirchmann reported that an estimate on the ability of the domestic market to absorb the present crop could be made in about two weeks. Inquest Jury Finds No Criminal Action An open verdict was returned by the coroner's jury after hearing testimony relative to accident on May 28 which cost the live of Mrs. Alice Nickles of Anaheim. The inquest was held last Thursday afternoon at Backs, Terry & Campbell mortuary. The jury found that both drivers, Reynold Green, 27, of Upland, and George Nickles, 23, son of the crash victim, were exceeding the speed limit at the intersection of Magnolia and Broadway where the accident occurred. It could not, however, place criminal responsibility on either driver. TEACHERS or those with teaching ability, wanted immediately for new school expansion program which was started the first of this year and is now rapidly sweeping the country.
