LEGAL NOTICE RESOLUTION OF THE BOARD OF SUPERVISORS OF ORANGE COUNTY CALLING AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD THROUGH OUT SAID COUNTY OF ORANGE ON THE 15TH DAY OF DECEMBER, 1935, FOR THE PURPOSE OF VOTING UPON THE INCURRING OF A BONDED INDEBTEDNESS OF SAID COUNTY IN THE SUM OF $6,620,000.00. On motion of Supervisor Smith, only seconded and carried, the following Resolution and Order, giving notice of a special election to be held in and throughout the County of Orange on the 19th day of December, 1935, was upon roll call upon the affirmative vote of four of the members of the Board of Supervisors of the County of Orange adopted: PROCLAMATION AND NOTICE OF SPECIAL ELECTION IN THE MATTER OF THE ISSUANCE OF $6,620,000.00 OF BONDS OF THE COUNTY OF ORANGE. STATE OF CALIFORNIA. FOR FLOOD CONTROL AND WATER CONSERVATION. STATE OF CALIFORNIA. COUNTY OF ORANGE. WHEREAS, there exists in the County of Orange a District known as Orange County Flood Control District, the boundaries of which District are co-terminus with the boundaries of the County of Orange, and WHEREAS, said Orange County Flood Control District has heretofore in conformity with the provisions of the Act creating said District adopted a comprehensive plan of flood control and water conservation, which said plan was submitted in a report filed by a board of competent engineers which said report shows: 1. A general description of the work to be done. 2. General plans, profiles, cross-sections and general specifications of the work to be done. 3. A general description of the lands, rights of way, easements, and property proposed to be taken, acquired or injured in carrying out said work. 4. A map showing the location of the proposed work and improvements, and lands, rights of way, easements and property to be taken, acquired or injured in carrying out said work. 5. An estimate of the cost of such work, including an estimate of the cost of lands, rights of way, easements and property proposed to be LEGAL NOTICE property in said District, and at the time pwd in the same manner as the general tax levy for County purposes, and when collected shall be paid into the County Treasury of the County of Orange to the credit of the interest and sinking fund for the purpose of paying the interest and principal of sald bonds so sold, and shall be used for no other purpose; that the principal and interest of sald bonds shall be paid by the County Treasurer of Orange County In the manner provided by law for the payment of principal and interest on bonds of said Orange County. SECTION 6. That for the purposes of sale election, the election precincts as now established for general election purposes outside of incorporated cities and towns of said Orange County are hereby declared to be and are adopted as bond election precincts for sale special election; and the election precincts as now established for general election purposes inside of incorporated cities and towns of said County shall be and they hereby are consolidated into bond election precincts for sale special election, together with the polling places therein designated, and the names of election officers appointed hereby to hold, conduct and make returns of sald election as required by law are as follows: to-wit: Bond Election Precinct No. 1 Comprised of General Election Precincts Santa Ana 1, 63 and 64. An estimate of the cost of such work, including an estimate of the cost of lands, rights of way, easements, and property proposed to be taken, acquired or injured in carrying out said work, and also of all incidental expenses likely to be incurred in connection therewith, including legal, clerical, engineering, superintendence, inspection, printing and advertising, and stating the total amount of bonds necessary to be issued to pay for the same, and WHEREAS, it is the intention of the Board of Supervisors of Orange County to call a special election to be held throughout the County of Orange for the purpose of submitting to the qualified voters of said County of Orange the proposition of incurring a bonded indebtedness of said County in the sum of $6,620,000.00, for the purpose of carrying out a plan of flood control and water conservation, as authorized by the provisions of Sections 4041.6 and 4088 of the Political Code, of the State of California, and any Sections or Acts supplemental thereto and WHEREAS, the said Board of Supervisors of Orange County did on the 19th day of November, 1935, by a Resolution passed on said day adopt and approve the report of the engineers of said Orange County Flood Control District as a plan of flood control and water conservation for said County of Orange except as herein otherwise provided. NOW THEREFORE, IT IS HEREBY RESOLVED AND ORDERED by the Board of Supervisors of the County of Orange: SECTION 1. That a special election be and the same is hereby called and ordered to be held in the County of Orange on the 19th day of December, 1935, for the object and purpose of submitting to the qualified electors in said County the proposition of incurring a bonded debt in the amount of $6,620,000.00 for the purposes hereafter stated. SECTION 2. That the objects and purposes for which said indebtedness is proposed to be incurred are the following, to-wit: For the control of the flood and storm waters of said Orange County and the flood and storm waters of streams that have their source outside of said County, but which streams and flood waters thereof flow into said County. Said streams being the Santa Ana River, Brea Creek, San Juan Creek, Carbon Canyon Creek, East Fullerton Creek, Trabuco Creek, Alliso Creek and Santiago Creek, for the conservation of the aforesaid flood and storm waters for beneficial and useful purposes by spreading, storing, putting and causing to percolate into the soil within said County, and without said County, and for the protection from damage from such flood and storm water of the harbors, waterways, public highways and property in said District, all of which work is to be done in accordance with the said plan adopted by said Board of Supervisors and in accordance with the provisions of law authorizing said Bond Election Precinct No. 3 Comprised of General Election Precincts Santa Ana 59, 60 and 62. That the estimated total cost of the proposed work and improvements is the sum of $11,600,000.00; that the estimated cost of the proposed work and improvements for which bonds are to be issued is the sum of $6,620,000.00; the balance of said cost in excess of said $6,620,000.00 to be paid out of the funds expected to be furnished by the United States of America or some agency created thereby; and that the amount of the principal of the indebtedness to be incurred therefor is $6,620,000.00 that one-fortieth (1/40) part of said indebtedness shall be paid each and every year; that the rate of interest to be paid on principal indebtedness shall not be to exceed four per cent (4%) per annum payable semi-annually. That if at such election two-thirds of the votes cast are in favor of incurring said bonded indebtedness, then bonds of said District for the amount of $8,620,000.00 shall be issued, and the Board of Supervisors of Orange County are authorized to offer said bonds for sale at such time and in such amounts as in the Judgment of said Board is necessary to carry out the purposes for which said bonds are issued. That said bonds shall bear interest at the rate of not to exceed four per cent (4%) per annum, payable semi-annually. SECTION 4. Said bonds shall be of the denomination of One Thousand Dollars ($1,000.00) each and shall be numbered consecutively and the whole amount must be payable within forty (40) years. SECTION 5. That for the purpose of paying the principal and interest of said bonds, the Board of Supervisors of said Orange County shall levy a tax each year upon all taxable property in said County sufficient to pay the interest on said bonds for that year and such portion of the principal thereof as is to become due before the time for making the next general tax levy; that such tax shall be levied and collected on all taxable Comprised of General Election Precincts Santa Ana 7, 38, 39 and 40 Polling Place—R. That said election shall be held in conformity with the tenure election laws of the State of California, except as otherwise provided in this Resolution, and none but qualified voters in said County of Orange shall be permitted to vote thereat, and at said election the polls must be opened at 6 o'clock in the morning of the day of election and must be kept open until 7 o'clock in the afternoon of said day when the polls shall be closed, and thereafter no ballots shall be received provided, however, that if at the hour of closing there are any voters in the polling places or in line at the door who are qualified to vote and have not been able to do so since appearing, the polls shall be kept open a sufficient time to enable them to vote; but no one who arrives at the polling place after 7 o'clock in the afternoon shall be entitled to vote, although the polls may be open when he arrives. That the Board of Supervisors of Orange County shall meet at the usual place of meeting at one o'clock in the afternoon of the first Monday after said election, said day being the 23rd day of December, 1935, to canvass the returns of said election, or as soon thereafter as all the returns are in. When begun the canvass shall be continued until completed, which shall not be later than six o'clock in the afternoon of the sixteenth day following the said election.The Clerk of the said Board of Supervisors shall, as soon as the result is declared, enter upon the records of said Board a statement of such result, which statement shall show: (1) The whole number of votes cast in the County; (2) The proposition voted upon; (3) The number of votes given at each bond election precinct for and against the proposition voted upon; (4) The number of votes given in the County for and against such proposition.
