TWELFTH INSTALLMENT
SYNOPSIS: Johnny Breen, 16 years old, who has spent all his life aboard a Hudson river tugboat plying near New York City, is made motherless by an explosion which sinks the tug and tosses him into the river. He swims and crawls ashore where starts a new and strange life. He is ignorant, cannot read, and knows nothing of life in a great city. Beaten and chased by toughs he is rescued by a Jewish family living off the Bowery in the rear of their second-hand clothing store. Here he is openly courted by the young daughter. Breen fights bullies in self-defense... and soon is picked up by an unscrupulous manager who cheats him—until "Pug" Malone at the saloon-fight club, attracted to the boy, takes him under his wing. On the other side of the picture are the wealthy Van Horns of Fifth Avenue. There is a Gilbert Van Horn, last of the great family, a bachelor, in whose life is a hidden chapter with his mother's maid—who leaves home—to be lost in the city life—when Gilbert is accused. It was reported the maid married an old captain of a river tug... rather than return home—and was soon a mother. Under Malone's guardianship young Breen develops fast. "Pug" discovers the boy cannot read—starts him to night school and the world commences, to open for Johnny Breen. Malone, an old-timer, is backed in a health-farm that simmering night.
John secured a table on the balcony, ten feet or so above the crowded street, where they could dine, under the awnings, in the open air, and still in sight of the entrancing things within.
Josephine sank into her seat with a sigh, they were very fortunate indeed John talked as he had never talked before. His life at the University, in the atmosphere of recognized ideas, had broadened him. He unburdened great ambitions ripe for expression in that understanding night. His surer outlook and his burning belief in the great dignity of the career ahead, glorified him. He would be a builder, "like Ranily back across her hair.
"Do you mind the smoke, Jo?" He used the diminutive easily.
"No, John I love it." Her face was close to his, her hair gave back the faintest perfume. She was even lovelier than he had imagined her in his fondest dreams; she was an angel.
As John talked Josephine was glad, so glad, to be with him. He was finer, more manly, more handsome than ever. Merest suggestion of a dimple. A mood of perfect understanding seemed to permeate the air. The dinner was superb. She had asked for a cocktail and John joined her, and a bottle of St. Julien added flavor to the dishes. Cafe Boulevard, always famous for its coffee, outdid itself on that Arabian night. They ate their ice and lingered, white John smoked a cigar grandly already disappeared in "What's up, John? No hope?" He looked at quizzically.
"Josephine has prome," The words sound most as if he were utter sacrilegious.
"Marry you?" Gilb steadied himself at a mute devil you say? Come gripped him by the glistened, he turned Jules!" to the butterball hall, "some Cliquot, Juice to drink to this. The talk of money to John. He was feeling his period of exaltation get away, wanted to "Good night, John."
Fifth Avenue. There is a Gilbert Van Horn, last of the great family, a bachelor, in whose life is a hidden chapter with his mother's maid—who leaves home—to be lost in the city life—when Gilbert is accused. It was reported the maid married an old captain of a river tug... rather than return home—and was soon a mother. Under Malone's guardianship young Breen develops fast. "Pug" discovers the boy cannot read—starts him to night school and the world commences, to open for Johnny Breen. Malone, an old-timer, is backed in a health-farm venture—taking Breen with him. There they meet and come to know Gilbert Van Horn. John attracts Van Horn who learns of Breen's mother, name Harriet. Learning John's desire for engineering course at Columbia University—he advances the money. John comes to know Josephine, Van Hornward, and during his school years Gina In love with her. Graduating as a Civil Engineer he gets a job with a great construction company, working in New York. Breen has a rival for the love of Josephine, a rich man of the world by the name of Rantoul.
NOW GO ON WITH THE STORY
John had never proposed to her, probably never would, or perhaps had never had the chance.
Van Horn was dining at the club. It was Friday night, a beastly night by the way, with so many people always eating fish, and Aunt Wen was in the midst of a book.
John had called up only an hour before. It was six o'clock. Perhaps he was still at his new quarters. She would call, and would leave word for Rantoul, at his rooms, that she could not see him. After all, Josephine could see Rantoul often, but that night she wanted to see John Breen.
They met, an hour later, at the Savoy, and walked east, through Fifty-ninth Street to the Third Avenue L. It was a familiar station to John, in a reminiscent way, as indeed the entire city was reminiscent and crowded with surprises. The same old platforms and rails, but an electrified train carried them down through the close revelation of the East Side. Jacob Rilis had written about slums, disturbingly, and Theodore Roosevelt had endorsed his words; this gave the steaming tenements a sentimental and a literary value.
"John, I'm so glad to see you, alone." Josephine was starting things early. "There's a lovely place, the Cafe Boulevard, so Bohemian, John, and with you, I'm not afraid." A few weeks before Rantoul had protected her there.
John Breen might have no medals, she mused, moving closer to him, but he did have an uncanny fascination onlier than he had imagined her in his fondest dreams; she was an angel.

On their ride downtown, they had talked the common-places of their separation. But once at table, and alone, as if by magic, John and Josephine were again on the fatal plane of delicious intimacy.
Josephine smiled, John noted the toul. Yes, like Rantoul," a builder in the greatest city of the world!
Something from within smote Josephine; it came, a cold breath of doubt. She was losing ground, slipping in a mental panic as she compared her lovers. She missed the tight, high-colored skin of the older man, youthfully flushed at times, perhaps by wine. The crisp white hair of Rantoul was less silky, and less thick, than the youthful crop of Breen, and she missed that careful guarded manner, the habit of an older man, but which she then set down to cunning. John swept her along on a flood of emotion. His hunger demanded her; it was a terrible emotion. She dared not try to fascinate or charm. Love stabbed her with delirious pain. Doubt dropped away and, in her instant of surrender, her hold on John was of transcendent power.
Rantoul vanished from her mind, and John Breen, so close across the table, clasping her hand, her pulse, her soul, was the finer man, wealthier by twenty years, rich full years she was to share with him; love with him. His grip tightened; he whispered, "Darling will you marry me?" The question had been in his eyes. She heard the words, the fervent words carrying her beyond all thought of time or calculation.
"Will you wait for me?" his eager tones were tender. "Will you—sweet-heart?"
Their eyes met, swimmingly. She whispered, "Yes." Rantoul was forgotten; her plans and structures tumbled and re-formed.
They drove home in a taxi gliding quickly through dark enveloping streets. John helped her to the door, and Van Horn, who had entered a minute earlier, called to him.

ORDINANCE NO. 568
AN ORDINANCE OF THE CITY OF ANAHEIM RELATING TO THE SALE OR OTHER DISPOSITION OF GOODS, WARES AND MERCHANDISE IN THE CITY OF ANAHEIM AT AUCTION AND PROVIDING LICENSES IN CONNECTION THEREWITH, PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DO ORDAIN AS FOLLOWS:
SECTION 1. It shall be unlawful for any person to sell or expose for sale by way of auction, except under and by virtue of legal process, any property, real or personal, within the limits of the City of Anaheim, without having first obtained the proper license therefor as hereinafter provided, and any such auctioneer's license granted hereunder shall not be assignable or transferable except upon approval by the City Council, by resolution or ordinance; provided however, that this ordinance shall not apply to any person engaged in the selling at auction of second-hand or used goods, wares and merchandise in the City of Anaheim, but that said auctioneers shall be governed by the provisions of Ordinance No. 507 of the City of Anaheim, and shall pay the license fee required therein.
SECTION 2. Such auctioneer's license shall be of two classes, namely: The First Class, which shall be a daily license only, and for which the licensee shall pay to the City Treasurer of the City of Anaheim, the sum of Fifty ($50.00) Dollars per day, and furnish the bond hereinafter required and such license shall authorize the holder thereof, subject to the provisions of this and other ordinances of the City, to sell or offer for sale any property either real such sale is made. If the purchaser of such article or things sold shall, within forty-eight (48) hours, make claim against said auctioneer upon the ground that the article or thing sold to him at auction was not as represented by said auctioneer and shall demand of the auctioneer the return of the money or other consideration, and shall offer to return the article or thing purchased, then and in such a case the auctioneer shall either return to the purchaser the purchase price or deposit with the Chief of Police, taking his receipt therefor, said purchase price as a fund to answer and pay any judgment that may be recovered against said auctioneer by the puchaser, provided that if no action be commenced against said auctioneer within fifteen (15) days from the date such sale the Chief of Police shall not be required longer to hold such purchase price deposited with him and upon presentation of the receipt may return same to the auctioneer.
SECTION 6. It shall be unlawful for any person to act as a by-bidder or what is commonly known as a "capper" or "booster," at any auction or place where goods, wares or merchandise or anything whatever is sold, held or offered for sale, at auction; or to offer or make false bids on any thing or article held or offered for sale at such auction, or pretend to buy any thing at any auction sale, in order to in any manner stimulate such sales by any deceit or misrepresentation in the making of bids or offers for the purchase of any thing held or offered therein for sale.
SECTION 7. That it shall be unlawful for any person, firm or corporation, with intent to sell or dispose of at auction any goods, wares or merchandise or to induce the public in any manner to enter into any obligation pertaining thereto, or to acquire title thereto or interest therein at any such sale, to make, publish, disseminate, circulate, or place before the public, or cause, directly or indirectly, to be made, published, disseminated, circulated or placed before the public within the City of Anaheim, in a newspaper or other publication, or in the form of a book, notice, handbill, poster, bill, circular pamphlet, or letter or in any other way, advertisement of any sort regarding

"Thank you, Gil," John said simply. "How are you fixed? Money; I mean," the older man spoke with the ease of long friendship.
"I've enough," John answered; "I'll make more."
The talk of money seemed hateful to John. He was feeling let down from his period of exaltation; he wanted to get away, wanted to think.
"Good night, John. I won't come down." Van Horn held out his hand. He too wanted to be alone, to think. "Don't worry about money," he called. Josephine will have enough. It's a partnership, you know——" He waved his hand as John left, to walk uptown under the stars, up through the southern part of the park where he and Becka had tarried, and on, up to the flat opposite the shaft site. The more John walked the less certain he was of what might happen next.

SECTION 3. That no auctioneer shall ring a bell or permit the same to be rung in or about the front of the premises where he is conducting an auction sale, before, after or during such sale. Neither shall he permit soliciting by music, singing or loud noises to be made or done for the purpose of attracting the public.
SECTION 4. No auctioneer shall sell, or offer for sale, any article of gold, silver or plated ware; watches, jewelry, precious or semi-precious stones, Japanese or Chinese wares, objects of art or what is usually known and designated as antiques, or any new goods, wares or merchandise, without at the time of offering such article, stating in a loud and distinct voice either that the article is sold without any warrant or representations as to quality or price or value or genuiness whatsoever, or that said article is expressly warranted to be as the auctioneer represents it; nor shall he accept false bids from any person in the employ of himself or others and no articles shall be given away, disposed of or offered to any person as a gift, premium, bonus or inducement to purchase any other article or commodity; and no person, firm or corporation shall offer for sale or sell at public auction any new goods, wares or merchandise unless there is securely attached to each of such articles a tag or label upon which shall be plainly written or printed in English, a true and correct tion any goods, wares or merchandise or to induce the public in any manner to enter into any obligation pertaining thereto, or to acquire title thereto or interest therein at any such sale, to make, publish, disseminate, circulate, or place before the public, or cause directly or indirectly, to be made, published, disseminated, circulated or placed before the public within the City of Anaheim, in a newspaper or other publication, or in the form of a book, notice, handbill, poster, bill, circular, pamphlet, or letter or in any other way, an advertisement of any sort regarding merchandise or any thing so offered to the public, which advertisement contains any assertion, representation or statement of fact which is untrue, deceptive or misleading.
SECTION 8. No auctioneers' license shall be issued under any of the provisions of this ordinance authorizing any auctioneer to conduct any kind of an auction upon any of the streets or alleys of the City of Anaheim or to sell, expose or offer at or for auction sale, except by public vendure or auction under and by virtue of legal process, any personal property between the hours of from sunset of any day to sunrise of the succeeding day, or by or with the use or aid of artificial light at any time, and no auctioneers' license shall be granted to any person unless he shall have been a resident of the City of Anaheim for a continuous period of six (6) months prior to the date of the issuance of such license.
SECTION 9. Any such auctioneer who shall exhibit and offer for sale at auction any article and induce its purchase by any bidder and who shall afterwards substitute any article in lieu of that offered to and purchased by the bidder whereby said bidder is defrauded, shall be guilty of a misdemeanor and upon conviction thereof may be punished therefor as herein-after provided.
SECTION 10. No person, firm or corporation shall sell or offer for sale in the City of Anaheim by auction, any stock of goods, wares and merchandise or any part or portion thereof; whether same is a stock of goods, wares and merchandise or a part or portion thereof formerly belonging to or kept in the business of another person, firm or corporation; either resident or non-resident; without having first filed in the office of the Chief of Police of the City of Anaheim an inventory of such goods, wares and merchandise duly supported by affidavit, setting forth the quality, quantity, kind or grade pf each item thereof; in the case of an individual, such affidavit shall be made by him as such; in the case of a firm; it shall be made by one of the partners.

SECTION 5. The auctioneers offering for sale any of the articles mentioned in Section 4 hereof, shall retain in his possession the money or other valuable thing or things received for the article or thing so sold for at least forty-eight (48) hours from the time Anaheim, or is a stock of goods, wares and merchandise or a part or portion thereof formerly belonging to or kept in the business of another person, firm or corporation, either resident or non-resident, without having first filed in the office of the Chief of Police of the City of Anaheim an inventory of such goods, wares and merchandise duly supported by affidavit, setting forth the quality, quantity, kind or grade of each item thereof, in the case of an individual, such affidavit shall be made by him as such; in the case of a firm, it shall be made by one of the partners, and in the case of a corporation, it shall be made by an officer of the corporation. Such inventory and affidavit when so made shall be kept on file as part of the public records of his office by the Chief of Police. Any owner of goods, wares and merchandise sold or offered for sale by auction as aforesaid shall not later than noon of each day during which such auction sale is being conducted, file with the Chief of Police an inventory supported by similar affidavit of all sales made at such auction sale on the preceding day, which said inventory shall set forth the quantity, quality, kind or grade of each item sold, the name, and post office address of each purchaser thereof, and the price paid for each of said items. In the event that additions and replenishments shall be made to and in said stock of goods, wares and merchandise, sold or offered for sale at such auction sale during the progress thereof, the owner of said stock of goods, wares and merchandise shall immediately upon adding the same to the stock of goods, wares and merchandise so held and offered for auction sale, file an inventory of such additions and replacements supported by similar affidavit, with the Chief of Police of the City of Anaheim, setting forth the quantity, quality, kind or grade of each item of such replenishments and additions, and the name and address of the owner or owners thereof, which said inventory and affidavit shall be kept on file as a part of the public records of his office by the Chief of Police.
SECTION 11. Every applicant for a license as auctioneer covered by this ordinance shall, before the issuance of said license to him, file with the City,
pressured it; nor shall he accept false bids from any person in the employ of himself or others and no articles shall be given away, disposed of or offered to any person as a gift, premium, bonus or inducement to purchase any other article or commodity; and no person, firm or corporation shall offer for sale or sell at public auction any new goods, wares or merchandise unless there is securely attached to each of such articles a tag or label upon which shall be plainly written or printed in English, a true and correct statement of the kind and quality of metal or material of which such article is made or composed, and the percentage or karat or other common designation of such material or metal; and in case such articles are plated, overlaid or veneered, then such tag or label shall contain a true statement of the kind of material or metal covered and of the covering; and when precious or semi-precious stones are offered for sale or sold, such written statement shall set forth the true name, weight, quality and fineness of said stones and imitations shall be described as such; and when watches and clocks are sold, the true names of the manufacturers shall be stated in writing, and no parts of the movements or mechanism thereof shall be substituted or contain false and misleading names or trade marks; neither shall second hand or old movements be offered for sale in new cases, without a true statement to that effect. Such tag or label shall remain securely attached to any such articles or merchandise, shall be delivered to the purchaser as a true and correct description and representation of the articles sold, and in case said written statement is not a true and correct description and representation of such articles sold, the same shall be deemed prima facie evidence of intent to defraud.
SECTION 5. NOTICE IS HEREBY GIVEN that on the 10th day of October, 1932, at the hour of ten o'clock A.M. of said day, at the South entrance to the Orange County Court House, in the City of Santa Ana, County of Orange, State of California, the BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION, (the successor to all rights, powers and duties of the First National Bank of Anaheim, a corporation, of Anaheim, California, organized and existing at the time of the execution of the deed of trust here-in after referred to) as Trustee under a certain deed of trust executed by HARRY D. RILEY and ALICE E.
