TODAY AND TOMORROW FRANK PARKER STOCKBRIDGE BILLBOARDS The war against defacing the scenery and endangering the lives of highway travellers by advertising billboards is gaining new recruits daily. The latest is the Fox Film Company, which has announced its abandonment of billboard advertising in favor of newspapers. Newspapers are better advertising media, the Fox people say, and of that there is no possible question. If there were no possible argument against billboards, that should be enough. Safety on the highways depends upon every driver keeping his eyes on the road. There should be no signboards by the roadside, except those which call attention to the wares of the roadside retailer on the spot, direction markets and signs established by the highway authorities to indicate the condition of the road ahead. "SPORT" Two-thirds of what passes for "sport" in the United States is pure commercialism. Some of the inside of the "boxing game" was revealed the other day when a fight promoter sued Gene Tunney for half a million dollars, claimed as commission for arranging as commission bouts. The court decided against the claim, but in the course of the testimony the whole business of prize-fight promotion was exposed as the money-making scheme which it is. There isn't any reason why people who like boxing and wrestling matches, professional baseball or college football or any of the other so-called "sports" which are promoted for the big gate-money, should not go to see them. It is a degradation of the word "sport," transporation and distribution of oil in, along and across all public highways now existing or hereafter laid out in the county of Orange, state of California, described as follows: 1. Beginning on the west side of Golden West (Westminster Road) Avenue, at the intersection of said Avenue with Magnolia Avenue, thence East across said Golden West Avenue (Westminster Road) on Magnolia Avenue, except therefrom Farm Lot No. 106, and the Southern Pacific Railway Company's right-of-way. 2. Beginning at the intersection of Huntington Avenue and Magnolia Avenue, thence Southerly along said Huntington Avenue to the City limits of the City of Huntington Beach. Section 2: This franchise is granted and shall be held and enjoyed only upon the terms and conditions herein contained, and the grantee must, within thirty (30) days after the passage of this ordinance, file with the clerk of the board of supervisors a written acceptance of the terms and conditions herein expressed. Section 3: The term "grantee," whenever used herein, shall be held to include the grantee or its successors and assigns. Section 4: The grantee shall have the right to construct and maintain such trap, manholes, appliances and attachments as may be necessary to properly maintain the pipe line laid or constructed under this franchise, and said traps, manholes., appliances and attachments shall at all times be kept flush with the surface of the highway and so located as to conform to any order of the board of supervisors in regard thereto and not to interfere with the use of the highway for travel. The grantee shall have the right, subject to such regulations as are now or may hereafter be in force, to make all necessary excavations in said highways for the construction and repair of said pipe line, traps, manholes, appliances and attachments. Coleman Du Pont started in life with nothing but his bare hands and a keen mind. He worked as a coal miner, with pick and shovel, in a coal mine which he later owned. He loved to build, but cared little for the thing he had built after it was done. When the Du Pont powder industry was dying of dry rot and his cousins, who owned it, wanted to sell out, Coleman Du Pont offered to take hold and see what he could do. He built the business up into one of the most important industrial corporations in the world, and then retired to do something else. A great American passed away when Coleman Du Pont died at the age of 66. MATING The head of the Westfield, N. J., schools, told a convention of school nurses the other day that one of the things which high school students should be taught is how to select their future husbands or wives, and how to judge the characters of men and women. That is extremely practical advice. The problem of mating wisely is the most difficult one which the young man or young woman faces, and the one in which he or she usually has had less help from parents than in any other of the problems of real life. Three-quarters, at least, of all the marital difficulties which have brought the divorce rate up so high in this country, arise from the fact that young folks have had no instruction at all as to the qualities in the other sex which make for married happiness. In a completely civilized state, the proper mating of young human beings will be regarded as of equal importance with the proper mating of livestock. CASH Within the next three weeks the largest amount of cash newly put into circulation at one time will find its way into the tills of merchants all over the county. That is the annual distribution of the Christmas Clubs, maintained by 8,000 banks. Eleven million persons have been depositing small amounts every week since the first of the year, in order to accumulate a fund and so located as to conform to any order of the board of supervisors in regard thereto and not to interfere with the use of the highway for travel. The grantee shall have the right, subject to such regulations as are now or may hereafter be in force, to make all necessary excavations in said highways for the construction and repair of said pipe line, traps, manholes, appliances and attachments. Section 5: If the said pipe line shall be laid along any macadam highway in the county of Orange, it shall be placed at the edge of the highway so as not to disturb the macadam surface, and in no event shall any pipe or conduit be laid across the macadam highway without a special permit from the board of supervisors so to do, which permit shall specify the manner in which the pipe shall be laid, and may provide for the repair of the highways after the pipes have been laid by the officers of the county at the expense of the grantee; and upon the presentation of a bill therefor the grantee shall pay the same at once, or in the event of its failure so to do, this franchise shall thereupon be forfeited. Section 6: All pipes, traps, poles, manholes, attachments and appliances constructed, erected or maintained under the provisions of this franchise shall be constructed, erected or maintained under the provisions of this franchise shall be constructed, erected or maintained in compliance with all of the ordinances, rules and regulations now or here after adopted or prescribed by the board of supervisors of Orange County. All pipes laid under this franchise shall be of first-class material subject to the approval of said board of supervisors; and no pipe laid under this franchise shall exceed ten inches in diameter. Section 7: The work of laying or repairing all pipes, pipelines, traps, manholes, attachments and appliances shall be conducted with the least possible hindrance to the use of the highways for purposes of travel, and as soon as the laying, constructing, erecting or repairing of any pipe, pipe line, trap, manhole, attachment or appliance is completed all portions of the highway which have been excavated or otherwise injured thereby shall be placed in as good condition as the same was before the laying, constructing, erecting or repairing of any pipe, pipe line, trap, manhole, attachment or appliance, to the satisfaction of the board of supervisors of said county; and that any damage or injury suffered by any person by reason of any excavation of obstruction being improperly guarded during said work shall be borne by the grantee of this franchise. Section 8: The county of Orange reserves the right to change the grade of any highway over which this franchise is granted and the grantee shall and so located as to conform to any order of the board of supervisors in regard thereto and not to interfere with the use of the highway for travel. The grantee shall have the right, subject to such regulations as are now or may hereafter be in force, to make all necessary excavations in said highways for the construction and repair of said pipe line, traps, manholes, appliances and attachments. Section 13: The section shall show in it all such pipes, coats other structures which laid, constructed or rented to the filing of maps or set maps; be accompanied by any thereon; subscribed to the grantee hereof. The average in these Christmas accounts is $56.40 this year, but the grand total runs to six hundred and twelve million dollars. Not all of the money will be spent for Christmas presents. Some will go into permanent savings and investments, some to pay off debts incurred during the year, some for other purposes. About a third will be spent for gifts; but all of the six hundred million will change hands, and it is money changing hands that makes business good. The faster it changes hands, the better business is. The stimulus of this immense sum starting to circulate again should go a long way toward restoring prosperity. THE MAIN TROUBLE It is estimated that 20,000 cars will be taken off the roads of the state on account of defective equipment, but defective equipment in the heads of drivers is a greater peril for all who use the roads. ORDINANCE NO. 288 AN ORDINANCE GRANTING TO THE SHELL COMPANY OF CALIFORNIA, A CORPORATION, A FRANCHISE TO LAY PIPES FOR THE TRANSPORTATION OF OIL. The board of supervisors of the county of Orange do ordain as follows: Section 1: A franchise is hereby granted to the Shell Company of California, a corporation, to lay, and for a period of forty (40) years from and after the date of the granting of such franchise to maintain and operate, a pipe line system to be composed of not more than one line of pipe for tha- Section 8: The county of Orange reserves the right to change the grade of any highway over which this franchise is granted and the grantee shall within thirty days change the location of all pipes, poles, traps, manholes, appliances and attachments laid, constructed or erected hereunder so as to conform to such change of grade. Section 9: If any portion of any highway shall be damaged by reason of breaks or leaks in any pipe or conduit laid or constructed under this franchise, the grantee thereof shall, at its own expense, repair any such damage and put such highway in as good condition as it was in before such break or leak, to the satisfaction of the board of supervisors of said county. Section 10: If said grantee shall fail to comply with any instructions of said board of supervisors with respect to the location of any of said pipes, pipelines, traps, manholes, appliance or attachments, or the repair of any damage to highways within ten days after the service of written notice upon said grantee requiring compliance therewith, then said board of supervisors may immediately do whatever work is necessary to carry out said instructions at the cost and expense of said grantee, which cost by the acceptance of this franchise said grantee agrees to pay upon demand. Section 11: The grantee shall not commence the construction of any pipeline under the provisions of this franchise until it shall first have obtained a permit from the board of supervisors so to do. Such permit shall be granted upon application of the grantee, which application shall show: The highway upon which it is proposed to construct or lay the pipe, the length of pipe lines proposed to be constructed or laid, the size and description of the pipe intend- ed to be used, and such other facts as the board of supervisors may require. On the first day of July and January of each year after the date of the granting of this franchise, the grantee shall render a statement to the county of Orange showing in detail the permits issued and the total length of pipeline for the construction of which under the terms of this franchise permits have been taken out during the preceding six months, and show in detail the total length of pipeline actually laid under said permits, and the grantee shall accompany said report with the payment of one hundred dollars for every mile or fraction thereof of pipeline which has been actually constructed under the permits taken out during the preceding six months under the provisions of this franchise. Section 12: The grantee hereof shall also file with the board of supervisors on or about the 15th day of January of each year, during the life of this franchise, a map or set of maps each drawn to a scale of not less than 600 feet to one inch, showing in detail the exact location and size of all mains, laterals, and service pipes installed beneath the surface of the public highways hereinabove described belonging to, used by, or under the control of such grantee, or its successors or assigns. Whenever any pipe, conduit, tunnel or other structure located under the surface of said highways is abandoned, the grantee shall, within thirty days after such abandonment, file with said board of supervisors a statement in writing, giving in detail the location of the pipe, conduit, tunnel or other structure so abandoned. The map or set of maps filed pursuant to the provisions of this section shall show in detail the location of all such pipes, conduits, tunnels or other structures which shall have been laid, constructed or abandoned subsequent to the filing of the last preceding map or set of maps. Each map shall be accompanied by an affidavit endorsed thereon, subscribed and sworn to by the grantee hereof. Section 13: The said grantee shall also within thirty days after the granting of this franchise file with the board of supervisors of Orange County a detailed statement showing the location county treasurer of the county of Orange two per cent of the amount of the gross annual receipts arising from use, operation or possession of this franchise, and if the amount paid is incorrect in the judgment of the board of supervisors, they may order the payment of such additional sum as they may find due hereunder, and any and all sums due under this franchise if not paid may be collected by suit. Section 18: Said grantee shall not sell, transfer or assign this franchise, or the rights or privileges granted hereby without the consent of the board of supervisors, nor shall this franchise be sold, transferred or assigned except by a duly executed instrument in writing filed in the office of the board of supervisors of the county of Orange; and nothing in this franchise contained shall be construed to grant to said grantee any right to sell, transfer or assign this franchise, or any of the rights or privileges hereby granted, except in the manner aforesaid. Section 19: Any neglect, failure or refusal to comply with any of the conditions of this franchise shall thereupon immediately, lapse facto, effect a forfeiture hereof, and the said county, by its board of supervisors, may therefore delare this franchise forfeited, and may exclude said grantee from further use of the highways of said county under this franchise and said grantee shall thereupon and immediately surrender all rights in and to the same, and this franchise shall be deemed and shall remain null, void and of no effect. Section 20: The grantor or any municipal corporation now existing, or hereafter formed, shall have the right at any time after five (5) years from the taking effect of this ordinance, to acquire the works, property and rights of the grantee, or any portion thereof, constructed, acquired or operated under the franchise upon making reasonable compensation therefor. Section 21: This franchise is granted subject to the further condition that the grantee has now and shall at all times during the life of this franchise keep on file with the said board of supervisors a bond running to said county in the penal sum of one thousand dollars, with at least two good and sufficient sureties, to be approved by said board of supervisors, conditioned that said grantee shall well and truly observe, fulfill and perform each and every term and condition of this franchise, and that Ability ENROLL ABILITY, not personality is the thing that counts in the business world.
