Conservationists Win First Round
Fight to Save Sardines Is Approved By the Court
With four large sardine canneries operating at Monterey closed under abatement by a recent decision of Judge J. R. Welch, judge of the superior court of Santa Clara county, as a result of action brought by the Division of Fish and Game, the long bitter fight for the conservation of food fish appears to have a much brighter chance of success.
After a hard fought legal battle in the superior court of Monterey county, with Judge Welch sitting in place of Judge H. G. Jorgensen, the Santa Clara jurist's decision favoring on practically all counts the stand for conservation of the sardines as a valuable natural resource, has been hailed as a signal victory by the division.
Despite the fact that B. D. Marx Greene, former executive officer for the Fish and Game Division, represented the canners, and the introduction of testimony of numerous operators of canneries throughout the state to the effect that the reduction law and regulations was not fair to the canners, Eugene D. Bennett, present executive officer and attorney for the division, was able to present a case so conclusive that the decision leaves little to be desired, giving as it does the relief sought and establishing important facts regarding reduction of food fish and the authority of the division to regulate canners.
The Monterey Canning company, San Carlos Canning company, Sea Pride Canning company, all large Monterey operators are the plants closed on March 15th by Judge Welch's decision.
This decision counteracts that recently rendered in Los Angeles by Judge Clair Tappan, who declared that reduction of 136.7 tons of sardines per can closing machine should be allowed for each month.
This verdict would have allowed canners to many times take more sardines for canning than were brought into the plants, and was regarded as a treason.
Champs Train For Another Contest
U. S. C. and Stanford Clash in Track Meet Saturday
With his team a decided under-dog in the meet, Coach Dean B. Cromwell is now engaging his University of Southern California track and field squad, national intercollegiate champions in 1925 and 1926, in a strenuous week of training for the dual contest Saturday, April 6th, at Palo Alto with Stanford's athletes, national champs in 1927 and 1928.
Although Stanford has been the victor in the Trojan-Card meet by more than 20-point margins for the past two years, and again has a team as strong if not stronger than the winning aggregations of 1927 and 1928, the Southern Californians have their best equal of the last three seasons and optimistic Trojan followers give their team a small but hopeful outside chance to come out on top.
It is Stanford's overwhelming superiority in the shot put, discus and javelin that is expected to put the meet in the refrigerator for the Cards. Krenz and Rothert are sure to finish one-two in the shot and discus, with Tandy in the discus and Forster in the shot probably taking the third places to give the Cards a grand slam in these events.
In the javelin another slam looms, as Jesse Mortenson, the lone Trojan hope, has never come close to the marks being hung up this season by Sparling, Nibby and Perelli-Minetti.
After handing Stanford 27 points in these events, the Trojans have just about bowed themselves out of the picture before the meet starts. Were it not for Hector Dyer, the Card sophomore sprinting sensation, the Trojans might hope to come back partially by sweeping the sprints with Captain Charley Borah, Milt Maurer and Dick Wehner, but the optimistic Trojan dopers are naming Dyer to place second to Borah in both the 100 and 220.
In the quarter there will be a merry battle for places with Morrison and Shove fighting it out with Vic Williams the S. C. sophomore star. The Trojans hope to pick up some badly needed real property hereinafter thirteen Orange County Title Corporation, of Santa Clara as Trustee, to secure all liabilities, the payment of promissory note dated December 1923, made by said Louise Madeleine Macchler to Loan and Building Associationhelm, a Corporation, on principal sum of $2,000.00 at the rate of eight per num., principal and monthly installments of the first day of each month on the 1st day of May continuing until fully paid.

This decision counteracts that recently rendered in Los Angeles by Judge Clair Tappann, who declared that reduction of 136.7 tons of sardines per can closing machine should be allowed for each month.
This verdict would have allowed canners to many times take more sardines for canning than were brought into the plants, and was regarded as a tremendous excess by the fish and game officials, who have held that twenty-five per cent of fish brought in should be a liberal allowance. The division declared that after a careful investigation this percentage should be determined by insisting that the canners pack at least fifteen cases of sardines for each ton of fish brought into their plants.
Judge Welch went into the evidence very carefully and in his decision he explained that evidence presented showed the Fish and Game Commission was vested with certain protective rights, and that the commission had dealt fairly with the canners, not only in previous years but during the period when the defendants were charged with using in excess of the twenty-five per cent of sardines in reduction plants, and also failing to pack the fifteen cases per ton required by the commission's order.
He pointed out that the fifteen cases represented but 520 pounds of fish and that should dallow a very liberal quantity for reduction purposes. His figures show why the commission was right in asking for an abatement of the four defendants' plants for violation of these orders.
"Judge Welch's decision closing the four Monterey canneries because of their excessive reduction of food fish is greatly appreciated and it is a long step forward in the campaign of this commission for conserving this highly valuable natural resource. This decision will very likely be given serious consideration by the California legislature, which has an opportunity this year to adopt legislation which will better regulate the reduction of sardines, two bills having been introduced in the senate and assembly that give this necessary relief." Mr. I. Zellerbach president of the Fish and Game Commission, declared after carefully reading the decision.

Fire prevention and rural fire control will be featured in a series of meetings scheduled for April 18, 19, 20, in various portions of the county, under the auspices of the Agricultural Extension Service and Farm Bureau. These come as a forerunner of the fire hazard summer season and as a means of developing the community's fire mindedness. A conference call by Farm Advisor Wahlberg last week of these events, the Trojans have about bowed themselves out of the picture before the meet starts. Were it not for Hector Dyer, the Card sophomore sprinting sensation, the Trojans might hope to come back partially by sweeping the sprints with Captain Charley Borah, Milt Maurer and Dick Wehner, but the optimistic Trojan dopesters are naming Dyer to place second to Borah in both the 100 and 220.

Jesse Hill and Jack Williams are possible Trojan first place winners in the broad jump and pole vault respectively, but Zombro and Dowell in the former event and Edmonds in the latter are top-notch performers for Stanford, who have the edge in the dope because of their consistency in the past.
Although Stanford has lost Bob King its champion high jumper of last year, Southern California is weak in this event this season, and unless Al Bowen or Karl Tintinger find more spring in their legs than they ever had before, another one-two-three event for the Cards may go down on the books.
Despite the fact that Stanford rules the heavy favorite on paper, the meet should be just about the most interesting dual affair of the season on the Pacific Coast. The Trojans' hopes lie in the fact that Cromwell's squad is composed largely of sophomores who are improving with every day of competition. There is always the chance that some of them might step out and run, hurdle or jump better than they ever have before and it is upon the possibility of some dark horses suddenly popping up in Trojan uniforms that Cromwell has not given hope for a surprise party at Palo Alto.
Daily Radio Program
Beginning each day at 12 p.m. and continuing ten minutes, talks of interest to farmers, growers and producers will be given during the week, beginning April 8th, under the auspices of the Agricultural Extension Service, cooperating with radio station KPI. The conference decided upon the following meetings:
Thursday, April 18, 10:00 a.m. — Rural fire control demonstration at Glassell and Vista streets, Orange, for the Villa Park, Olive, El Modena and West Orange districts.
Thursday, April 18, 7:30 p.m. — Meeting of the Orange County Forest Protective Association, City Hall, Orange.
Friday, April 19, 2:00 p.m. — Brea-Olinda.
Friday, April 19, 6:30 p.m. — Orange county fair grounds. Dinner meeting to discuss the county-wide program. Farm Bureau officials, county board of supervisors, rural fire companies, packing house managers, forestry officials and others will be invited to the conference.
Saturday, April 20, 10:00 a.m. — El Toro, grain fire control demonstration.
Saturday, April 20, 2:00 p.m. — Capitrano, rural fire control demonstration.
Specialists from the University Extension Service will come with equipment of all kinds to show methods of fire control. All persons interested in this important problem are invited to attend the meetings, according to the Farm Advisor.

Egg Race
The conclusion of the fourth month of the Egg-Laying Contest at Pomona shows two Orange county entries among the high sixth. The Katella Leghorn farm of Anaheim now holds fourth place, with 699 eggs from ten pullets. E. J. Campbell of Garden Grove holds sixth place with 672 eggs from a like number of pulllets. The highest entry is owned by G. C. England of Inglewood, with 761 eggs.
The Katella Leghorn Farm also has eight high hen, with 95 eggs. The high hen in the contest is one owned by H. S. Killian, with 102 eggs for the fourth month period since the contest started.

Incandescent lamps of such sizes, at such times and in such quantities as said City may determine, the total amount of contract for this commodity to be between $1200.00 and $2500.00.
Said lamps shall be Mazda or equal, and shall include all standard sizes and classifications.
ITEM 3—ELECTRIC METERS
Electric meters of such classes, at such times and in such quantities as said City may determine, the total amount of contract for this commodity to be between $1000.00 and $5000.00.
Said meters shall include single phase for two or three wires, equal to General Electric Types D-7 and D-14; and 5 ampere meters for use with instrument transformers.
Single phase meters for two wires to be 50 cycle, 110 volt; for three wires to be 50 cycle, 110-220 volt.

Franz, also known as W. A. NOTICE INVITING SEALED PROPOSALS FOR AUTOMOBILE.
Notice is hereby given that sealed proposals will be received by the City Council of the City of Anaheim, at the office of the City Clerk of said City, up to the hour of eight o'clock p.m. of Thursday, the 11th day of April, 1929, for furnishing to said City one single-seated Automobile at a price not more than $1800.00.
Each proposal must be accompanied by a certified or cashier's check, payable to City of Anaheim, in an amount not less than ten per cent of such bid; the check of the successful bidder will be held by said City until the delivery and acceptance of the automobile, as a guarantee of the faithful performance of the contract.
Further information may be obtained at the office of the City Manager of said city, and all proposals must be on forms furnished by said City Manager.
The City Council of said City reserves the right to reject any and all proposals.

stallments of principal and interest due and payable on said note, according to the terms thereof, and by reason of such defaults, said Pacific Coast Building-Loan Association, the owner and holder of said note and deed of trust, in accordance with the provisions thereof, on to-wit December 1, 1928, exercised its option and declared the full amount of the indebtedness secured by said deed of trust immediately due and payable, there being the total sum of $1,497.60 now due and unpaid; and
WHEREAS, in accordance with the provisions of Section 2924 of the Civil Code of California, said Pacific Coast Building-Loan Association, the owner and holder of said note and deed of trust, on December 6, 1928, caused to be recorded in the office of the County Recorder of said county a notice of such default in the payment of principal and interest and of its election to cause the property described in said deed of trust to be sold, in accordance with the provisions thereof, to satisfy said obligation, which notice of default and election to sell was duly recorded in Book 223, page 298, Official Records of said Orange county; and.
WHEREAS, said Deed of Trust provides that, if there is a default in the payment of any of the sums secured thereby, upon application of the holder of said note, the trustee shall give notice and sell so much of the property as shall be necessary to satisfy the indebtedness secured thereby; and.
WHEREAS, said Pacific Coast Building-Loan Association, by reason of the default in payments as stated, has requested the TITLE GUARANTEE AND TRUST COMPANY to give notice and to sell said property, or so much thereof as shall be necessary to sell, to pay all the indebtedness secured and expenses incurred necessary to the execution of said trust.
NOW, THEREFORE, notice is hereby given that the TITLE GUARANTEE AND TRUST COMPANY by virtue of the authority vested in it as Trustee, will sell at public auction, to the highest bidder, for cash in GOLD COIN, on the 6th day of April, 1929, at the hour of 11 o'clock a.m. of said day,
Lot Eleven (11) in Block "A" of Tract 524, as per Map thereof recorded in Book 22, page 1, Miscellaneous Maps, Records of Orange County, California, subject to prior encumbrances of record; or so much thereof as shall be necessary to pay all principal, interest advances, charges costs and trustee's fee, due and unpaid, secured by said deed of trust.
