Annual Report of Chairman Cuttle
What Conservation Association Accomplished During Year
Following is the annual report of Chairman Francis Cuttle of the tricounties water conservation committee, submitted to that body at the meeting October 14:
Water Supplies
The problem of maintaining adequate and dependable water supplies for domestic purposes and irrigation in Southern California has lost none of its importance in the public estimation during the past year; in fact, it is not too much to say that people generally are recognizing that upon the proper solution of this problem depends all other industries and activities.
The term "adequate and dependable" water supplies is stressed in considering this matter, for the reason that there are places in Southern California where so-called "water rights" are being sold with lands, which "rights," to say the least, are very questionable as to their adequacy and dependability.
It is becoming more apparent to the public in general that the limit of growth in population and material wealth in Southern California is measured almost wholly by the amount of water obtainable, and it should be further recognized that drawing upon supplies that have been accumulated over a long period of years, which means a lowering water plane, can hardly be considered a permanent supply. When the amount used is more than the annual water crop there must eventually be either less use or depletion of the supply, with the result that someone will suffer for lack of water. Development no longer consists of sinking artesian wells, or wells from which water is pumped. In many cases such so-called development means only dividing the supply with others who are already using it. True development of water today in Southern California means conserving that which runs to waste, either through rivers into theods of preventing flood damage and conserving all of the waters of these streams, on October 20, 1925, the association filed upon 250,000 acre-feet of water; and it should be clearly understood that the filing on this amount of water by the water conservation association was not intended to prevent the conservation and use of flood water by parties who would be benefitted by such work on the Santa Ana river and its tributaries.
Water Levels
The record of water levels, kept monthly for the past year, shows that the average pressure in artesian wells has risen 3.86 feet over last year, while the average level in water from surface wells has shown a rise of 5.03 feet over last year. (Measurements on one artesian well and one surface well have been abandoned during the past fiscal year. One has gone dry and on the other measurements were not taken or it was flowing.) There has not been the sensational rise in these water levels that there was in 1923, 1924, and 1925, following the large amount of water spread in 1922, but it is gratifying to note that the water is not falling, but is showing a gain, while water levels in other parts of Southern California are falling.
Water Spread
During the past season the water conservation association diverted and spread 360,447 miners inches of water. Much more could have been done had the rainfall come more gradually. For a long time, while water was escaping into the ocean, it was practically impossible to divert water on account of the large amount in the stream, and it would not have been advisable to have used it, even if it could have been diverted, as it was carrying so much silt that it would no doubt have done a great deal of damage to the spreading grounds by slitting them up, making them impervious to water. This illustrates very clearly the necessity for constructing dams in the can-
lowering water plane, can hardly be considered a permanent supply. When the amount used is more than the annual water crop there must eventually be either less use or depletion of the supply, with the result that someone will suffer for lack of water. Development no longer consists of sinking artesian wells, or wells from which water is pumped. In many cases such so-called development means only dividing the supply with others who are already using it. True development of water today in Southern California means conserving that which runs to waste, either through rivers into the ocean, or eventually the use of sewage water. It is conceivable that the time may come when there will be a restriction on the amount of water used both for domestic purposes and for irrigation, so that the amount available may be made to serve the greatest possible number of people and area of land.
Rainfall
The rainfall for the past year in Southern California was above the average. In San Bernardino, the source of our water supply, it was 20:55 inches, or 4.55 inches above the average, but unfortunately this rain came in storms of such violence as to create large runoff at the time of precipitation, resulting in floods and flood damage, and most unfortunately in the loss of 70,000 acre-feet (U. S. G. S.;) some put this as high as 100,000 acre-feet of water lost into the Pacific ocean through the Santa Ana river and its tributaries. It is to prevent the loss of this water and put it to beneficial use that this organization is striving for.
Santa Ana River Survey
The survey of the Santa Ana river and its tributaries, which is being carried on under the direction of the state engineer, through funds provided by the state and three counties, was not completed in time to submit the same to the legislature of 1927, and an appropriation of $40,000 was secured through a bill introduced by Senator Ralph Swing near the end of the session, and it was through his efforts, ably assisted by Senator Kline and Assemblymen Ball, Wherrell, Brock and Jones, that the appropriation was secured.
The Boards of Supervisors of the three counties matched the first installment of the appropriation by contributing the sum of $6,666.67 from each county, all of which has been paid into the state treasury. The study of the underground waters of the three counties, particularly Orange county, is being carried on, and we are advised within the last few days that there are two parties continuing the work and that there has been, and will be, no interruption in this work, but that a continuous record of investigation of ground water fluctuations will be kept, so that engineers will have all information before them on which to base final conclusions.
There is every reason to believe that the survey will be completed and available for consideration in advance of the session of the legislature which convenes January 1, 1929, so that the

Extension of the contour ditches has been on a limited scale, only during the past year, as the association has been co-operating with the federal government by contributing men and money in constructing lanes and trails to protect the watershed and prevent erosion, as it is known that the burning of the growth on the watershed results in bringing down large quantities of ash and slit, which fill up the interstices in the gravels upon which we sink the water. This would also be corrected, to a large extent, by the building of dams where such detritus would be held, the water clarified and then drawn off for sinking purposes.
New Headgate
Change in the channel of the stream during high water of 1927 has made it somewhat difficult to divert water through the Richey intake, and it is recommended that a new headgate be constructed at a point between the Richey intake and our original intake. The point has not yet been selected, as it will be necessary to secure a right way. The cost of the headgate will possibly range between $250 and $500. Negotiations are now pending with owners of land to secure a right to build this headgate and divert water at another point.
If agreeable to the directors, the force of men will now be increased and preparation made for the sinking of as much water as possible during the coming season.
SUPERVISORS' PROCEEDINGS
The chairman was authorized to approve the bond on map tract No. 777, and map tract No. 777 was accepted as the official plotting of said tract.
J. J. Dwyer was appointed as a member of the Orange county flood control advisory board, as per recommendation of the Orange county farm advisory board.
Fumigating licenses were ordered issued to Jones & Oberley, G. E. Herrman, G. Hawk, W. A. Humhard, Frances Citrus Association, C. C. Brown and Garden Grove Citrus Association; imposing fines were ordered issued to spread 360,447 miners inches of water. Much more could have been done had the rainfall come more gradually. In view of the fact that there seems to be some agitation about water filings in San Bernardino county, it may not be out of place to state again the condition of the rights and filings of this association.
Prior to the formation of the state water commission in 1911, this association filed notices of appropriation of 30,000 inches of water of the Santa Ana river for conservation purposes. As there was no water commission or division of water rights at that time, the law provided that notice should be posted at the point of diversion and filed with the county clerk of the county in which it was proposed to make the diversion. This procedure was compiled with and the association proceeded with due diligence to divert and use water appropriated, to the extent that it was available.
After the creation of the division of water rights, this association filed upon 48,000 acre-feet of water, it being stated in the application that it was to augment the supply of irrigating water on lands in San Bernardino, Riverside and Orange counties, being the lands irrigated by water appropriated by companies and individuals who were subscribing to the expense of this association. This filing was perfected and the permit secured for 48,000 acre-feet of water. The contract for the construction of a grade separation structure near Stern's station on the Pacific Electric Railway was awarded to W. M. Ledbetter & Company, at a price of $14,254.
Resolution in the matter of Road District Improvement No. 49, ordering bonds issued for contract price, was regularly adopted.
Resolution relative to government lands, Silverado, Harding and Santiago canyons was regularly adopted.
Hearing of the petition of Capistrano Beach Company, et al., was set for November 1, 1927, at 10 a.m.

The county auditor was ordered to draw a warrant on the county general fund for $253.45 in favor of the city of Santa Ana in payment to correct for any minor person sixteen (16) years old at any public dance dance. It shall be parent or guardian of the age of sixteen proprietor personally public dance, to person to enter, be or do dance hall.
SECTION 8. It is for any person to conduct any public dance hours of two (2) and six (6:00) o'clock day.
SECTION 9. All or places where public must at all times dance throughout, and the mination must not time such dance open to the public.

"AN ORDINANCE REGULATING PUBLIC DANCE HALLS AND PUBLIC DANCES IN THE CITY OF ANAHEIM"
THE MAYOR AND CITY COUNCIL OF THE CITY OF ANAHEIM DO ORDAIN AS FOLLOWS:
SECTION 1. It shall be unlawful for any person, association of persons, or corporation, to conduct, or assist in conducting, any public dance hall or any public dance in the City of Anaheim, unless they shall first obtain a permit so to do from the City Council of the City of Anaheim.
SECTION 2. Permits to conduct public dance halls or public dances may be issued by the City Council upon the written application of any person for himself, or on behalf of any associations of persons or corporations. The City Council may require at the hearing of said application evidence as to the good character of the applicant, and may, in its discretion, refuse to issue said permit to any person whom it finds from such evidence to be a bad character, or unfit to conduct such public dance halls or public dances.
SECTION 3. When the City Council shall issue any permit under the terms of Section 2, the same may be revoked at any time thereafter by said City Council, if said Council becomes satisfied that the conduct of such dance halls or public dances does not or will not comport with the public welfare, or that the same has been conducted in an illegal, improper or disorderly manner. The City Council may make rules governing the public dance halls and public dances, and may revoke or suspend a permit issued for any public dance hall or public dance when the proprietor or person or persons in error in original assessment No. 16-67, Sycamore street lights.

SECTION 4. For the purpose of this Ordinance, a public dance hall is defined to be a place where dances are conducted, either for profit or not for profit, and to which the public is admitted, either with or without charge, or at which the public is allowed to participate in the dancing, either with or without charge.
SECTION 5. For the purpose of this Ordinance, the term "public dance" is defined to be a gathering of persons in or upon any premises where dancing is participated in, either as the main purpose for such gathering, or as an incident to some other purpose, and to which premises the public is admitted.
SECTION 6. It shall be the duty of the Chief of Police of the City of Anaheim to employ, with the approval of the City Council, a matron to be present at all public dance halls or public dances within the City of Anaheim. The salary and expenses of such matron shall be paid by the person, firm or corporation conducting said dance hall or public dance, which salary shall be payable in advance to the Chief of Police before the public dance is held in the City of Anaheim.
SECTION 7. It shall be unlawful for any minor person under the age of sixteen (16) years to enter, be or dance at any public dance hall or public dance. It shall be unlawful for any parent or guardian of a minor under the age of sixteen (16) years, or the proprietor personally in charge of any public dance, to permit any such person to enter, be or舞 in any public dance hall.
SECTION 8. It shall be unlawful for any person to conduct or assist in conducting any public dance between the hours of two (2:00) o'clock A. M. and six (6:00) o'clock A. M. on any day provided, however, that no permit for a public dance hall or public dance or dances shall be revoked or suspended under the terms of this Section, unless hearing and notice thereof be given, which hearing shall be had before the City Council of the City of Anaheim not less than ten (10) days from the date of service of notice upon the permitee, and that at said hearing the permittee shall be permitted to introduce such evidence as is material to the hearing.

SECTION 11. Any person, association of persons or corporation who shall violate any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punishable by a fine not exceeding Three Hundred ($300.00) Dollars, or by imprisonment in the City Jail for a period of not exceeding ninety (90) days, or by both such fine and imprisonment, and upon conviction, any permit which may have been granted to such person, association or persons or corporation, to conduct,
