PROCLAMATION AND NOTICE OF SPECIAL ELECTION
IN THE MATTER OF THE ISSUANCE OF SIX HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00) OF BONDS OF THE COUNTY OF ORANGE STATE OF CALIFORNIA FOR THE FURTHER IMPROVEMENT, DEVELOPMENT AND PROTECTION OF NEWPORT HARBOR.
STATE OF CALIFORNIA.
COUNTY OF ORANGE.
WHEREAS, there exists in the County of Orange, State of California, at Newport Beach, a harbor, bay, inlet or arm of the sea, commonly called and known as "Newport Harbor," and
WHEREAS, under and by virtue of an Act of the Legislature of the State of California, approved June 18, 1915, enforced on January 24, 1915 by the Frontier Improvement Department, Development or Protection of any Harbor Bay, Inlet or Other Arm of the Sea Existing within any County of This State, Providing for the Appointment of a Harbor Commission by the Board of Supervisors of any such County to Have Charge and Control of the Improvement, Development or Protection thereof and the Voting. Issuance and Sale of the Bonds of Such County to Pay the Cost Thereof, and all Amendments thereto the Board of Supervisors of the County of Orange, State of California, have heretofore appointed a Harbor Commission, and
WHEREAS, under and by virtue of the provisions of said act, bonds in the sum of FIVE HUNDRED THOUSAND DOLLARS ($500,000.00) have heretofore been voted by the people of Orange County, and
WHEREAS, said sum of FIVE HUNDRED THOUSAND DOLLARS ($500,000.00) has heretofore been expended under the direction and supervision of said Harbor Commission, and
WHEREAS, said Harbor Commission has filed its final report with the Board of Supervisors, which said report was accepted by said Board of Supervisors and said former Harbor Commission was, under the provisions of said act, terminally discharged and ceased to exist, and
WHEREAS, work for the development and protection of said Newport Harbor had been commenced and accomplished under the above entitled Act, the Board of Supervisors of the County of Orange, State of California pursuant to the Amendment of said Act, passed and adopted by the Legislature in the year 1921, did, on the 7th day of October, 1924, at a regular meeting of said Board, appointing a Harbor Commission, consisting of five members, each of whom was and had been for two years prior thereto, a bona fide resident elected to be said County, for the purpose of considering the feasibility of the further development of said Harbor, and
WHEREAS, the members of said Harbor Commission so appointed by said Board of Supervisors, duly qualified in plan and system for the further development, improvement and protection of said harbor was the sum of ONE MILLION. Two Hundred Thousand Dollars ($1,200,000.00), and
WHEREAS, said Act herefore referred to provides that upon the performance of the several things hereinbefore cited, the Board of Supervisors of said County, after such steps have been taken shall, without delay, call a special election to determine whether bonds of such County shall be issued and sold in the amount estimated by the Harbor Commission and set forth in the Resolution of the Board of Supervisors, accepting and approving the plans and specifications and report of said Commission, and
WHEREAS, the Board of Supervisors on said 2nd day of June, fixed the 7th day of October, 1925, as the day upon which an election should be called for submitting to the Council of voting bonds as aforesaid for the further development, Harbor, and
WHEREAS, on the 24th day of August, 1925, the Board of Supervisors upon a reconsideration of its fixing the 7th day of October, 1925, rescinded said order by a unanimous vote of said Board being voted and voting on day by an order duly entered upon the minutes of said Board, fixed the 7th day of April, 1926, as the day for the calling of a special election throughout the County of Orange, for the purpose of submitting to the vote of the qualified electors of said County for the question of the insurance of the Bonds of the County for the purposes aforeseen,and,
WHEREAS, the Board of Supervisors on the 2nd day of March, 1926, at a regular meeting of said Board, by Resolution rescinded said order calling said election for April 7th, 1926, by a unanimous vote of said Board, all of the members or said Board being voted on day by an order duly entered upon the minutes of said Board, fixed the 10th day of June, 1926 as the day for the calling of a special election for the purpose of submitting to the vote of the qualified electors of said County for the question of the insurance of the Bonds of the County for the purposes aforeseen,and,
WHEREAS, the Board of Supervisors did regularly meet said Board held on the 4th day of May, 1926, adopt a Resolution calling a special election to be held throughout the County of Orange on the 10th day of June, 1926 for the purpose of submitting to the qualified electors of the County of Orange for the question of the insurance of the Bonds of the County for the purposes aforeseen,and,
WHEREAS, the Board of Supervisors did regularly meet said Board held on the 4th day of May, 1926 for the purpose of submitting to the qualified electors of the County of Orange for the question of the insurance ofthe BondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangethequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangethequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangethequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangethequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangethequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangethequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangethequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangethequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangethequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangeThequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangeThequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangeThequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,
WHEREAS,theBoardOfSupervisorsdidregularmeetingofsaidBoardheldonthe4thdayofMay,1926forthepurposeofsubmittingtothequalifiedelectorsoftheCountyofOrangeThequestionoftheinsuranceoftheBondsoftheCountyforthepurposeaforeseen,and,

WHEREAS, work for the development and protection of said Newport Harbor had been commenced and accomplished under the above entitled Act, the Board of Supervisors of the County of Orange State of California pursuant to the Amendment of said Act, passed and adopted by the Legislature in the year 1921, did, on the 7th day of October, 1924, at a regular meeting of said Board, appoint a Harbor Commission, consisting of five members, each of whom was and had been for two years prior thereafter, duly organized in conformity to law, and did proceed with all diligence to cause a proper survey to be made of that certain Harbor, bay, inlet or arm of the sea, same being located within the County of Orange and commonly called Newport Harbor, that being the harbor designated to be further improved, developed and protected.
WHEREAS, said Harbor Commission did after a careful survey, investigation and examination of said Harbor, find and report to the Board of Supervisors of said County that said Harbor could be further improved, developed and protected and that the public would be benefited by such further improvement, development and protection and that the cost would not be disproportionate to the benefits to be derived therefrom, and did provide detailed plans and specifications for the best and most feasible plan and system for the further improvement, development and protection of said Harbor and estimated the cost thereof and the amount to be raised by the issuance and sale of said bonds of said County, to-wit: the sum of ONE MILLION, TWO HUNDRED THOUSAND DOLLARS ($1,200,000.00) to do the work of said further improvement, development and protection, and did make a full, complete, comprehensive and final report its investigative and examination and filed together with said detailed plans and specifications with the Board of Supervisors of said County of Orange, on the 14th day of April, 1925, at which time said Board of Supervisors, by an order duly made and entered on its minutes fixed the time the hearing on report for the 12th day of May, 1925, at the hour of two o'clock, P.M., at the Chambers of the Board of Supervisors, in the Court House at Santa Ana, which said date was not more than thirty nor less than twenty days after the filing of said report, caused notice of the fact that said report had been filed the hearing thereof had been set for the 12th day of May, 1925, to be duly published in accordance with law, which publication was duly made, as will more fully appear from the affidavits of the Clerk of the Board of Supervisors,
WHEREAS, on the said 12th day of May, 1925, after a further hearing and consideration of said report of said Harbor Commission the Board of Supervisors, by an order duly made and entered on its minutes on said 19th day of May, 1925, ordered that a further hearing of said report be continued to the 2nd day of June, 1925, at the same hour and place,

WHEREAS, on the said 2nd day of June, 1925, after further hearing and consideration of said report of said Harbor Commission and after hearing all the protestants protesting against said report and after further consideration of said report and said plans and specifications, said Board of Supervisors being ultimately discharged and ceased to exist,

WHEREAS, on the said 19th day of May, 1925, after further hearing and consideration of said report of said Harbor Commission and after hearing all the protestants protesting against said report and after further consideration of said report and said plans and specifications, said Board of Supervisors being fully advised therein, passed and approved a Resolution accepting and approving said report, plans and specifications for the further improvement, development and protection of said Harbor, and designated said Harbor by the name of "Newport Harbor," same being the name by which said Harbor is commonly called and further resolved that the harbor system to be employed and used in the further improvement, development and protection of said Newport Harbor should consist of the following work, to-wit:
(1) Building a jetty on the east side of the entrance to said Harbor 1500 feet long, in accordance with the detailed plans and specifications of said Harbor Commission on file with said Clerk.
(2) Repairing the jetty on the westerly side of the entrance to said Harbor, in accordance with said plans and specifications.
(3) Building the necessary revetments to said settles in accordance with the plans and specifications, beforehand;
(4) Dredging an entrance to said Harbor 300 feet wide and 25 feet deep.
(5) Dredging an area at the turn, in accordance with the plans and specifications.
(6) Dredging the channel across said bay and harbor in accordance with said plans and specifications.
(7) Deepening the turning basin already dredged in said harbor in accordance with said plans and specifications.
(8) The construction of a wharf and equipment, in accordance with said plans and specifications.
(9) Dredging an anchorage area of recently present in said harbor in accordance with said plans and specifications.
All of the aforesaid work to be done and all of the materials to be furnished therefor was to be done and furnished in accordance with the detailed plans and specifications attached to and made a part of the report of the Harbor Commission thereof with the Board of Supervisors of said Orange County.
And said Board further resolved at said time that the estimated cost of said further improvement, development and protection of said Newport Harbor, according to the plan and system recommended by said Harbor Commission was the amount of ONE MILLION FIVE HUNDRED THOUSAND DOLLARS ($1,800,-000.00); and that the amount to be raised by the sale of bonds to carry out said
WHEREAS, on the said 19th day of May, 1925, after further hearing and consideration of said report of said Harbor Commission and after hearing all the protestants protesting against said report and after further consideration of said report and said plans and specifications, said Board of Supervisors being fully advised therein, passed and approved a Resolution accepting and approving said report, plans and specifications for the further improvement, development and protection of said Harbor, and designated said Harbor by the name of "Newport Harbor," same being the name by which said Harbor is commonly called and further resolved that the harbor system to be employed and used in the further improvement, development and protection of said Newport Harbor should consist of the following work, to-wit:
(1) Building a jetty on the east side of the entrance to said Harbor 1500 feet long, in accordance with the detailed plans and specifications, beforehand;
(2) Dredging an entrance to said Harbor 300 feet wide and 25 feet deep.
(3) Dredging an area at the turn, in accordance with the plans and specifications.
(4) Dredging the channel across said bay and harbor in accordance with said plans and specifications.
(5) Deepening the turning basin already dredged in said harbor in accordance with said plans and specifications.
(6) The construction of a wharf and equipment, in accordance with said plans and specifications.

and filed the same, together with detailed plans and specifications, at the Board of Supervisors, County of Orange on the 27th day of July, 1926, at which time said Board of Supervisors, by Resolution duly entered upon its minutes, fixed the time for the hearing on said report for the 24th day of August, 1926, at the hour of two o'clock, M. at the Chambers of the Board of Supervisors in the Court House, at Santa Ana; which said date was not more than thirty nor less than twenty days after the filing of said report, and caused notice of the fact that said report had been filed and that the hearing thereon was set for the 24th day of August, 1926, at the said time and place, be published in accordance with law, which publication is duly made, as will more fully appear from the affidavit of publication now on file in the office of the Clerk of the said Board of Supervisors, and
WHEREAS, on the said 24th day of August, 1926, being the time set for the hearing on said report of said Harbor Commission, and after hearing all protestants, protesting against said report and after further consideration of said report and said plans and specifications, said Board of Supervisors being advised thereto, passed and adopted a Resolution accepting said report, plans and specifications for improvement, development and protection of said Harbor by the name of "Newport Harbor," same being the name by which said Harbor is commonly called, and further Resolved that the plan system to be employed in the further improvement, development and protection of said Newport Harbor shall consist of the following work: to-wit:
(1) Building a jetty on the east side of the entrance of said Harbor 1500 feet long, in accordance with the detailed plans and specifications of said Harbor Commission and the Clerk of said Board of Supervisors;
(2) Repairing possible sinking of said Jetty;
(3) Repairing jetty on the west side of the entrance to said Harbor in accordance with said plans and specifications;
(4) Building the necessary revetiments to said Jetty, in accordance with the plans and specifications aforesaid;
(5) Dredging an entrance to said Harbor 300 feet wide and 20 feet deep, in accordance with said plans and specifications;
(6) Dredging an area at the turn of entrada to a depth of 20 feet, in accordance with said plans and specifications.
All of said work to be done and all of said materials to be furnished in accordance with these plans and specifications.
California, and none but qualified voters of the said County of Orange shall be permitted to vote thereat, and at said Special Election the polls must be opened at six o'clock in the morning of the day of election and must be kept open until seven o'clock. In the afternoon of said day, when the polls shall be closed.
That by Resolution and Order of the Board of Supervisors of the County of Orange heretofore duly made and entered, said Special Election has been, and the same is hereby called to be held throughout the County of Orange State. 1926, for the purpose of submitting to the vote of the qualified electors of said County above and foregoing question.
That the notice of said Special Election called for the 14th day of December, 1926, as set forth in the above foregoing Resolution and Order, and given by special Election once a week for at least four weeks prior to the said election. In the following newspaper, published in the County of Orange, to-wit: "Annaheim Gazette," which said paper is a paper general circulation printable and published in each County of Orange.

HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00), and that the amount to be raised by the sale of bonds to carry out said plan and system for the further development and protection of said Harbor is the sum of SIX HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00).
WHEREAS, sold Act heretofore referred to provides that upon the performance of the several things herein before recited, the Board of Supervisors of said County, after such steps have been taken, shall, without delay, have special election to be held in the amount estimated by the Harbor Commission in its report, as forth in the Resolution of the Board of Supervisors, accepting and approving the plans and specifications and the report of said Commission, and
WHEREAS, the Board of Supervisors on said 7th day of September, 1286 fixed at the 14th day of December, 1288 was the day when the regulation of said Harbor be it RESOLVED AND ORDERED by the Board of Supervisors of the County of Orange, State of California, at a regular meeting of said Board held in said County at the regular place of meeting thereof, all the members of said Board being present and voting therest, not having any regulation in their pursuant to the regulation and Order of said Board heretofore made and entered, that a special election has been, and is hereby called by said Board of Supervisors for the purpose of submitting to the qualified electors of Orange County the question of voting bonds as aforesaid, for the further development, improvement and protection of Newport Harbor.
WHEREAS, the Board of Supervisors on said 14th day of Monday the time and the occasion convassing and selection and that each Orange county had sold bonds Yes, shares to the words, and Supervisors on the said 10th day of deterring the purposes provided by said Elector in said Harbor, in the County of Orange under the plan and system hereinbefore set forth, specified and described in the report, plans and specifications of said Harbor Commission, accepted and approved by the Board of Supervisors, as aforesaid, and be it
FURTHER RESOLVED and ORDERED that the question of voting said bonds as submitted to the qualified electors of said County at said Special Election as follows: to-wit: "Shall the bonds of the County of Orange be issued to the amount of SIX HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00), for the further development improvement and protection of said Harbor in Newport Harbor, in accordance with the report of the Harbor Commission."
FURTHER RESOLVED and ORDENED that the question of voting said bonds as waived shall be submitted to the qualified electors of said County at said Special Election as follows, to-will: "Shall the bonds of the County of Orange be issued to the amount of SIX HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00), for the further improvement, development and protection of the entrance to Newport Harbor, in accordance with the report of the Harbor Commission."
That the ballots to be used at said Special Election shall contain the word: "Shall the bonds of the County of Orange be issued to the amount of SIX HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00), for the further improvement, development and protection of the entrance to Newport Harbor in accordance with the report of the Harbor Commission?" and to the right of this sentence, "Shall the bonds of the County of Orange be issued to the amount of SIX HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00), for the further improvement, development and protection of the entrance to Newport Harbor in accordance with the report of the Harbor Commission?"
Provided that if the electors at said Special Election shall vote to incur a bond indebtedness of the County to the amount of SIX HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00), above set forth, then and in that event, bonds of said amount of SIX HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00) shall be divided into 650 bond indebtedness from one to six hundred fifty inclusive, and each bond shall be of the denomination OF ONE THOUSAND DOLLARS ($1,000.00) and shall be consecutively numbered and payable within twenty years from its issue as follows: THIRTY-TWO THOUSAND DOLLARS ($32,000.00) and shall be consecutively numbered and payable within twenty years from its issue as follows: THIRTY-TWO THOUSAND DOLLARS ($32,000.00) respectively, shall be payable in alternate years thereafter until all of said bonds are paid in full.
The principal of said bonds and the interest therein shall be payable in gold compounded United States, at the office of the Treasurer of the County of Orange, in the City of Santa Ana, California, and each of said bonds shall draw interest at the rate of four and one-half per centum (4½%) per annum, payable semi-annually and evidenced by interest contracts attached thereto.
