PROCLAMATION AND NOTICE OF SPECIAL ELECTION
IN THE MATTER OF THE ISSUANCE OF SIX HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00) OF BONDS OF THE COUNTY OF ORANGE, STATE OF CALIFORNIA FOR THE FURTHER IMPROVEMENT, DEVELOPMENT AND PROTECTION OF NEWPORT HARBOR.
STATE OF CALIFORNIA.
COUNTY OF ORANGE.
WHEREAS, there exists in the County of Orange, State of California, at Newport Beach, a harbor, bay, inlet or arm of the sea, commonly called and known as "Newport Harbor," and
WHEREAS, under and by virtue of an Act of the Legislature of the State of California, approved June 11th, 1815, entitled "AN ACT PROVIDING FOR THE IMPROVEMENT, DEVELOPMENT AND PROTECTION OF ANY HARBOR, BAY, INLET OR OTHER ARM OF THE SEA EXISTING WITHIN ANY COUNTY OF THIS STATE, PROVIDING FOR THE APPOINTMENT OF A HARBOR COMMISSION BY THE BOARD OF SUPERVISORS OF ANY SUCH COUNTY TO HAVE CHARGE AND CONTROL OF THE IMPROVEMENT, DEVELOPMENT AND PROTECTION THEREOF," and all Acts amendments thereto, the Board of Supervisors of the County of Orange, State of California have hereof appointed a Harbor Commission, and
WHEREAS, under and by virtue of the said act, bonds in the sum of FIVE HUNDRED THOUSAND DOLLARS ($500,000.00) have heretofore been voted by the people of Orange County, and
WHEREAS, said sum of FIVE HUNDRED THOUSAND DOLLARS ($500,000.00) has hereof been expended under the direction and supervision of said Harbor Commission, and
WHEREAS, said Harbor Commission has filed its final report with the Board of Supervisors, which said report was accepted by said Board of Supervisors and said former Harbor Commission was, under the provisions of said Act, automatically discharged and ceased to exist, and WHEREAS, work for the protection and protection of said Newport Harbor had been commenced and accomplished under the above entitled Act, the Board of Supervisors of the County of Orange, State of California, pursuant to the Amendment of said Act, passed and adopted by the Legislature in the year 1921 on the day of October 19th at a regular meeting of said Board, appoint a Harbor Commission, consisting of five members, each whom was and had been for two years prior thereto, a bona fide resident, elector and freeholder of said County, for the purpose of considering the feasibility of the further development of said Harbor, and
WHEREAS, the members of said Harbor Commission so appointed by said Board of Supervisors, duly qualified in the manner and within the time prescribed by law and thereafter duly ordered to plan and system for the further development, improvement and protection of said harbor was the sum of ONE MILLION, TWO HUNDRED THOUSAND DOLLARS ($1,200,000.00), and
WHEREAS, said Act heretofore referred to provides that upon the performance of the several things baseloaded on the Board of Supervisors of said County, after such steps have been taken shall, without delay, call a special election to determine whether bonds of such County shall be issued and sold in the amount estimated by the Harbor Commission in its report and as set forth in the Resolution that board of Supervisors accepting and approving the plans and specifications and report of said Commission, and
WHEREAS, the Board of Supervisors on said 2nd day of June, fixed the 7th day of October, 1925, as the day upon which an election should be called for submitting to the voters of Orange County the question of voting for any member of the Board of Supervisors, appointed and protected by Newport Harbor, and
WHEREAS, on the 24th day of August, 1925, the Board of Supervisors upon a reconsideration of its order fixing the 7th day of October, 1925, rescinded said order by a unanimous vote of said Board, all of the members of said Board being present and voting, and on said day by an order duly entered upon the matter of said Board; fixed the 7th day of April, 1926, as the day for the calling of a special election throughout the County of Orange; for the purpose of submitting to the vote of the qualified electors of said County the question of the issuance of the Bonds of the County for the purposes afforded and paid,
WHEREAS, the Board of Supervisors on the 2nd day of March, 1926, at a regular meeting of said Board by Resolution, rescinded said order calling said election for April 7th, 1926; by a unanimous vote of said Board, all of the members of said Board being present and voting, and on said day by an order duly entered upon the matter of said Board; fixed the 7th day of June, 1926 as the day for the calling of a special election for the purpose of submitting to the vote of the qualified electors of said County the question of the issuance of bonds of said County in the sum-of ONE MILLION (TWO HUNDRED THOUSAND DOLLARS ($1,200,000.00)) for any member of said Board; fixed the 7th day of June, 1926 for the purpose of submitting to the qualified electors of the County of Orange the question of voting bonds of the County in the sum-of ONE MILLION (TWO HUNDRED THOUSAND DOLLARS ($1,200,000.00)) for any member of said Board; fixed the 7th day of June, 1926 for the purpose of submitting to the qualified electors of the County of Orange the question of voting bonds of the County in the sum-of ONE MILLION (TWO HUNDRED THOUSAND DOLLARS ($1,200,000.00)) for any member of said Board; fixed
and protection of said Newport Harbor had been commenced and accomplished under the above entitled Act, the Board of Supervisors of the County of Orange, State of California, pursuant to the Amendment of said Act, passed and approved by the Legislature on July 1924, on the 7th day of October, 1924, at a regular meeting of said Board, appoint a Harbor Commission, consisting of five members, each of whom was and had been for two years prior thereto, a bona fide resident, elector and freeholder of said County, for the purpose of considering the feasibility of the further development of said Harbor, and
WHEREAS, the members of said Harbor Commission so appointed by said Board of Supervisors, duly qualified in the matter and within the time prescribed by law and thereafter duly organized in conformity to law, and did proclaim with all diligence to be made of that certain Harbor, bay, inlet or arm of the sea, same being located within the County of Orange and commonly called Newport Harbor, that being the harbor designated to be further improved, developed and protected, and
WHEREAS, said Harbor Commission did, after a careful survey, investigation and examination of said Harbor on the Board of Supervisors of said County that said Harbor could be further improved, developed and protected and that the public would be benefitted by such further improvement, development and protection and that the cost thereof would not be disproportionate to the benefit be deferred therefore from detailed plans and specifications for the best and most feasible plan and system for the further improvement, development and protection of said Harbor and estimated the cost thereof and the amount to be raised by the issuance and sale of said bonds of said County, to-write: (1) "Said bonds of the County of Orange in the sum of ONE MILLION. TWO HUNDRED THOUSAND DOLLARS ($1,200,000.00), for the purpose of the further development and protection of Newport Harbor. Said question at said election was submitted to the qualified electors in two, separate and distinct units, to-write:
(1) "Said bonds of the County of Orange be issued in the sum of SIX HUNDRED THOUSAND DOLLARS ($1,200,000.00), for the further improvement, development and protection of the entrance of Newport Harbor in accordance with the report of the Harbor Commission" and
(2) "Said bonds of the County of Orange be issued in the sum of SIX HUNDRED THOUSAND DOLLARS ($1,200,000.00), for the further improvement, development and protection of the entrance to Newport Harbor in accordance with the report of the Harbor Commission" and to the right and opposite said question was presented with voting squares to the right of and opposite said words, and
(3) "Said bonds of the County of Orange be issued in the sum of SIX HUNDRED THOUSAND DOLLARS ($1,200,000.00), for the purpose of determining whether bonds of the County of Orange should be made through law; said Board did proceed publicly and in the manner provided by law to canvass the returns of said election upon the two proposition, to-write:
(1) "Said bonds of the County of Orange be issued in the sum of SIX HUNDRED THOUSAND DOLLARS ($1,200,000.00), for the purpose of determining whether bonds of the County of Orange should be made through law; said Board did proceed publicly and in the manner provided by law to canvass the returns of said election upon the two proposition, to-write:

WIMBLEY,on the说,during a meeting held on Monday evening at noon in New York City to discuss matters related to a proposed new harbor project. The meeting was attended by several members from local government agencies. The discussion focused on issues such as water quality control measures for new harbors; potential impacts on nearby communities; and recommendations for future harbor developments. The meeting concluded with a formal agreement regarding a proposed new harbor project.
(3) Building the necessary revolvements to aid leftovers in accordance with the plans and specifications. Ahead of this meeting a plan was prepared for construction or a wharf installation. In accordance with these plans and specifications (4) Dredging an entrance to said Harbor for use by vessels. In accordance with these plans and specifications (5) Dredging a channel across salt bay and harbor in accordance with these plans and specifications. (7) Deepening the turning basin already dredged in salt harbor in accordance with these plans and specifications. (8) Construction of a wharf and equipment in accordance with these plans and specifications. (9) Dredging an anchorage area of seventy acres in salt harbor in accordance with these plans and specifications. All of these materials were to be furnished thereafter to be done and furnished in accordance with these detailed plans and specifications attached to and made part of the report of the Harbor Commission. Then on file with the Board of Supervisors or Salute County.
And sald Board further resolved at said time that the estimated cost of salt further improvement development and protection of said Harbor commission was the sum of ONE MILLION. TWO HUNDRED THOUSAND DOLLARS ($1.200,-000.00), and that the amount to be raised by the sale of bonds to carry out said
Proposition #3 "Bonds Yes." (15%) Bonds No. (55%), upon which said proposition the Board of Supervisors thereupon found the vote to be against its assurance of the bonds for the purpose set forth in said question. And WHEREAS. on the 22nd day of June,1926,at a regular meeting said Board of Supervisors,by an order duly entered upon its minutes,ordered that the Harbor Commission be continued in existence for the purpose carrying out additional improvement development and protection of Newport Harbor,and WHEREAS,said Harbor Commission,after being continued in existence,as aforesaid did make a further careful survey,investigation and examination saidHarborand did find和report totheBoardofSupervisorsofsaidCountythatsaidHarborcouldbe further improved,developedandprotectedandthatthepublic couldbenefitedbymuchimprovement,developmentandprotectionandthatthecostthereofwouldnotbedisproportionatetothe benefittoberivedtherefromandbidprovidedetailedplansandspecificationsforthebestandmostfeasibleplanandsystemforthefurtherimprovementdevelopmentandprotectionofsaidbondsofsaidCounty.to-wit:thesumofSIXHUNDREDFIFTYTHOUSANDDOLLARS($650,-000.00)to dotheworkofsaltfurtherimprovementdevelopmentandprotectionsaidHarboranddidmakeafullcompletesuperhensiveandfinal-reportofitsinvestigationandexamination

and filed the same, together with detailed plans and specifications with the Board of Supervisors of said County of Orange on the 24th day of July, 1926, at the said Board of Supervisors, by duly entered upon its minutes, fixed the time for the hearing on said report for the 24th day of August, 1926, at the hour of two o'clock, P. M., at the Chambers of the Board of Supervisors, in the Courthouse of Santa Ana, which date was not more than thirty nor less than twenty days after the filing of said report, and caused notice of the fact that said report had been filed and that the hearing thereof had been set for the 24th day of August, 1926, at the said time and place to be published in accordance with law, publication was duly made, as will more fully appear from the affidavits of publication now on file in the office of the Clerk of the said Board of Supervisors, and
WHEREAS, on the said 24th day of August, 1926, being the time set for the hearing on said report of said Harbor Commission, said report was read and, until publication was duly made, further hearing on said report was continued to September 7, 1926, at two o'clock, P. M., at the Chambers of the Board of Supervisors, at the Court House, in Santa Ana, said County, and
WHEREAS, on said 7th day of September, 1926, after further hearing and consideration of said report of said Harbor Commission, and after hearing all protestants protesting against said report and said plans and specifications, said Board of Supervisors being fully advised therein, passed and adopted a Resolution accepting and approving said report, plans and specifications for further improvement development and protection of said Harbor by the name of "Newport Harbor," same being the name by which said Harbor is commonly called, and further Resolved that the plan and system to be employed and used in the further improvement development and protection of said Newport Harbor shall consist of a building followed by to-wit:
Building jetsy on the east side of the entrance of said Harbor 1500 feet long, in accordance with the detailed plans and specifications of said Harbor Commission on file with the Clerk of said Board of Supervisors.
(2) Repairing possible sinking of said jetsy.
(3) Repairing jetsy on the west side of the entrance to said Harbor in accordance with said plans and specifications.
(4) Building the necessary revotions to said jetsy in accordance with the plans and specifications offered by Dredging an entrance to said Harbor 300 feet wide and 20 feet deep in accordance with said plans and specifications.
(5) Dredging an area at the turn of said entrance to a depth of 20 feet in accordance with said plans and specifications.
All of said work to be done and all of said materials to be furnished in accordance with the detailed plans and specifications attached to and made a California, and none but qualified voters of the said County of Orange shall be opened at six o'clock in the morning of the day of the election and must be kept open until seven o'clock, in the afternoon of day when the polls shall be closed. That by Resolution and Order of the Board of Supervisors of the County of Orange heretofore duly made and entered, said Special Election has been, and the same is hereby called to be held throughout the County of Orange. State California, on the 14th day of December, 1926, for the purpose of submitting to the vote of the qualified electors of said County the above and foregoing question.
That the notice of said Special Election called for the 14th day of December, 1926, as set forth in the above and foregoing Resolution and Order and Notice of Special Election shall be given by publication of said Notice of Special Election once a week for least four days in a newspaper published in the County of Orange, to-wit: "Anahale Gazette," which said paper is a paper of general circulation and printed in said County of Orange. That following are the general election precincts for this election declared to be and are adopted by bond election precincts for said Special Election, together with the polling places therein designated and the names of the election officers appointed to hold, conduct and make returns of said election as required by law:

REPRESENTATION OF SIX HUNDRED FIFTY THOUSAND DOLLARS (¥650,000.00) and WHEREAS, said Act heretofore referred to provides that the performance of the survey things herein performed, the Board of Supervisors of said County, after such steps have been taken, shall, without delay, call a special election to determine whether the bonds of said County shall be issued and sold in the amount estimated by the Harbor Commission in the report of the Board of Supervisors accepting and approving the plans and specifications and the report of said Commission, and WHEREAS, the Board of Supervisors on 7th day of September, 1926, fixed the 11th day of December, 1926, as the day upon which the special election should be called for the purpose of submitting to the question of voting bodies as aforesaid, for the further development, improvement and protection of Newport Harbor.
NOW THEREFORE, by the Board of Supervisors of the County of Orange State of California, the regular meeting of said Board held in said County at the regular place of meeting thereof, all the members of said Board being present and voting thereat, that notice be, and the same is, hereby given, pursuant to the Resolution and Order of said Board heretofore duly made and entered that a special election be entered that borough called by said Board of Supervisors for the purpose of submitting to the qualified electors of the County of Orange, at a special election to be held in throughout said County, the question of the issuance of bonds of said County of Orange for the purpose of incurring and abidingness of such HUNDRED FIFTY THOUSAND DOLLARS (¥650,000.00) for the purpose specified as follows: so-wit: For the further improvement, development and protection of the entrance of Newport Harbor in the said County of Orange under this special election described in the report plans and specifications of said Harbor Commission accepted and approved by the Board of Supervisors, as aforesaid, and as follows:
