Pollution of Streams Diminishing in State Damage From Gas Houses, Oil Wells, Etc., Decreasing Conditions as regards the pollution of rivers and harbors of California have improved materially in the past three months, according to a recent statement by Major Rolin G. Watkins, director of the bureau of river and harbor pollution of the California Fish and Game Commission. The pollution bureau, created since the reorganization of the commission, shortly after the first of the current year, has taken particular cognizance of cases of pollution by gas houses, oil wells and refineries and distilleries. Reports which came in from virtually every section of the state were investigated and remedial action demanded. In most cases this was forthcoming without the necessity for court action. In others it became necessary to file proceedings at law to force action. Robert J. Irvine, a graduate chemist and bacteriologist, has been added to the staff of the pollution bureau. With his assistance a comprehensive analysis of all polluted waters is prepared for presentation to the proper authorities, upon which to base prosecution under Section 635 of the Penal Code. While conditions have greatly improved in recent months, Watkins still declares that there are numerous other cases and conditions in various communities that must be cleaned up ere California waters can be said to be wholly safe for fish, plant and bird life. Those responsible for pollution are always given an opportunity to rectify conditions first. Falling in this, the pollution bureau does not hesitate to take action under authority granted it by the commission upon its establishment. Watkins again requested that all persons knowing of cases of river and harbor pollution report same to him at Room 174 Postal Telegraph Building. West Coast Club Is Found Guilty Judge Morrison Imposes Fine of $300 in Water Waste Case A jury in Justice K. E. Morrison's court which has been hearing evidence and argument in the case of the West Shore Gun Club, returned a verdict of guilty, following a half hour's deliberation. Prosecuting officials and interested ranchers, who crowded the courtroom during the trial, were jubilant at their success. The defense will appeal, it was made known through L. A. West of counsel, but that fact failed to dampen celebration of the victory. The district attorney's office was preparing to press more of the dozen or so complaints against various gun clubs. These complaints were filed following a report by the 1925 grand jury, recommending prosecution of the gun clubs. A grand jury committee, accompanied by Deputy District Attorney D. G. Wettlin, had conducted an investigation of the situation, and claimed to have found numerous wells flowing unchecked upon the preserves of various clubs. The committee's findings raised a wave of protest in agricultural circles throughout the county. The West Shore Gun Club was the first brought to trial. Its attorneys, L. A. West, Santa Ana; George Adams and ex-Judge Ralph Clock of Los Angeles offered the defense that the water allowed to flow over leased lands of the gun clubs was being put to beneficial use. Fred Bixby, Long Beach capitalist, who owns most of the lands leased to the gun clubs in that section, was the chief witness for the defense, whose case rested upon his testimony. Bixby declared that the gun clubs were required, under their leases, to allow the water to flow unchecked for five months during the year as a process of leeching the alkali from the soil and reclaiming it for agricultural use. He declared his bureau had been given the finest support by city, county, state and federal authorities, with particular reference to cooperation between his office and the Bureau of Sanitary Engineering, State Board of Health and the Federal Bureau of Harbor Engineers. J. C. Hayden Goes To Los Angeles C. E. Rutledge Succeeds Him as Gas Company Manager Transfer of J. C. Hayden, for several years district manager in charge of the properties of the Southern Counties Gas Company in Orange county, to the Los Angeles offices is announced by officials of the corporation. He will be succeeded by Charles E. Rutledge, formerly district manager of the company's distribution system and properties in Santa Barbara. Rutledge arrived recently and took over the organization's affairs in the division. He has been with the Southern Counties Gas Company for a number of years and comes to this district highly recommended by officials. A meeting of all Orange county employees of the company was held in the Santa Ana gas office, where the retiring executive J. C. Hayden, introduced the incoming Orange county district manager, Frank H. Blvens, general agent for the corporation, with headquarters in Los Angeles, was present. More than 100 of the company's employees were in attendance. Rutledge has been in the public utility business since 1902. Starting and excluding Tulsa Clock of Los Angeles offered the defense that the water allowed to flow over leased lands of the gun clubs was being put to beneficial use. He described three processes of reclamation, stating that the leeching process was the only practical method for his lands, and asserted that 1000 acres of land had been so reclaimed during the last few years. The land is washed with water for five months of the year, this water draining into ponds, which are drained away after the hunting season, carrying the alkali in the water. The prosecution blasted the defense in two ways. It produced authorities including Francis Cuttle of Riverside, head of the tri-county reforestation association, to prove that the process Bixby described was only temporarily successful. These authorities declared that white alkali is soluble in water and that, therefore, the first water flowing on the land, which it was admitted would seep into the ground, would carry the alkali down into the ground with it. The alkali would be carried deep enough that for several seasons the land might be productive, but that further moisture upon it would again bring the alkali to the surface. Judge Morrison imposed a fine of $300. Starting with the Southern California Edison Company, in Santa Monica, in that year, he has advanced steadily, and in 1916 was sent to Santa Barbara, where he became district foreman. On March 11, 1919, when the Southern Counties Gas Company acquired the Santa Barbara properties, Rutledge was retained by the organization as district foreman. On September 1, 1923, when Frank H. Blvens, now general agent for the utility, was transferred south, Rutledge was promoted to the position of district manager in the Santa Barbara territory. There he remained until the present time, when he again was advanced to the chief executiveship for the Orange county district. Rutledge won for himself and company wide recognition during the earthquake of June 29, last year. Immediately following the earthquake, gas service throughout Santa Barbara was discontinued. His organization worked constantly for several days in order to restore gas service to the stricken city. During the last several months, a considerable part of the Santa Barbara gas distribution system has been entirely rebuilt under Rutledge's personal direction. He has taken an active part in business and civic affairs in Santa Barbara. At the time of his advancement to this territory, he was a director of the Santa Barbara Rotary Club, a director of the Santa Barbara Chamber of Commerce, past master of the Santa Barbara lodge No. 192, F. and A. M., and has taken a keen interest in civic movements generally. The reason they still call it prewar liquor is that after you drink it the battle starts immediately. One thing that puzzles us is where all of these Chinese armies get the money to pay for their ammunition. Abd-el-Krim can be thankful for one thing when peace is declared. Dumke has assigned said promissory note to John Paul Lee; and Whereas, a breach and default under the terms of the said deed of trust and under the terms of said note occurred in that the payment of interest as above called for payable on the 8th day of January, 1926, has not been made; and Whereas, principal in the amount of $7,500.00 and interest from July 8th, 1925 to February 17th, 1926, in the amount of $321.37, including compound interest, being a total sum of $7,821.37 to February 17th, 1926, and all pay- and Whereas, the said Abstract & Title Guaranty Company thereafter, on the 17th day of February, 1926, did record in the office of the Recorder of the said County of Orange, a notice of the above mentioned default in the payment of the said principal and interest due under the terms of the said note and notice of the election of the said John Paul Lee to sell the property described in the said deed of trust after three months shall have elapsed following the recordation of said notice to satisfy the obligation evidenced by said note and secured by the said deed of trust; and Whereas, more than three months have elapsed since the recordation of said notice and the sums and obligations secured by the said deed of trust remain unpaid.
