APPEALS FROM JUSTICE COURT
Insisting that he is entitled to collect 2 cents per mile for each of the 10,000 miles which he alleges Alfred Miller, his ranch helper, operated his automobile without the owner's knowledge, Louis Henning has filed an appeal in the superior court from a decision of Justice J. S. Howard, of Anaheim, who awarded Miller judgment for $130.40 on his suit against Henning for wages.
Miller originally sued Henning in justice court for $109.57 wages. Henning, he said, had discharged him January 4, after Miller had worked a month and 12 days at a stipulated wage of $70 per month and board.

automobile without the owner's knowledge, Louis Henning has filed an appeal in the superior court from a decision of Justice J.
Henning being away from home part of the time, Miller was forced to get his board elsewhere at his own expense, amounting to $10.40, he alleged. He also claimed $1.20 as expense he paid for tractor repairs during Henning's absence.
Henning's cross-complaint charged that while he, Henning, was unaware of what was going on, Miller used Henning's car and drove it 10,000 miles, charging up a gasoline bill of $59.62 to his employer. This sum and $200, representing 2 cents per mile for the use of the car, were demanded by Henning.
Justice Howard, on May 24, decided in favor of Miller, whose brother, William Miller, was appointed as guardian to act for him in the case. Alfred Miller is only 20 years of age. Henning's claim was denied.
Henning accordingly appealed to the superior court through his counsel, Tipton and Callor. Attorney Leonard Evans represents Miller.
