WORKED FOR EX-WIFE BUT SHE REFUSED PAY Orange Painter Couldn't Get Credit on Allimony Account If a divorced husband is required by a court order to pay $15 per month for the support of a minor child and does work for his ex-wife in repairing her dressmaking shop should he be credited for the work done with deductions from the monthly allowance? And if he buys clothing for the child without consulting the ex-wife and mother should he receive credit on that? Those were two questions Justice of the Peace Cox was called upon to decide at the preliminary hearing of Joe C. Vollmer, a painter of Orange, charged with non-support of his minor child. Justice Cox declined to allow Vollmer credit for work done on the shop, but did give him credit for buying clothing for the child. He was then required to turn over to Mrs. Vollmer something like $60 due in default payments minus the cost of the clothing. Because the testimony plainly showed that Vollmer had made an effort to pay the regular allotments of $15 per month through the probation officer, but could not because neither the probation officer nor Vollmer himself knew the whereabouts of Mrs. Vollmer, the criminal action charging non-support was dismissed. The work done by Vollmer on his divorced wife's dressmaking shop consisted of tinting the walls., painting the floors and some work on the windows. That, however, was done in the latter part of 1920. He expected her to pay for the job. SEVENTY FATALITIES IN YEAR There were 70 fatal accidents in Orange county during the years of 1920 and '21 according to figures compiled by Coroner Charles D. Brown for the statistical department of the Automobile Club of Southern California. Of the 70 persons killed in accidents in the two years, 38 of these were killed outright or fatally injured in automobile accidents. The other 32 were killed in various other kinds of accidents, including drownings, falls, burns and so forth. Mr. Brown made no report on suicides as he did not figure that such deaths could be classified as accidents. The data was furnished to the automobile club for the purpose of compiling statistics from all counties comprising its membership. STANDARDIZATION LAW UPHELD BY COURT Little Violation of the Law in Orange County Commenting on the decision of the California supreme court in upholding the constitutionality of the fruit and vegetable standardization act, George McPhee, county sealer of weights and measures, said he was gratified to learn the higher courts had taken this action and added that the law was an excellent protective measure for the purchasing public. "In Orange county," said McPhee, "we have found that Japanese dealers and others have a profound respect for the provisions of this act. In the case just passed upon by the supreme court, Frank Fujii, of San Francisco, was accused of selling strawberries in baskets containing less than the dry pint required by law. "His defense was that the law was not uniform in its application, was discriminatory, and was in direct violation of the constitution of the state." "In passing on the case, the state supreme court answered that acts of this character having for their purpose the protection of the purchasing public by the elimination of deception are beneficial in a high degree, and are to be liberally construed." "In Orange county this construction is never questioned, and we find that the law works out very satisfactory. We handle everything by weight and maintain a careful check on strawberry sales and other berry weights. We merchants, in particular, should have a wholesome respect for the law and we have heard few complaints."
