VOLUME LI ENDORSES FIGHT FOR LOWER RATE ON JUICE ASSOCIATED CHAMBERS OF COMMERCE GETS BEHIND CITY ATTORNEYS' ASSOCIATION Recommends That Supervisors Make an Appropriation Toward the Fund—City Attorney Ames Tells of Anaheim's Experience With the State Board Once Upon a Time—Officials of Southern California Edison Co. Complimented, But Their Charges for Juice Denounced. A determined fight will be waged before the state railroad commission on Tuesday, February 27, by the City Attorneys' association of Southern California in its endeavor to secure a reduction of rates from the Southern California Edison company, which supplies juice to a large portion of the cities of the southland. An effort is being made to raise a fund of $25,000 for the purpose of gathering statistics and presenting the matter before the com- "We do not know, however, that the rates are making only fair returns. We want to know the amount. We want to know that its valuations are right. We want to know that it is not paying excessive salaries. We want rate experts and engineers or our own to prepare data that will prove or disprove that the rates charged, are producing only a fair rate of interest on invested capital. "We have information from men who say they know and who are close enough to the situation to have rather definite information, that the Edison rates are too high." Dunn pointed out to an advertisement of the Edison company, assuring 8 1-2 per cent interest to purchasers of its stock. He said he had inside information that the company is making better than 8 3-4 per cent. He did not profess to know whether the high interest rate was possible by reason of the fact that the coompany may be getting some of its funds at a rate less than it is paying consumer-purchasers of stock, or whether the high dividend was being paid entirely from earnings. T. B. Talbert, chairman of the Orange county board of supervisors, was the only member of that organization present. He expressed the belief that the association was taking a step in the right direction. Secretary Prerber of Commerce, hafor tonight at the persons who have fund are requested A determined fight will be waged before the state railroad commission on Tuesday, February 27, by the City Attorneys' association of Southern California in its endeavor to secure a reduction of rates from the Southern California Edison company, while supplies juice to a large portion of the cities of the southland. An effort is being made to raise a fund of $25,000 for the purpose of gathering statistics and presenting the matter before the commissioners. The city trustees at a recent meeting appropriated $300 toward this fund, and other cities in the county have likewise contributed. The Associated Chambers of Commerce at Balboa Friday night unanimously endorsed the movement of the attorneys and recommended an appropriation by the supervisors toward the fund. City Attorney Ames told Anaheim's experience with the railroad commission once upon a time when matter of Edison rates was being considered. He said the trustees of this city had appropriated $300 toward the fund and instructed him to co-operate in every way possible with the association in its fight for better rates. In outlining the plans and purposes of the association of city attorneys with reference to its fund-raising campaign, James Howard, city attorney of Pasadena, said it was "to weld into unity, the powers of the southern California municipalities." The association is endeavoring to raise a fund of $25,000 by appropriations from city councils and boards of supervisors. Howard explained. One fifth of the amounts appropriated is wanted for the Edison rate hearing on February 27. It was disclosed that Senator W. J. Carr has already been employed as leading counsel and W. J. Eberle, of the University of Southern California, as engineer, to aid in the fight at the hearing before the railroad commission in Los Angeles, February 27. If the results of the hearing are such as to warrant further action, the balance of the appropriations will be asked, with engineers rate experts and accountants employed to make an investigation for the assembling of data upon which the association later, may go before the railroad commission with a petition for another hearing in an effort to secure further reduction in the rates of this public utility. Both Howard and John Dunn, city attorney of Monrovia, who also made getting some of its funds at a rate less than it is paying consumer-purchasers of stock, or whether the high dividend was being paid entirely from earnings. He expressed the belief that the association was taking a step in the right direction. He said he could not speak for the board, but felt certain that other members would be agreeable to an appropriation for the fund. Lew H. Wallace, of Newport Beach, offered the motion, pledging support of the chambers to the supervvisors in whatever action they might take in connection with an appropriation to the fund. The legislation committee of the county organization was directed to co-operate with the City Attorney's association and assist the executive committee in matters that might require attention in Orange county in the way of raising finances. Both Howard and John Dunn, city attorney of Monrovia, who also made an address, paid high tribute to the officials of the Edison company. "The officials of the company are working for the stockholders, to return them dividends on their investment, and do not see the side of the consumer or the general public," said Dunn. "They probably are sincere and honest in the presentation of their side of the case when an issue is before the railroad commission, but I am inclined to believe that they are a little biased in their interest to their stockholders." He pointed out that in past hearings city attorneys, in appearing before the commission, have been in the position of attorneys going into a case in court, one side introducing witnesses and the other none. In the case of the public utilities they have their experts as witnesses to present facts on rates, valuation, etc., he continued, while the city attorneys have no such witnesses to offset the statements of utility witnesses or tear their figure or facts to pieces. Lawyers are neither rate experts nor engineers and can not combat or bring out weak points in the statements of utility experts, Dunn pointed out. "If the corporation is making only a fair return on its investment, it is all right and we are willing that it should have such a return," said Dunn. HEYING AGAIN WINS IN POULTRY CONTEST His Birds Out-Laying All Competitors at Pomona Show Ferd Heying, the Westside poultry fancier, was considerably elated over winning the blue ribbon for the best single hen laying record during the month of December at the Pomona egg-laying contest, but the achievements of his birds in December were commonplace compared to what they did in January. For single birds Mr. Heying won both the first and second prizes, one of his hens laying 27 and another 26 eggs during the month. The next highest was a White Leghorn hen, her record being 25 eggs. In addition to this Mr. Heying's pen overtopped all the others, their total production being 174 7-8 eggs. Second place was won by George C. England's White Leghorns, the total for the pen being 173 1-4. Mr. Heying's hens are Rhode Island Reds. They are in competition with Leghorns and Anconas, noted only for their egg laying qualities, but the heavier birds are beating the smaller ones at their own game. The leading pen of Anconas produced only 129 7-8 eggs in January, being 45 below the Heying pen. The strain Mr. Heying breeds now are non-setters, the hens rarely showing signs of brooding and being just as loathe to waste time on the nest as the Leghorns. A ready letter writer is often just as ready a trouble-maker. Sufficient money for the construction of protection work along the river bank east of town, where the breach occurred during the flood some weeks ago, has been subscribed, and immediate steps will be taken to start the work. Secretary Fraser, of the Chamber of Commerce, has called a meeting for tonight at the high school. All persons who have subscribed to the fund are requested to be present and to the document are Homer G. Amess and Joseph W. Diehl. Other nearest of kin include several brothers and sisters, mostly residing in Illinois. BEAUTIFUL RESIDENCE BUILT BY ONE LONE MAN Herman Schindler Has Reached the Painting Job on His Palm Street House Hundreds of houses have been built in Anaheim within the past few years, some of stone, some of brick, some of wood and some of steel and cement, and the style of architecture favored by the builders has been varied. But a residence now slowly nearing completion on South Palm street stands unique among all the others from the fact that it is the handiwork of one man. Herman Schindler is the designer, builder and owner, and no hand but his has laid a brick, sawed a board or driven a nail in it. It is a beautiful six-room cottage, built of brick, with a cement coat on the outside, and its rooms admirable arranged. The site on which it stands was formerly a hole in the ground, having been used as a sand pit by Charles Schindler. Herman filled it up and made a solid table on which to build his house. With his own hands he dug trenches and poured the cement for his foundations, then began laying the brick walls. Secretary Fraser, of the Chamber of Commerce, has called a meeting for tonight at the high school. All persons who have subscribed to the fund are requested to be present and assist in perfecting a plan and forming an organization for the prosecution of the work. Mr. Fraser has sent a letter to each of the subscribers explaining the object of the meeting. At this meeting the Chamber of Commerce will surrender its management of the project and all authority will be turned over to a committee or board elected by the subscribers. A meeting of persons interested in forming the Anaheim-Richfield-Yorba protection district was held at the Richfield school house Friday night. It was decided to put in a double row of diking from the Santa Fe tracks to the Yorba bridge, a distance of 500 feet, with a probability that a 1200 foot stretch above the Yorba church will be protected by a double row of piling. There was much discussion of the matter, and many conflicting opinions, but an agreement was finally reached. A. A. Mills, chairman of the committee in charge of the work, has issued the following statement: In order that the action taken at the Yorba-Richfield-Anaheim flood control meeting last Friday night be clearly understood I desire to state to all interested the following: After a long, earnest discussion of the whole project it was decided by unanimous vote to add to the word previously agreed upon that section lying between the New Golden State bridge and the Santa Fe bridge at Olive. This was done on the recommendation and motion of Mr. LeRoy Lyons, who said the ranchers immediately west of the Santa Fe tracks feared the back water here may run over or break through the railroad grade here and especially damage this particular section as well as flooding all west of them in the proposed district. It was also voted unanimously, excepting one man, to allow $5.00 per acre on the easterly 570 acres, including the land of Mr. Halliday, above the bridge, to be expended above the Yorba bridge and east of board or driven a nail in it. When the walls were finished he laid aside the trowel and tackled the inside with hammer and saw, and in the course of time was able to say finis to that part of the work. Now he is engaged in coating the walls with cement, and within a week or two expects to be putting the finishing touches on the structure with a paint brush. During all the time he has been engaged in building the house he was holding a job at the Adams-Bowers Lumber Co.'s yards, working at the house only at nights and on holidays. Considering only the beauty and convenience of the house, the beholder would declare that Herman should devote his entire time to architecture. Looking at its substantial and well built walls one would think that he ought to be a brick layer, but after giving the wood-work and inside finishings the once over he would be convinced that Herman is a first-class carpenter and should make that his life work. Before many moons it will be finished and Herman will have the satisfaction of knowing that he has one of the most beautiful homes in the city, and that his own hand built it. There is one draw-back to it, however. Should he discover a flaw anywhere he will not be able to cuss the bonehead who made it. It was also voted unanimously, excepting one man, to allow $5.00 per acre on the easterly 570 acres, including the land of Mr. Halliday, above the bridge, to be expended above the Yorba bridge and east of the Yorba church. The dissenting voter stated that he would not be bound by the action of the meeting, but after talking it over with the people interested with him, decided to come in, and has subscribed his full quota, I am told. The addition of these two sections of protection will add to the strength of the whole plan and also add a further feeling of security to those living in these certain sections. You have acreage and resources enough in the proposed district to raise the money with which to do all the work. The outlook is very encouraging. Let us go and get the money. WIDOW INHERITS ESTATE Julia A. Deihl, of Anaheim, represented by Attorneys Ames and McFadden, filed petition with the superior court Thursday for probate of the will of her husband, George E. Diehl, who died February 4 at the age of 62. The estate consists of an interest in a co-partnership with his brother, Joseph W. Diehl, in the Valencia hotel, notes, stocks and bonds of a value of $7500; $562.34 in cash, and an automobile valued at $1500. In the will, dated April 8, 1921, Mrs. Diehl is named executrix and sole heir to the estate. Subscribing witnesses Rotarians of Santa Ana are to gather at the Elks home in Anaheim to celebrate the second birthday of their club. The birthday party is to be held Saturday, February 25. This party is to be a dinner dance and invitations have been sent to all Rotarians to attend. This is the second birthday party which the organization has had and this one is planned to surpass the last one, which was held at the Newport Harbor Yacht club. This party comes during the week when all Rotarians are celebrating the founding of their organization for this week is "Rotary Week," and is given over by Rotarians to the observance of the seventeenth anniversary of the founding of the international organiation. The party to be given at Anaheim is to be a celebration of the birthday of the Santa Ana club rather than an observance of the birthday of the entire Rotary organization. Rotarians from Long Beach are going to be here as guests of honor, for the Long Beach Rotary club is the one which is responsible for the organization of the Santa Ana Rotary club. There is to be music throughout the evening furnished by Grigsby's orchestra of Santa Ana. A few very short speeches will immediately follow the dinner. Since the birthday party comes at the end of the week the international observance of the anniversary is being omitted. Washington's birthday has been selected by Rotarians as a fitting day for the celebration of the seventeenth international anniversary. The entire day is to be filled with a program which will start at 10 o'clock in the morning and end at 12 o'clock at night. SUES TO RECOVER LEASE AND DAMAGES Joseph Raymond Thorpe, who leased oil and gas rights on his twenty acres of land near Seal Beach to L. L. Boas nearly two years ago, not only demands now that the lease be cancelled because drilling operations never extended beyond a depth of sixteen feet, but also claims damages or $1000 for each month that possession of the property has been withheld from him, making a total of $23,000 in all. Furthermore, he insists that a derrick erected upon the premises by the lessees remain there unmolested. These demands were made known ZETTE Number 16 PLACES FOR TWO ACTIONS PRODUCED CALL AND REGLECTION Into Two Precincts for Calling Places at City at Pacific Imple-Ford Garage, Freeway Schools—All City's New Well, Done by Private in a suit on file in the superior court, through Attorney Earl L. Wisdom, of Long Beach. The lease to Boas, executed March 23, 1920, was later assigned by the lawyer to the Long Beach Oil and Gas company, according to Thorpe. He alleges that the company drilled a hole sixteen feet deep, but has made no sincere attempt to find oil and is now, he understands, preparing to remove the derrick. This would cause irreparable damage to the property, Thorpe contends, and he seeks a court order, restoring his property to him, awarding the damages claimed, and requiring the defendant to desist from any plans to disturb the derrick. Besides Boas and the Long Beach Oil and Gas company, Dee Graham, Louis N. Whealton and A. H. Speer are named as defendants in the action, because of some alleged interest they are said to have in the lease. Judge R. Y. Williams denied the claims of the Firestone company, which brought suit for claim and delivery of a tire press sold by it to the Anaheim firm. The court found that the press had been returned to the seller by Noll and Duckworth and had been resold by the plaintiff to another buyer. Payment of the remainder due by Noll and Duckworth had, however, been demanded. The court allowed Noll and Duckworth the costs of suit. In the other action, which involved a demand for $850 on trade acceptance issued by the plaintiff to the defendant, the court awarded the plaintiff $75. PECULIAR CONDUCT Whether innocent or sinister, the puzzling antics of a man and woman in an automobile on the state highway between Anaheim and Santa Ana were at least interesting, it was admitted by the police, whose attention has been called to the operations of the couple in halting other motorists along the highway, late Tuesday. Traveling in a slate-colored car, said to be a Templar or a Hupmobile, the couple would overtake another car, pass and stop about a block ahead or it. The woman would allight and signal the other car to stop. When it did so she would board it and ask permission to ride, naturally meeting with no refusal. After the car she had thus enteren had proceeded a short distance, the slate-colored car would pass it again and stop a short distance ahead. The woman would then ask that the car in which she was riding be stopped and would thereupon join her former companion. The operation was repeated on one car after another, according to the police. DAIRYMEN ELECT OFFICERS Directors of the dairy department of the farm bureau were elected at a meeting held in the farm bureau on roadway stars may draw more money for their performances on the stage than Anaheim actors are able to command, but the presentation of "Purple Flashes" at the Fairyland on Monday and Tuesday evenings convinced the large audiences that they are not worth any more. Fairyland theatre was crowded to full capacity on both evenings, and the prominent citizens, male and female, who sustained the heavy characters, and the fifty or more other prominent persons who supported them in minor characters, were loudly and repeatedly cheered by the discriminating auditors. There were no weak links in the cast. Every part was admirably played, every actor fitting his part to perfection. This entertainment was instigated and staged by the Anaheim Elks, which was an advance guarantee that it would be worth the price. C. J. McNaughton, of New York, was engagen as instructor, and within a short space of time he managed to mold the raw material presented to him into finished actors and actresses. The principal characters were: W. R. Gordon as Jack Temple, the lying husband; C. J. McNaughton as Frank Fuller, his lying friend; Walter Cadman as Captain Sharpe, the English officer; Gov. Louden as Wigson, the English butler; Jack Cole as John Brown, a ladies' hair dresser; Mrs. Agnes Messerschmidt as Mrs. Jack Temple; Mrs. Clem Staples as Mrs. Frank Fuller, and Miss Elise Jessurun as Mrs. John Brown. These were the principal characters, and there was no flaw in the performance of any of them. There were other features besides the play which added to the enjoyment of the auditors. The singing of a number of the city's most accomplished vocalists was a pleasing interlude between the acts, and the Kiddies Fashion Parade was appreciated by all—especially the ladies. Models in the parade were: "The Green Girl," Miss Beatrice Scraper; "The Gold Girl," Miss Helen Stoffel; "The Old Rose Girl," Miss Clara Keister; "The Lavender Girl," Miss Jean Wilke; "The Orange Girl," Miss Doris Eden; "The Flame Girl," Miss Lucile Nenno; "The Blue Girl," Miss Helen Wilke; "The Silver Girl," Miss Estella Hammerstein; "The Bathing Girl," Little Miss Eva Lyn Hartfield; "The Vamp," Little Miss Josephine Shanks; "The Ballet Dancer," Little Miss Marion Stroup; "The Society Girl," Little Miss Harriet Ril DAIRYMEN ELECT OFFICERS Directors of the dairy department of the farm bureau were elected at a meeting held in the farm bureau offices Thursday afternoon. Dr. H. L. Wakeham, of Tustin, was selected as chairman of the board and in this capacity will be a member of the executive board of the farm bureau. Other directors elected were A. H. Moore, Wintersburg; Steve Grise, Greenville; F. D. Plaven, Greenville; Mike Babylon, Santa Ana; P. H. Krick, Anaheim, and J. T. Raitt, Santa Ana. Due to the limited time, practically no business other than election of the directors was accomplished. R. D. Flaherty, secretary-manager of the farm bureau, was elected secretary of the dairy department. It was decided to hold a special meeting, Monday, February 27, at the home of A. H. Moore, at Wintersburg, at which time further business will be handled. Sheriff C. E. Jackson has received word from Sheriff D. B. Newell, of Bakersfield, stating that Hugh C. Tullus was being held there for Orange county. A complaint charging him with passing a bad check for $10 on O. A. Mullinix, Anaheim druggist, was filed February 17, 1921, and he has been sought since then. Sheriff Jackson got track of him only recently, the warrant being forwarded to Bakersfield January 13. USED CAR SALE Today, tomorrow and Saturday, Harry D. Riley, the Studebaker agent, is holding one of the most remarkable sales of used automobiles ever known in this section. Twenty-five thousand dollars worth of cars, including Studebakers, Buicks, Chevrolet's, Overlands, Dodges, Fords and Saxons are being offered at prices hitherto unheard of. Mr. Riley says he has a car for every purpose and a car for every purse. The sale is now on at Studebaker headquarters, 151 South Los Angeles street, and will continue until Saturday night. Here is your opportunity to get a car. We observe that a lot of the follows who are making a big noise about what the dirt farmers are going to do in politics are not dirt farmers themselves and probably never did a day's work in their shirt sleeves.
