WATER COMPANY HOLDS BUSY SESSION PROFILE OF PIPE AT YORBA ADOPTED ON PRESENTATION BY SHERWOOD LENGTHY LIST OF BILLS PASSED UPON, ALLOWED, AND ORDERED PAID Anaheim, Cal., April 4, 1914. Director Sherwood presented a profile of the pipes to be inserted in the fills at Yorba Linda, and it was moved by McFadden, seconded by Hale, and carried, that the A. U. W. Co. help to the extent of furnishing the cement and tools and putting in the bulk-heads. All other work and expenses to be paid for by the parties requesting the work. On motion of Hale, seconded by Wickett, the proposition of J. C. Craft, J. L. Christopher and R. B. Herman to pay one-half the cost of a pipe line from Sycamore street to Mr. Craft's northeast corner was accepted. On motion of Dwyer, seconded by Hale, the president and secretary were authorized to sign a warrant in favor of the Anaheim Sanitarium for the amount of bill for attending Mr. Scott. The report of the Hurley, Smith & Collins Company, for the month of March was received and filed. On motion of Hale, seconded by Wickett, Director Sherwood was instructed to reset the corner stakes for Chas. Schneider. A communication from Edward Simmons in regard to pipe line at Yorba Linda was received and filed. A log of well No. 4 was received and filed. Reavis, vice-president of the California Land and Water Company, and District Attorney Phil D. Swing, of Imperial county, are attending the National Irrigation Conference at Denver, this week, they declare, with a definite plan of action. Swing was appointed by Governor Johnson to represent the Imperial Valley and Reavis as representative from Victor Valley, but they have joined forces and will work together for the benefit of both sections. Following a mass meeting of representatives of thirteen mutual water companies, the Imperial Valley Irrigation District and ranchers of that valley, the two delegates have outlined their demands before the Denver conference. For the first time California is to ask for her share of reclamation money, having so far received only $616,000 out of a total of $100,000,000 spent in the great West. In substance these demands are: First—Prior right protection to water from the Colorado River as against any other system of irrigation or reclamation that might lessen the resources of that river. Second—the building, with Government funds, of vast storage systems on the upper Colorado, that would be preventive of any unexpected failure of that river at any "off" season. HEAVY CLAIMS AGAINST OIL MAGNATE OTIS BIRCH, OWNER OF THE BREA GUSHER, SUED FOR $1,157,400 FORMER STOCKHOLDERS IN THE MENGES OIL COMPANY ALLEGE FRAUD A. Otis Birch, owner of the famous million-barrel-a-year well at Brea, has been made defendant in nine suits in which judgment, aggregating $1,157,-400, is asked. The plaintiffs declare that Birch defrauded them of their stock in the Menges Oil Company by representing that assessments were to be made, that the outcome of the development of their property was uncertain and problematical and by inducing them to transfer their stock. They declare that as a matter of fact Birch knew the property was a great well and concealed that information from them in order to get their stock. The story told in the complaints has frequently been hinted at by those concerned, but it was believed that those who had been interested with Birch in the twenty acres at Brea, upon which the well was brought in, had swallowed their chagrin and would do nothing. Attorneys for the plaintiffs state, however, that recent developments brought the mutterings together into the thunderclap that came last Saturday. The big well has made Birch between $3,000,000 and $4,000,000 and has made him prominent as a banker and business man. Recently he has given sums of money to projects in connection with the Temple Baptist church in Los Angeles. The Menges Oil Company was organized by Santa Ana and Orange men several years ago. Birch and his nieces, heirs of Q. R. Smith, held a majority of the stock. The complaints set forth the fact that Birch was president and general manager of the company, and M. M. Good, superintendent, named as a defendant, was employed by him. In February, 1911, Birch announced to the minority stockholders that he planned to have the company buy oil land at Bakersfield, and he proposed to assess the stock. He then suggested that the stock be sold to a Bakersfield man, who was going in with him on the Bakersfield project. At that time the company had four wells down, producing 400 barrels a day. Well No. 5 was down 4,000 feet, and Birch said it was uncertain as to what it would do. The minority stockholders were offered $2 a share, 90,000 shares altogether being out. The stockholders allege that they were acquainted with Birch in social, religious and fraternal circles, had faith and confidence in him, and believed him. They were persuaded to put their stock in escrow and were paid $2 a share for it. Before doing so they visited the property, and say that Birch and Good secreted from them all information concerning the actual condition of the well. The complaint says that in truth there was no Bakersfield man in the deal, that Birch had the stock transferred to himself, and that immediately after "said false and fraudulent representations and acts for the grossly unfair and inadequate consideration of $2 a share, the defendants brought in and opened well No. 5 for production, and for the first time disclosed the fact of the great value of the well." It is stated that immediately the well began producing 2,600 barrels of oil a day and $500 worth of gas, making a total production of $3,750 a day. It is alleged that Birch then caused the Menges Oil Company to be dissolved so that the minority stockholders could not recover their stock, and that he then formed the Birch Oil Company, which holds the valuable Brea Canyon property as a co-partnership of Birch and his relatives. The plaintiffs declared that when they sold their stock by misrepresentation for $2 a share it was worth $50 a share, and they sue Birch for the difference. B. Goetz, son of H. X. Goetz, police commissioner at Santa Monica, and E. C. Young, of Placentia, started down the stairs of a rooming house in Los Angeles a few mornings ago, with the intention of going to the police station to report their clothing stolen while they slept. The landlord gasped in amazement and then barred their progress. "Where are your clothes?" he said. "They were stolen while we were asleep," said the pair in chorus. "Lend us something to wear until we can get an outfit." The landlord said that he would be unable to do so. "Then we go to the station like we are," they replied. The rooming house proprietor quickly found an assortment of cast-off wearing apparel and the young men made their way to central station. Each man lost a suit of clothes and a small sum of money. The room was entered by means of a pass key, but the officers were unable to find any claw as to the identity of the thieves. GOVERNMENT SUES ESPEE Setting forth three counts in a complaint charging that the Southern Pacific railroad has repeatedly refused to comply with the Interstate Commerce Commission's demand to inspect its files and records, the Government has instituted suit in the United States district court, San Francisco, demanding $115,500 penalties. All the alleged refusals were made in July, 1913. The Southern Pacific, in reply to the charges makes the following statement: "The these refusals were made on behalf of the Southern Pacific Company upon the ground that the commission had never been authorized to make a general, wholesale examination of all the records and correspondence which might be contained in the offices of the company, especially between the officers of the company. It has been further contended by the company that the commission was only authorized by previous act to inspect files relating to memoranda by the carriers which were required to be kept by the carriers under the Interstate Commerce Act.
