RATE FOR GAS AND WATER FIXED BY COMMISSION CITY OF ORANGE GRANTED A LOWER SCHEDULE THAN THAT HITHERTO IN EFFECT EFFORT OF WATTS IRRIGATING COMPANY TO RAISE RATES GETS A TURNDOWN The Railroad Commission has rendered a decision fixing the gas rate for the Southern Counties Gas Company, in the City of Orange at $1.22 per thousand cubic feet. The City of Orange recently fixed the rate for gas within its limits at $1.15 per thousand cubic feet. Thereupon the Southern Counties Gas Company, which is serving Orange, applied to the courts against the rate. While the suit was pending, the City of Orange transferred the control over its utilities to the Railroad Commission. Immediately thereafter the Southern Counties Gas Company brought an action against the City of Orange, protesting against the rate of $1.15. The commission now fixes the rate at $1.22 per thousand cubic feet. It found that the rate of $1.15 was unreasonably low, in view of all the circumstances involved. The Railroad Commission has rendered a decision fixing the rates to be charged for water by the Conservative said in this regard: "'Before leaving this subject, however, I think it well to say that contracts entered into in good faith between public utilities and their patrons that are not forced or compelled in any way, and are based upon adequate consideration should be adopted so far as is consistent with adequate regulation as the basis for the rates for the service performed by a public utility for its patrons.'" "The commission is being flooded with applications on the part of the land and water companies to repudiate the contracts entered into by such companies with their consumers when it is found that the contracts do not operate advantageously to the utility. But we have cases before us where the utilities just as strenuously urge that such contracts be kept in effect when it happens that they are favorable to the utility. "With this attitude on the part of the utility I have very little patience, and I would have no more patience with the attitude of the consumers when they voluntarily and freely enter into contracts if such consumers should seek to get rid of them, and it is only when the public interest demands it or the contracts are manifestly unfair that I think this commission should exercise its authority to substitute some other rate for the rate set up in such contracts. The man of ordinary business honestly tries to carry out his contracts, even when he finds that they are disadvantageous to him just as he expects those contracting with him to recognize their own obligations. "Nothing has been brought to my attention in this case which leads me to believe that either of the two conditions set out above which will be held...' In reaching its conclusion the commission has this to say of the methods of water companies which endeavor to escape the obligations they assume: "We have already expressed our opinion with reference to the effect of contracts made by a public utility with its patrons in Application No. 118, and while there is no doubt that as against the commission's power to fix rates the contracts involved in this case would have no effect, yet such contracts when voluntarily entered into may be taken by the commission as the measure of the rate to be fixed, and as an admission on the part of the company that such rate is fair to take. "Let everybody get busy before the flies increase and swarm in millions upon us in the summer months," he urges. The fly, he says, is more deadly than the snake. "It is a pernicious disease carrier. It is the enemy of man and man should be a natural and persistent enemy of the pest. "The best way to get rid of the fly pest," says Professor Edwards, who is head of the nature study work in the Los Angeles schools and professor at the U. S. C. Medical School, "is by the fly trap. Fly paper is only a second-class palliative. Other remedies are only temporary. To 'swat' the fly is not the ideal way because flies are scattered all over the house. "By getting a fly trap, or making one—for they can be made at home—the pest can be caught by the thousands with no outside work, as 'swatting' requires. "Children in the Los Angeles schools should exercise its authority to substitute some other rate for the rate set up in such contracts. "Nothing has been brought to my attention in this case which leads me to believe that either of the two conditions set out above which will be held by this commission as justification for substituting a new rate for a rate set out in a contract exists with reference to the applicant, and I recommend that the applicant be required to furnish water to its consumers under the jurisdiction of this commission at 15 cents per thousand gallons, if the service be metered, with a minimum charge of $1.00 per month per consumer. In prescribing this rate I have adopted the highest minimum charge set out in the contract and the charge agreed upon per thousand gallons if the water is metered." Judgment has been given in favor of the Micheline Tire Co. against the Anaheim Motor Co. for $675.90. Halt Freight Rate Advance The Interstate Commerce Commission today suspended until September 18 the proposed Southern Pacific advance in rates on carload lots of oranges from 50 cents to $1.30 per ton from Folsom to Brighton, Calif. The present rates to be used in a combination of other rates from Brighton to make through rates to interstate points. Back Stamping of Letters Will Cease As an emergency measure to relieve conditions in first and second class postoffices where the service has been demoralized by the application of the eight-hour law among clerks and letter carriers, Postmaster General Burleson has directed that until further notice the back stamping of letters will be discontinued except on registered and special delivery mail. This is the most important step that has yet been taken by Mr. Burleson to remedy confusion and congestion in the mail service. Dinero in County Treasury There is more money in the county treasury at present than ever before in the history of the county: County Auditor Lester, District Attorney West and Chairman of the Board of Supervisors Talbert counted the money in the county treasury this week and found the sum of $1,086,675.18 as per the monthly statement filed with County Clerk Williams. The statement also shows that the amount that ought to be in the county treasury on the 14th day to be $1,089,121.10. The sum of $1, that arrangements will be made to carry on the work of the association at once. The fire was discovered about 10 o'clock in the evening, and it is believed that it was started by a tramp who was sleeping under the shed at the end of the building. The flames spread rapidly, and as no fire apparatus was available at once nothing could be done to check their progress. All the books of the association were saved, but the machinery and contents were lost. There was but $4,000 insurance on the building and contents. A large number of people in this city saw the conflagration and went to the scene of the fire, but could render no assistance as the building was totally gone. Covina After Experiment Station President N. D. Mussey of the Covina Valley Farmers' Club has just returned from a trip to Berkeley, where he interviewed Dean Hunt of the University of California, concerning the location of the citrus experiment station which Orange county will seek to locate here. Covina is very anxious to present to the state authorities the desirability of this valley as a place of location. Dean Hunt informed Mr. Mussey that the matter of location would be placed in the hands of a committee appointed by the board of regents of the college, and that this committee would consider all applications as made by the various communities desiring the experiment station. This committee would then make a tour of investigation and inspection. President Mussey and other prominent ranchers at Covina believe that the Covina valley should make a concerted effort to get this station. The Farmers' Club will probably call a mass meeting during the coming week, in which the members of the Covina Sam, John Bull and Britannia, garbed in regulation costume, will ride on gaily decorated floats, followed by a real, live British lion, in a float and cage of his own. It is expected that 25,000 Britishers, coming from every city in the southern part of the state, will view this pageant, for which numerous other beautiful features are being arranged. Following the parade there will be a gathering in the Long Beach auditorium where addresses will be delivered and old English, Scotch and Irish airs will be sung and played. Then come the sports, athletic and aquatic, for which numerous handsome prizes will be awarded. Many events have been arranged for men, women and children. A feature of the program will be the married women's race and another will be a family relay race. Special cars will be run on all electric lines to handle the crowds and special rates will be in effect. C. R. Hannah was in town this week from his ranch on the Santa Ana road, where he is disposing of 500,000 pepper plants, selling them in any quantity. Mrs. T. H. The sum of $1,047,308.69 is county money and the sum of $41,822.41 is trust fund money. Must Pay Funeral Bills Justice Cox this week gave judgment in favor of Mills & Winbigler against F. M. Gilbert for $80 and costs. The plaintiffs sued Gilbert and his son, W. W. Gilbert, for the funeral expenses of the late George W. Fusen, for which, the evidence showed, they had assumed responsibility. W. W. Gilbert allowed judgment to go against him by default. Fusen, who was a county charge at the time of his death, had deeded to young Gilbert a house and lot on condition that he look after Fusen until his death and see that he had decent burial. F. M. Gilbert was made a party by reason of the fact that he went to the undertaking establishment and apparently assumed responsibility with his son in the matter. Strengthening Pacific Defenses Uncle Sam purposes to strengthen his defenses on the Pacific. This is borne out by the fact that the first movement of troops to the coast from the east began Monday morning. Two hundred and fifty artillerymen from Fort Slocum started on a special train from Jersey City at 11:05 o'clock for San Francisco, where they will be transferred to Honolulu. The troops consist of the Fourth artillery corps. The orders for the movement were received at Fort Slocum from the war department several days ago and there have been lively times at the fort since then getting ready for the departures. All the artillerymen go fully equipped. The orders for special transportation for the troops, according to the railroad officials, are "sudden and unexpected." Five shares of water stock of the Anaheim Union Water Company go with the land. In this county no great amount of land is owned by Japanese. In the lowlands the Japanese have many farms under lease for growing celery. Several ranches at El Modena are under lease for strawberry growing. Packing House at Fulletron Destroyed A large packing house at Fullerton, just east of Benchley's packing house, was totally destroyed by fire Thursday night, involving a loss of between $18,000 and $20,000. The packing house was one of the largest in that section, and its destruction at this time will prove a serious matter with growers, although it is understood Each year 45,000 little babies under 2 years of age die of summer complaint. The house fly is chiefly responsible for the spread of these and other diseases like consumption, pneumonia, spinal meningitis and those caused by many parasites."
