FIGURES OF THE CENSUS Healthy Growth, and Foreign Immigrants Decreasing It is the opinion of the superintendent of the census that outside of the Philippines, the population under the American flag is about 91,000,000. That is less by some 2,000,000 than has been generally supposed, yet it is a very healthy growth and leaves no apprehension that this country is going backward in the matter of population, like some of the European nations. But what will prove even more surprising than the fact that the population is smaller than was at first supposed, is the fact that the immigration for the past decade has only amounted to about 5,500,000 net. In the past the return immigration was very small, but those who are coming to this country now, are not coming to make it their homes but to make some money to take back with them to their birth place, where the accumulations of their American labor will place them among the rich or well-to-do classes. There is nothing extraordinary in Europe in an immigration of that character, because for centuries the Italians, for instance, have been crossing the Alps and working for the summer months in France or Germany and then returning home later. So great was this travel in the past that a special order of monks was founded—that of Saint Bernard—for the purpose of helping and succoring those who tramped over the snow-covered passes in the mountains. Now, of course, the traveling is largely done by train. But America was a long way off, and those who came here came to stay. Now, however, there are numerous lines of ships sailing between the United States and southern Europe. TRACK CLEAR FOR EXPOSITION Fifty Million Dollar Show Will Be Made Certain San Francisco's claim to the award of Panama Pacific Exposition honors goes forward to Washington with the promise of being recognized. Seventeen and a half millions of dollars, the financial backing of the state, the moral backing of the solid west and the encouragement of the greater part of the nation. It is a proud showing of force. No other phase of the claim compares with the natural suitability of the site for the exposition—the climate, the health-giving atmosphere, the bigness, generosity, courage and resourcefulness of the people. To such people the matter of finance is a small one in the final consideration, for with these other qualities and a soil and sun like California's, money is easily made. There is, too, in the situation, a definiteness and character which other claimants for the exposition lack. The West is an instinct. It will draw men to it. California is a magic name and the Pacific has an attraction not to be defined. The Portola Festival last October, a minor celebration, demonstrated the fact that San Francisco can not only draw the crowds but entertain them. They simple compete with our American labor in the heavy work of building railroads, aqueducts, etc. Their competition with home labor, however, is not great, since they do a class of work that few Americans care to follow. The increase then from immigration not being large, it follows that most of the increase in population during the last decade, an increase of 25,000,000, is due to births among the American population, or those who have made their homes here. Deducing the net immigration from the total increase and it appears that the population of the United States has increased from births 20,000,000 in 10 years, which is over 25 per cent for the decade. No other nation can show anything like such an increase, especially no nation of the size of ours. It shows that either Roosevelt's advice about race suicide was not needed or else it was heeded. In either case the nation is to be congratulated. SHORELINE BOULEVARD Movement to Build Paved Highway Along Coast The movement among residents of the beach resorts along the Orange county coast for an ocean boulevard from Bay City to Laguna Beach is gradually assuming definite shape. The people of San Francisco are natural hosts with the open-heartedness of the west and the capacity for enjoyment which comes to those who accomplish big things in the world. Five transcontinental railways converge to San Francisco bay, and the steamers from all over the world find shelter there. It is the gateway of the Orient—the mystic door to the Far East—the ultimate west. There could be no failure of an exposition held at San Francisco, for California is a land of pioneers, flushed with the victory of accomplishment and eager to accomplish. That they are in earnest and determined to secure the prize is demonstrated in the fact that San Francisco business men subscribed over four million dollars in two hours and a half, and have nearly doubled that sum to date. The special session of the legislature will further prove the sincerity of California. San Francisco promises to give a fifty million dollar show and the greatest in the history of the world. That this promise will be fulfilled if the opportunity is secured is a matter which not even the opponents of San Francisco's claim can doubt. There has never been a failure in the west. There should be a true unity of action in proceeding for the prize, and every Californian, every Westerner, should do all in his power to prove that the loyalty and patriotism of which they boast is a living fact. There are many ways in which all may help. The special session of the legislature is the first step to the goal, and it is here that every man who votes may help by writing or wiring to his senator and assemblyman, asking him to be at Sacramento and to vote for the charter amendment. Those who believe that San Francisco has the most valid claim for the exposition should do all in their power to secure it. Those who have friends who have influence at Washington or who have influence with congressmen should use it. Manager T. F. Doyle of the Laguna Beach hotel has the assurance of Jas. Irvine of the San Joaquin ranch that a right of way from Laguna to Corona Del Mar will be forthcoming at the proper time. This is considered as the first victory for those favoring the boulevard and they have been encouraged by the promise of Mr. Irvine. Such a thoroughfare would make one of the finest scenic drives in Southern California and do much to stimulate travel and interest in the resorts along the Orange county coast. If this is accomplished it will be but a step to Capistrano and in time will bring about the construction of a road to Capistrano, which would mean an ocean road from Bay City to San Diego. The subject of the ocean boulevard will be one of the principal topics for discussion at the meeting of the associated chambers of commerce to be held at Laguna Beach. The associated chambers is composed of the chambers of commerce and improvement associations in Orange county and meets once a month to consider improvement matters of importance to the entire county. MONEY FOR SCHOOLS County Superintendent Mitchell Informs Supervisors of Amount Needed County Superintendent of Schools R. P. Mitchell has sent a communication to the board of supervisors informing the board that a minimum amount of money to be raised for conducting the county schools for the next year shall be $53,725. The superintendent expects to ask the tax levy to be sufficient to raise $65,000, which is $3000 more than was raised last year. Special taxes are asked by a number of school districts for raising money to repaint and repair school buildings. Newport Beach asks for $800 with which to maintain a school at Balboa, and Huntington Beach wants $9000 for a new schoolhouse. The high school districts ask the following sums: Anaheim Union $14,000, Fullerton Union $25,000, Huntington Beach Union $10,000, Orange Union $11,000, Santa Ana $18,000. These sums are for running expenses, except in the cases of Anaheim and Fullerton. Anaheim is to pay for a basement, in which a manual training department is to be conducted, and Fullerton is to pay for a new building to be used for art, manual training and domestic science. Park of Palo Alto has favored us with a communication bearing upon woman suffrage and dealing with the inequalities of the law in this State with reference to the gentler sex. Mrs. Park states her case strongly, and we gladly yield to her request that her letter be published in our columns. One of the most unjust and unreasonable laws that California imposes upon women, says Mrs. Park, is the one making fathers sole guardians or custodians of minor children. The care, custody, education, control and services of minor children belong legally to the father alone if parents live together. A legitimate child has but one parent, a father. Illegitimate children are under the control of the mother. A man can no longer will away his unborn child in any state. A child's inheritance of money has been provided for, and the courts appoint a property guardian. This must not be confused with general guardianship. The father is sole custodian. Court decisions are often reported where young children have been given by the court to the mother. This does not prove that the mother had any legal share in the custody of her children prior to the decision. It proves that when a family is torn to pieces, the judge awards the pieces. Besides the direct results upon the mother and child, of the sole guardianship law, there is an indirect result that is wholly wicked. It is the threat a bad husband may hold over his wife, that he will do so and so to the child, unless the wife submits to his will absolutely. He has the law on his side. She has no redress the husband controls it just as long as he may live. The only restrictions placed upon the husband are that he shall not give such property away, and cannot will it all away. He can will away half of it. But the wife cannot will away the other half. "Fur frummit." The half he cannot will away, she can have if she outlives him. If she dies first, she loses the shadow of title she had alive. While he lives, she cannot control a dollar of so-called community property, even though it is a dollar she earned. If she dies first, she cannot will any part of so-called community property to anybody. Her death removes all restrictions, and gives it all to him absolutely. (Recommendation: When speaking of community property, use the name "so-called community property." It is a matter of common knowledge that the wife is required to sign deeds when the husband sells property. Many people wrongly believe that this signature is necessary, and that it implies a degree of control by the wife, even a half interest in the property. These conclusions are false. If she did not sign the deed, there would be a possibility of a suit over the title, in order to prove that the property was sold for a valuable consideration, the only conveyance the husband is forbidden to make. To prevent a possible suit with cost and delay, the lawyer and buyer require the wife's signature. But the action is only a precaution. Wives have tried in vain to recover a share in so-called community property sold without their knowledge. These are facts, even though people often refuse to believe them. The husband is bound to support his wife. A wife is bound to support her husband when he cannot support himself. Her separate property is li- relating to crimes by women, or against women. The women of California may vote after both branches of the legislature have given a two-thirds vote in favor of an amendment, without signature of governor, and after the men of California have given a majority vote in favor of votes for women. Women who are suffering injustice in their homes or in the courts are seldom able to take a public stand against present laws. Women whose husbands are better than the laws, and women who are not in subjection, are free to take an active part in the movement for equality and freedom. An unmarried woman has the same right that a man has, married or unmarried, of relinquishing citizenship in the country of her birth, or of her one legal parent, and enrolling as a citizen in the country of her choice. If a man lost his name by marriage, he would be able to see his loss. Precedent has blinded both men and women on this point. The growing custom of using a name like "Mrs. Mary Brown" rather than "Mrs. John Brown" is significant of an awakening of identity. A wife may hold separate property. All that she had before marriage (provided care is taken to separate it in the beginning and to keep it separate) all that she may receive as gift or inheritance, is separate property. This may be kept in her name alone, and is wholly under her control. A husband may hold separate property under similar conditions. A homestead may be declared by either husband or wife, its value being limited to $5000. The furniture of the home, and the clothing of the wife and children are community property, but may not be sold without consent of the wife. Joint property is that owned in partnership. All earnings of husband and wife are community property. If this were really held in common, it would belong to both partners. But community property is under control of the husband alone. Calling it community or common, is small comfort, since Women are eligible to school office throughout the state. Half the county superintendents of schools are women. Women serve as school trustees. Women occasionally fill high educational positions, but usually the high-salaried places are given to men who are promoted over the heads of experienced and able women. Women are lawyers, doctors, and ministers in churches of all denominations except three. No law prevents their serving as jurors. In 1900 the first woman physician was appointed to care for women in one of the state hospitals for the insane, though hundreds of the patients have always been women. Women do not receive equal pay for equal work either as teachers or in other positions. Women receive less pay for identical or better work. Women are taxpayers. Taxation without representation is tyranny now as it was in 1776. "The age of consent" is sixteen years. A girl cannot legally sell any property at sixteen, but she can consent to the loss of her virtue. Girls are often stolen or seduced, but convictions are extremely rare. The codes protect clams and lobsters and fish and birds, but they fail to protect girls sufficiently, or to punish those who trade in girls as sex slaves. The maximum penalty for stealing a pig is five years, the same as that for stealing a girl. For stealing a mule or a calf, the penalty is ten years. Women offenders against any law are arrested by men, imprisoned with men (police matrons are not found in all jails), tried in a court by men lawyers, jurors, and judge, according to man-made laws. Half the jurors should be women, as least in cases.
