STATE PURE FOOD LAWS Drastic Provisions of New Statutes Going Into Effect the First of the Year. The pure food law which goes into effect January 1st, provides for a state laboratory, and Prof. Jaffa of the State University has already been appointed director and chief analyst of foods and drugs. It is the duty of the district attorney of every county to prosecute violations of the law, and every sheriff and health officer is made an agent of the state board of health to detect violations of the law and assist in its enforcement. The state pure food and drug law being identical with the national law of June 30, 1906, obviates the confusion and misunderstanding that would follow were they not identical. The manufacturers and dealers may readily familiarize themselves with what is required by the state law by studying the national pure food regulations already in circulation and disrributed. Recently, by instructions of the district attorney, the following regulations governing the manufacture of food were issued, which are identical with national pure food regulations: The use of any dye, harmless or otherwise, to color or stain a food in a manner whereby damage or inferiority is concealed, is specifically prohibited by this act. The use in food for any purpose of any mineral dye or any coal tar dye, except those coal tar dyes mentioned in the act, will be grounds for prosecution. The use of mineral dye or any coal tar dye in coloring macaroni, vermilion make it genuinely a "mixture," be labeled as "Compound of," "Compound with, pure grain or late." Imitation liquors, within the meaning of this act, must be labeled as such. If any substance (allowed by this statute) is mixed with coffee, tea or any other product it must be so stated so as not to deform the purchaser. As for instance, case of a cereal preparation sold used as a substitute for coffee, it cannot be termed "cereal coffee," and held that, since the product mentions it not a coffee, it cannot be produced called coffee, or if cereals are mixed with the coffee it cannot be treated as "coffee," or "cereal coffee," but each product must be designated "Imitated Coffee," etc. The term "food" as used in this statute shall include all articles used for drink, liquor, confectionery or cement by man or other animals, while simple, mixed or compound. Food shall be deemed adulterated its manufacture, within the meaning of this act, in any of the following cases: (1.) If any substance has been mixed or packed or mixed and packed in the food so as to reduce or lower its juriously affect its quality, put strength or food value. (2.) If any substance has been substituted wholly or in part for the article of food. (3.) If any essential or any valuable constituent or ingredient of the article of food has been wholly or in part distracted. (4.) If it be mixed colored, powder coated or stained in any manner when damage or inferiority is concerned. (5.) If it contain any added poison or other added deleterious ingredient. (6.) If it consists in whole or in a filthy, decomposed or putrid mal or vegetable substance, or portion of an animal or vegetable product for food, whether manufactured or not. The use of any dye, harmless or otherwise, to color or stain a food in a manner whereby damage or inferiority is concealed, is specifically prohibited by this act. The use in food for any purpose of any mineral dye or any coal tar dye, except those coal tar dyes mentioned in the act, will be grounds for prosecution. The use of mineral dye or any coal tar dye in coloring macaroni, vermicelli, spaghetti and other cuts of paste, is prohibited; under regulation 21, section 8, paragraphs "e" and "f:" "A color or flavor cannot be employed to imitate any natural product or any other product of recognized name and quality. "The term 'imitation' applies to any mixture or compound which is a counterfeit or fraudulent simultaion of any article of food or drug." The use of paraffine in food products is forbidden. Mineral substances of all kinds are specially forbidden in confectionery, whether they be poisonous or not. Only harmless colors or flavors shall be added to confectionery. Artificial colors (that are allowed) should be stated or declared whenever present in flavoring extracts or confectionery. Articles of food in the preparation of which such substitutes are employed should not be labeled as if they were prepared from standard flavors or from the fruits themselves. For instance, a preparation intended to imitate vanilla extract should be designated by its true name, as "Imitation Vanilla Extract," or "Imitation Vanilla Flavor," and ice cream flavored with imitation strawberry flavor should not be designated as "Strawberry Ice Cream," but as "Imitation Strawberry Flavored Ice Cream," etc. A food product must not, under the law, be mixed with any other substance for the purpose of concealing damage or inferiority. A vegetable which is not naturally sweet cannot be sold as one which is naturally sweet by mixing with sugar or sucrose without violating the law, unless the addition of sugar is plainly indicated on the label; however, in cases where no deception is intended or practiced, the mention of the presence of a sugar substance is not required. for the purpose of concealing damage or inferiority. A vegetable which is not naturally sweet cannot be sold as one which is naturally sweet by mixing with sugar or sucrose without violating the law, unless the addition of sugar is plainly indicated on the label; however, in cases where no deception is intended or practiced, the mention of the presence of a sugar substance is not required. All chemical dyes and preservative substances, such as boracic acid and borax, salicylic acid and its salts, sulphurous acid and its salts, and formaldehyde, are prohibited under the law in food and food products, on the ground that they are poisonous and deleterious to health, provided that soda benzoate in limited quantities, or benzoic acid equivalent thereto, not exceeding one-tenth of 1 per cent may be used in preservatives for the present. The term "blend" or mixed" as applied to articles of liquor in the pure food law means the blending or mixing of liquors with like substances, but they must be actually identical; that is to say, whisky with whisky and wine with wine, etc., "so as not to injuriously reduce or injuriously lower, or injuriously affect its quality, purity or strength." And such blending or mixing should be so stated and declared upon the label, as for instance, straight whisky will be labeled as such—a mixture of two or more straight wines will be labeled "Blended Wine," or Blended Wines," etc. A mixture of straight whisky and ethyl alcohol, provided there is a sufficient amount of straight whisky to ment, design or device regarding an article, or the ingredients or substances contained therein, which shall be or misleading in any particular, and any food product which is falsely branded as to the county, city town, state, territory, District of lumbia or foreign country in which it is manufactured or produced. Food and liquor may be deemed branded or mislabeled within the meaning of this act in any of the following cases: First. If it be an imitation of or fered for sale under the distinct name of another article of food. Second. If it be labeled or colored so as to deceive or mislead the purchaser, it be falsely labeled in any respect if it purport to be a foreign product tend to mislead the purchaser, or port to be a foreign product when so, or if the contents of the package as originally put up shall have been removed in whole or in part and contents shall have been placed in package. Third. If in package form and tents are stated in terms of weight measure, they are not plainly and directly stated on the outside of package. Fourth. If the package contains it or its label shall bear any statement design or device regarding the ingredients or the substance contained therein, which statement, design or shall be false or misleading in any ticular. Fifth. When any package bears name of the manufacturers, jobber sellers, or the grade or class of mininely a "mixture," will be "Compound of," or with, pure grain distilled liquors, within the mean-must be labeled as such.STANCE (allowed by this act) coffee, tea or any spice, treated so as not to deceive. The possession of any adulterated, mislabeled or misbranded article of food or liquor by any manufacturer, producer, jobber, packer or dealer in food, or broker, commission merchant, agent, employee or servant of any such manufacturer, producer, jobber, packer or dealer, shall be prima facie evidence of the violation of this act. Scientific Agriculture Washington, Nov. 17.—The general education board, custodian of the 43,-000,000 Rockefeller foundation, will open in Washington in January an executive office for the direction of its work in promoting scientific agriculture in the south. It will continue to cooperate with the department of agriculture, supplying money in the states where the government has no appropriation for the boll weevil fight and will extend the system of demonstration farming through Virginia, Alabama, Mississippi, Georgia and North and South Carolina within the next year. The general education board's appropriation for this work for 1908 is $39,000. The Rockefeller plan of helping them who help themselves will be applied progressively to the movement to aid the southern farmer. Conclusions reached by Mr. Rockefeller's committee, which investigated especially the needs of the South's educational system, now have had two years of practical demonstration and astonishing results have been accomplished. In two years 1363 demonstration farms have been established in Mississippi, Alabama and Virginia by the general educational board.
