TAXES FOR THE HIGH SCHOOL Loara District to Bear Part of Burden for Its Support—Has Not Done So Since Separation The fact that the school tax in Loara district was 20 cents last year, while in the Anaheim school district it amounted to $1.10 has at various times suggested to the school trustees of this district that the work of the equalizer had been overlooked in apportioning this burden between these districts. Wm. Schwenckert of the Anaheim school board took the matter up with County School Superintendent Carpenter, and found that since the separation of Loara district from the Anaheim school district several years ago the former had paid no taxes in support of the high school. This ruling, it seems, was made by former County School Superintendent Nichols, but an opinion from Attorney-General Webb was received this week which sets aside that ruling, and as a result property in the Loara district is being assessed for support of the high school this year. The high school district was formed a number of years ago, its boundaries being the same as those of the Anaheim school district. At that time the Loara district was a part of Anaheim school district, but later on separated and erected itself into a district by itself. Since that time it has borne no part of the burdens of maintaining the high school, although its students have had free access to the school, as have also students from other outlying districts, the Loara district is superseded by the rights and all the obliquities of the Anaheim school district though they have had the seem to have had none of these in the shape of school tax is it now a union high school or should it be organized into this time it has been conceived as the Anaheim school and has been governed by trustees; ought Loara schools share in the government of the helm high school district? Mr. Schwenckert while taking the state and county assessment this year was forcibly struck by the disproportion of taxes in the two school districts, and called it to the attention of County Superintendent Carpenter. The subject was referred to State Superintendent Hyatt, who asked the opinion of Attorney-General Webb. The same is hereto appended. It holds that Loara is an integral part of this high school district, and must therefore bear its proportion of the expense of maintaining it. The question of collecting back taxes due the district has been discussed by local residents, but no conclusion arrived at. County Superintendent Carpenter will call a joint meeting of the boards of trustees of Anaheim and Loara school districts during the first week in June, when they will organize as trustees of the union high school district. The letter of Attorney-General Webb is as follows: SAN FRANCISCO, May 18, 1907. Edward Hyatt, Esq., Superintendent of Public Instruction, Sacramento, California. Dear Sir:—Your favor of May 3, 1907, received. Therein you state: The question is this: When a school district composing a high school district be divided into two or more school districts what is the result upon the organization of the high school district? The law recognizes a district high school composed of one school district, and organized as such by a vote of the people thereof. It is controlled by the trustees of the board. It would have been wise legislature had made explifications in regard to the division school district composing a high school district into two school districts has left it to our ingenuity in making the intention of the legal such a matter. I still agree former opinion that the division school district which composes a high school district makes of the school district a union high district. As far as the government union high school district that is concerned, subdivision 8 provides amply therefor. It part as follows: "The trustees serving on the school boards, composed of two school districts at the time approval of this section amended, shall hold until their sors are elected and shall quare the provisions hereof; in the case of new union or joint union district, the representative according to the provisions of subdivision sixth of the union high school board unction or appointment and quare of the regular board as here-ed. Subdivision 9 of Section 246 vides: "The union or joint union school board shall meet at the superintendent of schools shall organize by electing a member from their own number, and serve until the second Saturday next succeeding their election thereafter the board shall organize in the same manner on Saturday of July of each year." It would follow that the Loara district has a right to a sheriff government of the union high and the high school district governed by the joint boards trustees of the Loara and two school districts. If not, what is the legal status of a district high school district so divided?" You also enclose communication from W. R. Carpenter, superintendent of schools of Orange county, relating to the same matter, in which he says: "There is still another point which is troubling the board of trustees of the Anaheim school district. I call your attention to the fact that before we vote on the proposition to bond the county, we will know exactly what roads are to be built, and that no commission, however selfish, will dare submit a scheme which will neglect one section to the advantage of another; the very fact that a bonding scheme must have a two-thirds majority makes it absolutely imperative that practically all sections must be given respectful consideration. No doubt we will all have to be satisfied with something less than we desire, for no law can operate with equal justice to all, (when considered in its narrow sense.) Personally, as a farmer and producer I would vote to macadamize every heavily traveled road in the county, if it were legal to issue the necessary bonds, but I realize that it cannot be done, and am willing to take one mile or one hundred as I can get them. I think that under the limitations which we must work that it would be well to cut out the lower 15 or 20 miles of El Camino Real and put it in portions of the county where the population is denser and the travel heavier. There is a class of people who are opposed to any and everything that costs money or looks like progress, no matter how much needed or how beneficial. I fear the course you are taking with the Gazette is leading comfort and encouragement to this sort of citizens, and putting further off the day of good roads. Very respectfully, C. E. UTT.
