HE WOULD A WOOING GO. How Frank J. Capitain Drew a Breach-of-Promise Suit. Words of Unutterable Love Breathed Into the Willing Ear of a San Francisco Woman by the Gay Deceiver—"Would Soon be Sailing with Her Over the Waters of the Blue Adriatic!"—Told About Organizing the Anaheim Co-Operative Beet Sugar Company Which Fowler Wrecked-Some Warm-Baby Love Letters-Capitain, You are a Villain! How Could You do it? Frank J. Capitain, the sugar-factory broker, who is well-known in Anaheim and vicinity, was some days ago made the defendant in a breach-of-promise suit filed against him by Mrs. Nellie Wallace of San Francisco, who was once before married and divorced, and who asks for $50,000 damages. Although he only met her in August of 1897, being introduced by a mutual friend, and although their association and correspondence lasted little more than six months, still she shows a bundle of tender and loving sentiments on the latest styles of stationery larger than the most loving of lovers could usually find time and inspiration to write in many times so many months. "My own darling sweetheart," and similar terms, he repeats until she says, "If anybody else had written them I would have thought I was being joshed." In one instance at least he calls himself the "little boy," though he is two-and-fifty and she is less than half so old. After an absence of but a few days he says how nice it would be "if the little boy could be with you to love and pet you." One of his letters, written from Los Angeles, runs as follows: My Own Dear Nellie: Today I received your letter of October 9th, in which you express your surprise that I did not write to you. I assure you, my dear, it is a mutual surprise. I could not imagine why you did not answer my two letters from Santa Barbara, especially since before you have always so promptly replied, and possibly have spoiled the small boy by so doing. Believe me, my dear, that in my anxiety I have been imagining all sorts of things—wild beasts, wild men and other combinations. But I am happy the mystery is cleared up. To learn that you have been ill, my dear, has cast a line of sadness over your otherwise cheerful lines. The pictures are accurately reproduced in all the colors used in the originals, and are pronounced by competent critics, works of art. Pastel pictures are the correct thing for the home, nothing surpassing them in beauty, richness of color and artistic merit. One of these pictures will be given away with each package of purchased of your grocer. It is the best laundry starch on the market, and is sold for 10 cents a package. Ask your grocer for this starch and get a beautiful picture. ALL GROCERS KEEP ELASTIO STARCH. ACCEPT NO SUBSTITUTE gatherer and enjoy each other's companionship. In the meantime all the spare moments of the bride-to-be were spent in purchasing the finest articles, for an extensive and exquisite wardrobe would be necessary as an accompaniment to the life of travel and luxury which her lover had painted. Less than a month after the Christmas dinner at which it is charged he set the wedding day, he wrote as follows: Los Angeles, Jan. 15, 5:10 p.m. My Dear Sweetheart—Just returned from the country, hence I trust you will pardon my country style. Your sweet letter received. So sorry for your poor friend. Time and your kind ministrations will heal her aching heart. Our parties arrived from (where you and I will soon journey to) Europe this evening with the Santa Fe limited. Am going to receive them in a few minutes. Pardon brevity and diction; will write more in a few days. Be good, my little love, and cheerful. The suspense and agony will soon be over and our fondest and most cherished hopes may sooner than I at least anticipated, be realized. Above all, do not be impatient, but cultivate that great virtue, though it may seem hard. Yet with the exercise of a little will power you will easily learn the lesson. With love to you. Write soon. Your affectationate, sincere and loving FRANK. But his promises of marriage, oft repeated by word and letter, and finally repudiated entirely, is the ground on which complaint is made and damages sought. The complaint is brief. It does not refer to the promises of marriage which were made in the earlier part of their acquaintance, but comes down to the Christmas dinner which was given by Mrs. Martha R. Edwards, the mother of Mrs. Wallace, in the family home at 622 Post street. This was in December, 1897, four months after the first introduction. At this time it was set forth that Capitain renewed his avowals of love and promises to wed, and this time the date of the marriage was set for April 12th, the anniversary of the birth of the bride-to-be. She says he was so inclined to be looking for these little romantic touches. Then and there the mother and the sister were invited to their next Christmas dinner in Europe, where it was calculated that Mr. and Mrs. Capitain were to reside, for he was lord of his intended family, and they were to share in the many joys which he was to experience in his new found happiness. Then came many letters, approaching the spring time when the nuptials were to be celebrated. These all breathe of impatience because of the necessary delay. He longed for the time when the two should travel together and enjoy each other's companionship. They would travel in Europe extensively. In the meantime all the spare moments of the bride-to-be were spent in purchasing the finest articles, for an extensive and exquisite wardrobe would be necessary as an accompaniment to the life of travel and luxury which her lover had painted. Ten days before the date when they were to have been made one he wrote this letter: SAN LUIS OBISPO, April 2, 1898. My Dear Sweetheart—This is a small but beautiful place. Just such a place where I would love to spend a few days with you, as I am sure that you would enjoy it. The scenery between Paso Robles and San Luis Obispo is really grand. I am very glad that I accompanied the doctor. My only regret is that you are not with me, but the time is drawing near when we will travel together. My love to your mother and sister. If you are not too busy write me another letter at Paso Robles, and tell me if you will meet me, darling, at the depot. With love and a happy au revoir, sincerely and affectionately your FRANK. Sixteen days after the 12th of April—which was to have been so eventful, according to the complainant—this letter was written: SANTA BARBARA, April 28, 1898. My Dear Sweetheart—Disappointed I am at general tone of your letter, although I am in rather good spirits and assure you I propose to continue so, no matter what may occur, and I do suggest to you to do likewise. Be in good and cheerful spirits. Banish all troublesome, dismal and disagreeable thoughts and do not neglect, my dear, to as often as possible worship with devotion at the shine of god Morpheus..I predict that sooner or later (I hope sooner) the sunshine of happiness will at last peep in upon us, illuminating our path in life and repaying us for all the trouble we have gone through. Though it may seem dark and cloudy at present, I know you will pardon me if I insert rather common yet most appreciable phrase that it is a long road that has no turning. True it is sometimes hard to travel that road until we come to the turn, yet patience perseverance and eternal vigilance will invariably bring us to it. In the mean time it is the wise ones who enjoy life to the best of their ability. Don't you think, my dear, I would have made a fine preacher? The only difference between them and myself is that I practice what I preach. I leave this evening for Los Angeles, where I expect from you a letter. With love to mamma and Etta, and thanks to you for your good wishes, I remain forever, your devoted FRANK. But as the bills grew and were unpaid and the date of the wedding was still further postponed, Mrs. Wallace became anxious she says, and pressed him for something definite. This, according to the complaint, led to a reputation of all promises. Efforts to secure reconciliation were without effect and in July Mrs. Wallace says all her personal effects were attached by creditors. This is part of the humiliation for which she makes claim for damages. In this same month of July an attorney was consulted and correspondence together and enjoy each other's companionship. They would travel in Europe extensively. But as the bills grew and were unpaid and the date of the wedding was still further postponed, Mrs. Wallace became anxious, she says, and pressed him for something definite. This, according to the complaint, led to a repudiation of all promises.
