There is altogether too much "Freeman on Executions" in the unsigned communication dealing with the existing state of affairs between the City Trustees and the water board, in Saturday's issue of the Independent, to admit of any doubt upon the point that it was in great part written, and probably altogether inspired, by the Champion Leg Pulier of Orange county. The earmarks are quite too prominent to admit of doubt upon that score, but the beginning is all that we care to concern ourselves about this morning: Quite a number of people have the temerity to entertain a different view of the finale of the case of the city of Anaheim vs. the Anaheim Union Water Company from that to which the editor of THE GAZETTE has given expression. Well indeed, is that so? And who are they, pray? Not the poor cabbage raisers who sought to irrigate their crops the day the dam was put in the ditch on Sycamore street; nor yet the irrigators whose supply was cut off by damming up the ditch on Olive street. For our part, we have failed to encounter a single resident of the city or surrounding country but who regards the damming of the ditches with emphatic and outspoken denunciation. The case of the City Trustee against the water board has long since degenerated—by no act of either board, be it said—into a palpable side issue of the Mrs. Hansen case against the company for the recovery of $20,-000 for damages alleged to have been sustained by falling into the cement ditch at the precise point where the dam was placed in the ditch on Sycamore street. In the beginning of the occurrences that have led up to the amusing but unfortunate comedy of errors now before the people—unfortunate in the sense that it has attracted the attention of the people of the State to the apparent fact that we are ludicrously misgoverned—the city board required of the Water Company that it acquire a franchise for the maintenance of their ditches upon the streets of this city. The Water Company ought in duty bound to be required to apply possession. Then another motion was made and carried to place a dam in the ditch at the alley. The following morning the Marshal was instructed to dam up the Sycamore-street cement ditch as well. When Mayor Rust was informed of this action on Wednesday afternoon—too late for us to use in our report of the matter last week—he promptly disavowed the action of his fellow trustees, expressing great surprise thereat; and Trustee Lewis promptly placed himself on record as being emphatically opposed to this policy of the damming up of the ditches. Trustee Conrad also expressed himself as being opposed to this policy, and on Monday the three gentlemen joined in an order to the Mareal requesting him to remove the obstructions. Here the matter rests for the present. Water is running in the Sycamore ditch, the obstruction having been washed out soon after having been put in. The Marshal refrained from taking out the obstructions on Olive street, preferring to defer action by the advice of the City Attorney until the council meets next Tuesday evening. Mrs. Hansen's case against the company comes up in the Superior Court on the 17th proximo. We hardly look for a solution of this little comedy of errors until after her case is disposed of. In the meantime the tax-payers may console themselves with the thought that they will have a bill to pay in the end for the procuring of a pop gun judgment, which can do them no good whatever and which we apprehend will be gladly dismissed in the end. PLACENTIA POINTERS. J. K. TUFFREE WILL LAY OUT A TOWN SITE ON HIS BUENA VISTA RANCH. J. K. Tuffree expects to have surveyors at work laying out a town site in the center of his 640 acre ranch. Some acres property will be sold on the outskirts of the city, and the Southern Pacific Railroad will put its China line through it. The corner lots are already spoken for and will probably go high. Mr. Devonshire had a birthday party on Sunday last. Guests express themselves as having had a pleasant time, and we know they must with such a host as Mr. Devonshire. Tom McFadden has been quite ill and is obliged to stay out of school. He is being soothed in Los Angeles. We hope to see him as well as ever in a short time. BUT IMPORTERS EASILY EVADE THE DUTIES UNDER THE AD VALORI SYSTEM. WASHINGTON, Nov. 10 — The secretary—the treasury has received the annual report of the board of United States general praisers at New York. It shows that during eleven months ended September 2249 reappraisements were made by individual general appraisers and 783 cases The water board, following out their purpose to comply with the wishes of the City Trustees, instructed their attorney, immediately upon being made acquainted with the fact that the Trustees desired to have the matter of the ditches settled by a franchise covering the matters at issue, to apply for a franchise to maintain their ditches wherever, upon the public thoroughfare of this city, it was necessary to carry on their system of laterals for the distribution of water to irrigators in town and beyond the southern and western city limits. Upon the publication of the fact that the attorney of the water board had been so instructed, the City Attorney, acting as counsel for Mrs. Hansen, set up a claim for $20,000 damages, for injuries alleged to have been sustained by falling into the ditch, many months previously, and seeking to set up the contention that the Water Company had no rights upon Sycamore street, where the ditch had been maintained in undisputed possession for thirty years, brought suit to eject the Water Company from maintaining its ditch upon that street. No injunction was placed upon the work of cementing the ditch, which was going on at the time, and the work progressed quietly until the cementing was completed. At the time of the announcement of the fact that an ejection suit had been brought to put the Water Company off the street, every property owner upon that thoroughfare, who had irrigated from this ditch undisturbed since the original laying out of the town of Anaheim, and who could get water for irrigation in no other way, denounced the action in unmistaken terms, and we believe they still so regard the matter. In view of these ejection proceedings, and the bringing of this $20,000 damage suit against the company, an application for a franchise to maintain this Sycamore street ditch would undoubtedly have been misconstrued as a tacit admission, on the part of the Water Company, that they had had no right to maintain their ditch on that thoroughfare at the time of her accident, and her unjust suit for the recovery of exorbitant damages would undoubtedly have been facilitated very greatly thereby. This was the trap which the Water Company very wisely determined not to precipitate themselves into; and the matter of the application for the franchise was, by mutual agreement, required of the Water Company that it acquire a franchise for the maintenance of their ditches upon the streets of this city. The Water Company ought in duty bound to be required to apply for this franchise, and they should not be permitted to maintain a single ditch in town without one. But they should not be required to precipitate themselves into the trap set for them by the City Attorney; and a very few words ought to be sufficient to make this perfectly clear. This was the trap which the Water Company very wisely determined not to precipitate themselves into; and the matter of the application for the franchise was, by mutual consent, deferred, and there the matter rasted, so far as the water board was concerned, until they were enabled to free themselves from the entanglements of this outrageous damage suit against them. Mayor Rust himself, in an article printed elsewhere, says he thought the "friendly legal contest" was at an end, and was greatly surprised when the City Attorney brought in the report of the "judgment" at the last meeting of the Trustees. Mrs. Hansen's case was up before Judge Towner a week or two ago on demurrer, and the Judge sustained the contention of the water board, that they had a perfectly legal right to maintain their ditch upon that thoroughfare. Thereupon the City Attorney, without the knowledge, consent or authority of at least a majority of the City Trustees—we mean Trustee Lewis, Rust and Conrad—procured a pop-gun judgment by default against the Water Company, setting forth that they had no rights upon Sycamore street; and on Monday of last week Sheriff Nichols came ever, and going in a carriage, accompanied by three members of the city board and the Marshal, to Sycamore and Olive streets, placed them in possession of the ditches upon those thoroughfares. At the meeting of the city board Tuesday evening of last week, the City Attorney rendered an elaborate verbal report upon this excessively amusing comedy of errors, dwelling upon the fact that he had won a very great suit, and pointing out that the Sheriff had come over all the way from Santa Ana to "place the city in possession;" and after a motion had been made and failing of a second had been withdrawn, to request the water company to put in a bridge over a ditch at an alley on Olive street, near City Trustee McWilliams' residence, the City Attorney reiterated his statement that is necessary that something be done to confirm his action in the suit, and that it was essential that the city emphasize the fact of their Swazy is the leading spirit in the new enterprise, while Mr. James Mossa secretary throws its energy and business ability into it with all his heart. The station will be an immense boon to the section, and will pay 15 per cent on investment from the start. Six cows in fair milking order mean a check from the genial Mr. Moes for $24 a month, and we get back the skimmed milk for hogs and hens, and it is worth about $4 a month additional. Orange County Directory. The agents of the California Directory Company have finished distributing the new Orange County Directory. The book has been well received in all parts of the county and supplies a long felt want. The publishers have more than kept faith with their patrons, having done more than they promised on their business cards. All the towns have been alphabetically arranged with a short write-up of each conveying much useful information. The work also contains a gazetteer of the county, giving a list of the business men in each town. The book comprises four directories in one: A city directory of Santa Ana, giving street address of every resident; a gazetteer of the county, a classified business directory of the county, and a farmers' and fruitgrowers' directory. The latter will be valuable for business men. The book has a wide circulation throughout the county and will be found in numerous seaside resorts and hotels. It is a good homeseceker' and tourists' guide. As the places best advertised attract the most settlers, the book will be of great value to the land owners and residents of Orange county. Every land owner should read carefully the descriptive articles contained in it. Copies may still be had at the office of the California Directory Company, 421 Byrne Building, Los Angeles, with L. H. Meriz, Newspaper Agency. Country Newspapers. Sacramento Bee. The papers published in the smaller towns of California are so far ahead of those issued under similar conditions in the east that no comparison between them can be made. Some of the very best things to be found in journalism in this state may trace their origin to the columns of the unpretentious country newspaper. The refreshing breeze of the village appears to be conducive to healthy ideas and lucidity of expression. The country newspaper serves well of the people whom it addresses. It has brought to general notice many a town whose existence on the map had been almost unknown save to the inhabitants. It is the agency which keeps the more or less remote settlement in touch with the outside world. It is the promoter which does more to "whoop-up" and draw capital and population to its locality than all other influences combined. Take away the small daily or weekly paper from the town of 2000 or 5000 population and you have sent that twenty years back on the road of progress. The duty of the people of the smaller town and the country surrounding is to take the local paper, and the duty of the local paper to give them every inch of news it can squeeze into its columns. FOUGHT BEFORE THE GOVERNOR. TW LOS ANGELES MEN HAVE A SERVICE CHAMBER was the scene of a lively afternoon between John Mitchell, ney for the accused board of John Mitchell, agricultural directors, and Lewis Thorn secretary of the board, who filled the chair. The affray lasted but a moment, and witnessed by the Governor, who had adjourned the investigation, and a number of politicians who were there as investigators of the trial proceedings. For some time bad blood has existed between two men, and the ardor within the Los Angeles attorney has prosecuted counter charges against those who have about the present investigation hastened to lessen the feeling. During day's investigation Attorney Mitchell interrupted two or three times by his ex-secretary, who had something to say in explanation of certain statements made. At 4 o'clock the Governor said that would adjourn the meeting until no later at 9 o'clock. When the adjournment taken many picked up their hats and chamber, but others gathered around Governor and insisted on arguing further. Among them were Catterson Mitchell, attorneys for the accused and Speaker Lynch. During the conclusion a few unpleasant words passed by Attorney Cattern and Lynch, and Attorney Mitchell turning to his colleague, "Let's go." Mitchell then started for the door was intercepted by Lewis Thorner stopped him and said: "You have these directors to make statements that false." Mitchell answered: "There is against perjury." "Yes," said Thorne, "and I purpose ing advantage of it." He then started to say something else Mitchell said: "I do not desire to hear further conversation with you. I have spoken to you in this proceeding, and desire you to speak to me." The answer then raised his hand and waving it said away from me. Thorne's face flushed and he excused "Nor do I care to talk to a cur." It shows that during ten months ended September 30, appraisements were made by indi-general appraisers and 783 cases by than Mitchell raised his cane and struck several quick blows at Thorpe, who guarded them with his arms. There was a chair between the two men which probably prevented the attorney from following up the attack. Governor Budd, who was standing near the antagonists made a motion to interfere, but before he could get near them it was all over. Mitchell turned to the Governor and asked his pardon for having lost his temper. VISCOUNT VICTIMIZED. DIDN’T WANT TO BE A CHUMP, BUT HAD HIS BLOOMING LEG PULLED AFTER ALL. CHICAGO, November 18 — An Englishman who says he is Viscount Richard William Curzon, and who has letters from prominent people in London addressing him as such, reported to the Harrison-street police tonight that he had been robbed of $135 at 327 State street, a notorious house on the levee. Curzon claims to be the oldest son of Earl Howe, 21 Curzon street, Mayfair, London. He says he is on a trip around the world, and arrived here Saturday from Montreal. “I don’t care for the £27,” said Curzon with a rich English accent, to Lieutenant Smith, “but I don’t want it said that an American woman got the better of an English gentlemen, don’t you know. If you recover the money we’ll have a jolly good champagne supper on the head of it, and I will charge the expense to the good experience, don’t you know. “If my father, Earl Howe, heard of it he would think me a blooming chump, don’t you know. I’m traveling incognito, under the name of Bloomfield, but my right name is Curzon—Viscount Richard William Curzon. When I left London a few weeks ago my father gave me £12,000. I am on my way to San Franciscos where a remittance awaits me. From there I go to Honolulu. I suppose you have heard of the Duke of Marlborough, who last week married Miss Vanderbilt of New York? He was a chum of mine. I am a cousin of George N. Curzon, who some months ago married Miss Leiter of Washington.” Mr. Curzon showed letters which seem to bear out his claims. He did not deny that he had been imbibing a little too much of late. The Viscount came to the station with a carpenter by the name of “Ohio Bill.” He had made the acquaintance of “Ohio Bill” in a State-street saloon, and to night the man who claims to be the son of an Earl slept with “Ohio Bill” at the Great Western Hotel, State and Harrison streets. He will get a warrant in the morning for the women who robbed him. BRADY CONVICTED. MARYSVILLE, Nov. 19.—Bandit Jack Brady, who shot down Sheriff Bogard while robbing the Oregon Express, has been found guilty, with punishment fixed at imprisonment for life. A slight pallor was seen to mount Brady’s face when the verdict was announced, but aside from that he showed no emotion. C. Weeman, who told Juror Ogden while the trial was in progress to “hurry up and hang him,” has been cited to appear for contempt of court. Brady and a companion named Browning first introduced the bicycle into the trainrobber business. They left San Francisco on wheels and toured through the State. One night they held up the Oregon Express near Reed’s station. Browning, while engaged in robbing the passengers, was shot and killed by Sheriff Bogard of Tehama county, who was a passenger on the train. Just as Bogard fired, however, Brady entered the car behind him and shot him in the back. Brady escaped, and for months was purued by officers. He had several brushes with the officers, was wounded, but always got away. Finally he was surrounded in Yolo county and surrendered. It is almost certain that Brady and Brown ing committed several other train robberies before they tried the Oregon Express. One robbery near Sacramento netted the bandits $50,000, but they were forced to hide the money to escape. Tramps found the coin and made away with it. Brady and Brown were also accused of the murder of Corneilie Stagg at the Ingleside road-house near San Francisco, who was killed while resisting robbery. All Free.
