On the first page will be found an interesting article, albeit in spots grotesque in its inaccuracy, dealing with some features of the rich country tributary to Anaheim and Fullerton, taken from the columns of the Los Angeles Herald of a few days ago. Its numerous absurd inaccuracies can only be accounted for by the fact that either the correspondent, who tells us he came down on his visit "in a hurry," was precipitated amongst a lot of wicked "leg-pullers"—so highly prized in all well-regulated newspaper offices—or that he sacrificed accuracy in his baste to get home. He tells us, for instance, that some enterprising fellows last year peddled their water stock among non-stockholders to such an extent that 12,000 acres were watered, whereas only 7,000 acres can be irrigated by the company's by-laws. This, he complacently tells us, was the cause of the temporary injunction issued by Judge Towner against the collection of taxes in the irrigation district!—an entirely different and separate organization. Now, this is all of course not so, and it would be interesting to know where the correspondent got his information. Then he gets down to reminiscence, and tells us that our old friend, William Crowther, the North Side impressario, who himself is able to draw the hair of the horse across the desiccated viscera of the libidinous J. Thomas Cat in no uncertain way, drawing therefrom melodious strains like saw filing, made the picks that dug the North Santa Ana canal; and that David Yorba, who came to town with McFadden's contingent of spellers in the early days, lives on the south side of the wash, up in the Yorba mountains. This is all very nice, but it isn't so. Some of our farmers, he goes on to say, "get from $475 to $600 per acre every year," and then as if to administer a parting shot to the North Siders to offset the fulsome praise bestowed upon them, he tells them that the best walnut lands are to be found south of Anaheim and in the neighborhood of the county seat when Santa Ana is not keen on walnuts at all—she goes in for nothing but peanuts and that they entertain no feeling against him, and the further evidence of his worth which a vote of thanks passed by the board clearly extends him, his removal can be explained on no other hypothesis than that it is the result of the "water politics" that has agitated the stockholders for some time past and preceding the election. We are assured that Groat's administration saved the company $100 per month in running expenses over Sheppard's previous term in office, and this fact, coupled with the testimony against the latter at Saturday's meeting, that he had charged for "extraas" which Groat had done for nothing, naturally excites the query. Why was Groat removed to make room for Sheppard? Is it because Groat lives in Anaheim, and Sheppard in Fullerton?
LAST year the stockholders of the water company, at their annual meeting, voted unanimously to make the water appurtenant to the land, but at Monday's meeting, under the leadership of the eloquent Mr. Fay of West Anaheim, they were not so sure they were right about that business. The amendments were withdrawn under a cross fire of objections on the part of the stockholders, and will be submitted to a committee for repairs, to be acted upon again at a meeting called for April 5th.
There is doubtless some good in the amendments, and we are of the conviction that water should be appurtenant to the land. This would put a stop to the carting about of shares from one tract of land to the other, which has been the cause of so much dissatisfaction in the company.
The amendment increasing the capital stock from 7,000 to 12,000 shares of course met with active and well directed opposition. It can never be carried, until such time as it is shown that the volume of water has been correspondingly increased. If the increase is designed for purposes of speculation, it will never carry; but if it is for the purpose of permitting those along the ditch without stock a chance to become shareholders, and thus increase the revenue of the company, let us increase a thousand shares at a time, and see how it works. We think there would be little opposition to adding a thousand shares to the capital stock, but the purpose to increase it by 5,000 is out of the question.
There was no great exemplar lighting the way to the adoption of the amendments. They had been passed by the Board of Directors as being essential to the continued success of the company, but when it came to their submission to the stockholders and the storm of disapproval was on, there was none reports having had a jolly time, but he advises people to wait a couple of months before visiting the fair, as it is not yet in shape.
A. S. Bradford, who has been on the sick list, is now somewhat better.
J. K. Tuffree's youngest son has pneumonia. A great many others have bad colds.
Now, Mr. Editor, I wish you would consult the weather clerk and see if he could not spare us a little rain. We need it. Editors should be accommodating in such matters.
Mr. J. Botsford's ranch presents a lively appearance. He is setting out trees at a rapid rate. A. S. Bradford & Co. furnished a large share of the trees.
The orange association here has commenced to ship oranges and will continue at a lively rate. Cabbage is backward, the cold weather preventing them from growing. It has been estimated that the crop will not be much over half a crop.

The United States revenue cutter Wolcott has returned from a cruise along the coast of Vancouver Island as far north as Clayquot sound after an unsuccessful search for the wreck of the sealing schooner Mary Brown, which sailed from Sand Point,
and that David Yorba, who came to town with McFadden's contingent of spellers in the early days, lives on the south side of the wash, up in the Yorba mountains. This is all very nice, but it isn't so. The whole article is not troubled very much with the element of accuracy, but we republish it, just to show how wide of the mark some of the so-called city reporters get when they come down to see us "in a hurry."
From the decision of the Supreme Court sustaining the lower court in the matter of the Northern Counties Investment Trust vs. John Cadman and others, we take the following:
Northern Counties Investment Trust, appellant, v. John Cadman et al., respondents. This appeal is from an order made after judgment denying plaintiff's motion for an order directing the Sheriff to publish notice of sale of real estate, or execution, in a certain newspaper, selected and designated by plaintiff's attorney. The material substance of the bill of exceptions is that having contracted for the publication of the notice in the Daily Evening Blade for the length of time required by the statute, he gave the Sheriff written instructions to advertise in that paper, but the Sheriff ignored the instructions and commenced the publication in the Weekly Gazette, published in the same county, Orange, which last paper had a circulation of about 400 as against the 700 circulation of the Blade. (Judge Daniels' affidavit, which Judge Towner would not considerably larger.) The court in affirming the decision of the lower court says: The requirement of notice of sales in excursion is quite as much for the benefit and protection of the defendant as for the plaintiff; and the defendant, if not insolvent, ultimately pays the expense of publication. Why is not he, at least, equally with the plaintiff, entitled to dictate to the Sheriff how and where he shall publish notice of sale? And if equally entitled, who is to decide when they disagree?
Order appealed from is affirmed.
The language of the higher court is almost identical with that of Judge Towner. Mr. Montgomery had contended that the rights of the plaintiff had been better subserved by publishing the notice of Sheriff's sale in the columns of the Blade—in which he is a stockholder, by the way, and is presumed to be its manager and to dictate its policy. However he was prompted to say in his affidavit to the court, talking through his hat "on information and belief," that his paper had 700 circulation, and we only 400, is inexplicable. As well might we be permitted to go into court and make on "information and belief," damaging accusations against the methods of his practice or the usefulness of his newspaper.
Judge Daniels' brief, submitted to the Supreme Court, was at once a repository of cogent reasoning, and strong, convincing and resistless argument. He showed that the rights of the defendants were quite as much an issue in the case, and quite as much

During the prevalence of the Grippi past season it was a notorious fact that those who depended upon Dr. King's New Discovery, not only had a speedy recovery, but escaped all the troublesome after effects of the malady. This remedy seems to have thus increase the revenue of the company, let us increase a thousand shares at a time, and see how it works. We think there would be little opposition to adding a thousand shares to the capital stock, but the purpose to increase it by 5,000 is out of question.

THERE is considerable talk about Supervisor. Gentlemen, the campaign is young yet, and the election a long way off, but it might just as well be understood here and now that no man can be elected to this important office who is not solid against township division, and against hacking at our school district These two matters, together with good roads for the district—something we are strangers to—will come near forming the platform on which the successful candidate must stand, and none others need apply. But the campaign is young yet, and out of the abundance of material offered, people will probably have an opportunity to select a capable man for the office.
THE Senate Committee on Finance have agreed to take sugar off the free list, and to put on a duty of a cent per pound. They have not yet reported to the upper house, and while half a loaf is better than no bread House, it will never become law. The graduated bounty at first proposed should be restored, if possible; if not a compensating tariff will do, but free sugar would have a very dissatisfacious effect upon the sugar interests of the country.
By the way, what has become of those petitions out for signatures asking for an election to abolish the district?

Clayquot sound is the general headquarters of the northern Indians, who congregate there from all points of Southeast Alaska and Vancouver island preparatory to going outthe sealing vessels. None of the Indians had any news of recent wrecks of vessels. The belief prevails among the revenue officials thatthe Mary Brown was lost above Sitka.

Judge Daniels brief, submitted to the Supreme Court, was at once a repository of cogent reasoning, and strong, convincing and resistless argument. He showed that the rights of the defendants were quite as much an issue in the case, and quite as much to be respected, as those of the plaintiff—in which the Supreme Court has upheld him.
His affidavit, prepared for submission to the Superior Court, was not permitted in evidence, Judge Towner observing that it was unnecessary to introduce it after Mr. Montgomery had argued for an hour in support of his lame contention. The Judge thereupon, in an elaborate and forceful opinion, in which the grounds of the case and the facts and the law were minutely gone over, decided against the plaintiff, on substantially the same grounds as characterize the decision of the upper court.
The Sheriff had all along followed out the process objected to in this case—he had published the notice of sale in the paper printed nearest the property involved. He is the officer alone responsible for the publication, and he should seeto sit alone that these notices of sale are properly given the public. It matters not whether the circulation of the paper selected be a hundred or a thousand—the Sheriff is the responsible officer for the publication, and is strictly accountable for it on his bond. The plaintiff have rights in the case, to be sure, but the poor bankrupt defendant, undergoing the process of being "froze out," has rights along with the other fellows, nope the less. And in case each should have a newspaper, and both should attempt to dictate to the Sheriff where and how to publish his executions—who is to decide?
That the present board of water directors have the interest of the community at heart, as one of them feelingly remarked the other day, we have no disposition to deny, but when they displace the most efficient Superintendent the company has ever had to replace him by a gentleman certainly not so efficient as he, their action naturally gives rise to comment, and is viewed by many as being considerable of a puzzler. The said action is brought to obtain a decree of this Court for the foreclosure of a mortgage described in the said complaint, and executed by P. H. Lowell and Cedella M. Lowell on this day of October, A.D. 1891, to secure the payment of one premissory note signed by said P. H. Lowell, dated October 8th, 1891, payable to the plaintiff for the sum of $2,500, two years after date, with interest at the rate of nine and one-half per cent per annum from date until paid; Interest payable semi-annually, and for all attorney fees in suit to enforce payment of same; also for taxes and assessments paid; thus provides conveyed by said mortgage may be sold, and the proceeds applied to the payment of said note and interest, taxes and assessments paid and costs of suit; and in case such proceeds are not sufficient to pay the same, then to obtain an execution against said S. B. McConnick and Albert C. Haven for the balance remaining due; and also that the defendants and all persons claiming by through or under the defendant may be barred and forced all right, title, claim, lien, equity of redemption, and interest in and to said mortgaged premises, and for other and further relief. Reference is had to Complaint for particulars.
And you are hereby notified that if you fail to appear and answer the said complaint as above required, the said plaintiff will apply to the Court for relief demanded in she said complaint.
