A VISTA OF PERNICIOUS LEGISLATION.
Two bills have been introduced into the Assembly—Nos. 512 and 666—the first providing for the exclusion of property from irrigation districts, and the other relating to the disorganization of the same, which are meeting with the united opposition of the friends of the district system of irrigation throughout the State. The State Association of districts, represented by their Executive Committee at Sacramento, are taking active measures to defeat the passage of the bills, and have made an appeal to the friends of irrigation throughout the State to assist them in their fight, by forwarding remonstrances to the Governor and the Legislature against their incorporation into law. These bills have been introduced by the enemies of irrigation, with the sole object of disrupting the district system, and are universally denounced by all friends of the same as dangerous if not absolutely ruinous to the entire system of irrigation as practiced under the Wright bill. The Executive Committee are making a hard fight against them, but the bills are backed by a powerful lobby, and a letter from the Secretary of the committee brings the information that if they are to succeed they may have the immediate and united support of the friends of the districts throughout the State. The bills will bear the scrutiny of a close investigation.
The first bill, in providing for the exclusion of lands from an irrigation district makes it the duty of the Bord of Directors, when a petition, signed by one or more property owners residing or owning lands in the district, shall be presented to them praying for such exclusion, to exclude all lands which the filmmist pretext might show to be otherwise than directly benefited by actual irrigation. It there be outstanding bonds of the district at the time of the filing improvements could be made, no capital invested, and the condition of things would verge on anarchy. The district could not go forward, and it would be a question whether it had best be abandoned once and for all there and then. Both bills are cunningly devised measures, and are backed by an influential lobby.
The friends of irrigation throughout the State should respond at once to the call of the State Association. It is pleasant to know that from this district vigorous protests to the enactment of the measures are already speeding on their mission to Sacramento.
The proposed amendments to the Pension laws now being discussed by the House would if they became laws save the country about $30,000,000 a year. They provide for transferring the Pension office from the Interior to the War Department and placing it in charge of army officers; also, for suspending pensions paid to those having an annual income of $600 or more; to widows who were not married within five years from the close of the war, and, except in case of total disability, to alien non-residents.
RULES AND REGULATIONS.
GOVERNING THE AFFAIRS OF THE WATER COMPANY AND THE DISTRICTION OF WATER.
The following new rules and regulations governing the affairs of the Anaheim Union Water Company, and providing for the distribution of water, have been adopted:
The superintendent shall have a general supervision and care of all the property of the company, with power to employ or dismiss, fix the wages and keep the time of all employees in his department, including all laborers, ditch-cleaners and division zanjos, subject to the approval of the Board of Directors, excepting the zanjos who distribute the water (said zanjos being appointed by the Board of Directors at a fixed salary, but subject to the general supervision and control of the superintendent); he shall be responsible for, and regulate the flow of all water through the main canals, and the safe condition of all canals, ditches and gates; also for all orders, tools, and materials for repair and improvement of ditches; he shall purchase tools and materials for repairs by order, and shall have charge of all ditch cleaning and repairs of canal ditches, discharges and fittings.

The first bill, in providing for the exclusion of lands from an irrigation district makes it the duty of the Board of Directors, when a petition, signed by one or more property owners residing or owning lands in the district, shall be presented to them praying for such exclusion, to exclude all lands which the fliest pretext might show to be otherwise than directly benefited by actual irrigation. If there be outstanding bonds of the district at the time of the filing of said petition, however, the holders of the bonds "may give their assent" to the exclusion, and the lands so excluded shall be released from the lien of said outstanding bonds.
The bill repeals the sections of the present law providing for an election by the people on the exclusion of property from districts, and provides further that if the lands excluded embrace the greater portion of any division or divisions of such district, the office of Director of such division or divisions shall become vacant at the expiration of ten days from such exclusion, the vacancy or vacancies to be filled by appointment by the Board of Supervisors, the Director so appointed to hold his office until the next regular election, and until his successor is elected and qualified. Before the next election the Directors are to divide the district into five new divisions, after which the Directors are to be chosen as at present provided. The bill so far is aimed as a blow to the district system of irrigation, but what follows is calculated to work the practical undoing and in time perhaps the abolishment of that system. If the Board of Directors should deny any petition for the exclusion of lands, goes on this precious document, the petitioners, or any of them, may within sixty days after the entry of the order denying such petition upon the minutes of the board, institute an action against the Directors in the Superior Court for the purpose of obtaining a judgment that the lands may be so excluded. Here is the "nigger in the woodpile." Cases might be taken into Court interminably and upon the shallowest of grounds, involving the certain disruption of all prospective bond sales, discountening the investment of foreign capital, and subjecting the people of the district to great expense and annoyance, and working incalculable harm to the community. All this might be brought about by the wealthy non-resident, who cares very little for the advancement of the country and less for the maintenance of a system of irrigation.
The bill should be defeated, and sent to meet and hold communion with the ghost of the departed Teachers' Pension Bill, which is dead past all redemption, and worse than dead—buried. It will be defeated if the Legislature will keep in view the interests of the people of the State. The solution of the question of direct and indirect benefit misses in his department, including all laborers, ditch-cleaners and division zanjeros, subject to the approval of the Board of Directors, excepting the zanjeros who distribute the water (said zanjeros being appointed by the Board of Directors at a fixed salary, but subject to the general supervision and control of the superintendent); he shall be responsible for, and regulate the flow of all water through the main canals, and the safe condition of all canals, ditches and gates; also for all orders, tools, and materials for repair and improvement of ditches; he shall purchase tools and materials for repairs by order, and shall have charge of all ditch cleaning and repairs of canal, ditches, flumes, gates, bridges and fences, and of construction, when the same does not interfere with the performance of his regular duties; said construction work to be done by order of the Board of Directors under the direction and according to the plans furnished by the engineer; he shall require the division zanjeros at the head of canals to bill out daily record blanks showing the amount of water flowing into the canals, and also the same record to be kept of the volume of water at the Tuffree reservoir and at Hartung's corner by the distributing zanjeros, and shall require them to report the same to him at least once each month, together with such other matters of special interest as may come up in his department. The superintendent shall keep a full and complete record of all matters pertaining to his department, including a record of water measurement, the number of miles of ditch cleaned, and the location of the same, the cost per mile, the number and location of all gates, flumes, bridges, etc., repaired, and the cost of each, the total cost of the above item, the cost of maintaining the main canals per mile, the cost of maintaining the distributing ditches, and shall make a monthly report of the same to the Board of Directors, together with an itemized payroll of all the labor in his department. All bills, and supplies furnished by the order of the superintendent shall be O K'd by him before payment. At the beginning of his term of office he shall make an inventory of all tools, numbering the same, and other property in his department (all wornout tools shall be placed in the toolhouse until disposed of by the order of the Board), and at the expiration of his term of office he shall make a report and classification of said tools, together with additional tools purchased, showing the condition of the same.
RULES FOR DISTRIBUTING WATER.
1. It shall be duty of the distributing zanjeros to deliver water in regular runs beginning at the lower end of the ditch (as shown on the map for that purpose) and deliver up in regular order.
2. The zanjero is to give the irrigator twenty-four hours notice of the delivery of water.
3. It shall be the zanjero's duty to see that the water arrives and continues to flow to the land being irrigated (as per notice previously given), in as uniform a stream as possible.
4. In no case shall there be delivered a less head than 50 inches.
5. The minimum charge for water delivered shall be the amount which can be purchased at that time on one share of stock.
6. The amount of water is to be measured at the irrigator's corner, if there is a suitable gate there for ascertaining it, if not, it is to be measured at the nearest suitable gate above, and no allowance is to be made for loss through seepage after leaving said gate. The measurement shall be made in the presence of the irrigator if it irrigator so desires.

The solution of the question of direct and indirect benefit in matters of irrigation had best be vested in the people of the district, rather than be made an issue in a court of law, with its train of illis and objections to it insuperable. Let the law stand as it is. Pass the bill, and it will work the undoing of the district system of irrigation, and set at naught the work which it has taken years of patient endeavor to accomplish.
Assembly bill No. 666 provides for the abandonment of operations by irrigation districts and their subsequent disincorporation. This is the bill about which there was some weeks ago so much discussion before the Irrigation Committees of the Senate and Assembly between the friends and opponents of irrigation. By the terms of the bill, whenever a petition is presented to the Directors of a district signed by a majority of the taxpayers within the district, whose names appear upon the last assessment roll, asking for the abandonment of further operations in the district, the board shall call a special election to take the sense of the people upon the question, and if two-thirds of the votes cast shall be in favor of such abandonment, no further operations shall be carried on or money expended in such district for the construction or completion of any system of irrigation works. This interesting question of disorganization may be sprung upon the people as often as once in every two years.
Both bills are aimed at the ultimate defeat of the district system of irrigation. With a case hanging fire in the Superior Court, involving the exclusion of property from a district, and the constant menace of possible disincorporation, the irrigators would find themselves powerless to proceed in the further progress of the district. No

19. The zanjero shall keep a "daily report" of the water run, with chart of the same, and all night water shall be entered in said daily "report" in red ink to distinguish it from the day delivery.
20. He shall keep a record of the water as delivered in a run book of two volumes, prepared by the secretary, returning one volume at the end of the run and receiving the other volume for the succeeding run from the secretary, and balances due the irrigators will be transferred to the second run succeeding.
21. When not employed in running water, he is to be employed as instructed by the superintendent, and record in his daily report the nature of such employment opposite the hour of the day it which such work occurred.
22. Any person interfering with any of the gates of ditches of the company (unless requested to do so upon each occasion by the zanjero) is liable to a fine of twenty-five dollars ($25.00).
23. The zanjero will see that stock does not trespass upon the company's ditches.
24. It is the duty of the zanjero to report to the superintendent any stealing of water, whether waste水 or otherwise; or any tampering with the company's gates or ditches.
25. Any zanjero failing to carry out the rules of the company is liable to be fined or dismissed, or both.
26. All water must be purchased before the run commences.

All water to be measured with a four (4) inch pressure from the center of the opening, such opening in no case to exceed eight (8) inches in depth.

Allea Manvel, President of the Santa Fe bleached skeleton of a human being, which is supposed to be that of the missing Fraukel, as no one else has been lost since that time whose remains have not been found. Mr. Fraukel was quite wealthy, and his relative, who reside near San Pedro, will probably have the remains brought over and buried.

The Extinction of the Kiss.
The kiss of affection and romantic love is celebrated in the song and story of all ages. Sacred literature justifies—and honors—the holy kiss of religious sympathy and fellowship. The meeting of the lips has always been with our race the universal and natural and spontaneous expression of the most tender sentiment.
Now sanitary science pushes itself forward to degrade the tins to the level of sewer gas and the many agencies by which noxious and infectious disease is propagated. It is demanding the abolition of the practice as a remnant of barbarous ignorance of, the laws of health. It would subordinate romantic sentiment to cautious prudence and forbid the lover to embroach his sweetheart, even as a seal of their betrothed, until they are able to produce medical certificates that they are free from the transmissible germs of disease.
For several years past prudent parents, under the instruction of their physicians, have guarded their young children jealously against the indignate kissing which was once in vogue, less those poisonous germs be transmitted to the babies. It is a reasonable precaution, for undoubtedly the danger exists, and as the germ theory of disease is more generally accepted, peril of such contact is appreciated—the more intelligently. If, then, there is a serious risk for children in careless kissing, say the preachers of sanitary science, it is a risk which older people must avoid also. Even the cherry red and paiting hips of beauty may convey maternal posing along with the rapture of love they express so romantically. The most ardent manifestation of masculine devotion may be the means of planting the seeds of disease which will bring forth a new life.

Allea Manvel, President of the Santa Fe Railroad, died on Friday morning at the Hotel del Coronado, where he arrived three weeks ago from St. Paul, for the benefit of his failing health. He was accompanied by his wife. The cause of death was Bright's disease, Mr. Manvel was born at Alexandra, Genesee county, N.Y., September 26, 1857. He entered the railway service in March, 1859, serving the Rock Island as clerk to the Purchasing Agent. His rise was steady, and he became Purchasing Agent and Assistant Superintendent. In May, 1851, he left the road and went to the St. Paul and Manitoba railroad, where he served as General Superintendent until 1859. In that year he became General Manager of the Santa Fe system, and subsequently President of the company. He leaves a widow and two daughters. The remains were interred in the cemetery at San Diego, the grave being alongside that of the late Governor Watterman.

The management of the State Industrial School at Whittier is severely troubled. Applications for admission are coming from all over California. Thirteen boys were brought to the school on Saturday, nine from San Francisco, one from San Bernardino and two from Los Angeles, and all were obliged to sleep on the floor in the halls. It is impossible to receive more boys. The success of the school is jeopardized by inordinate crowding.
