A LETTER from Richard Gird brings the information that an increased price will be paid for sugar beets at the Chino factory the coming season. Instead of $3.50 per ton and 25 cents extra for each cent of sugar above 12 in the beets, the factory will pay $3.50 and 40 cents for each additional cent. The circular issued by Richard Gird, announcing the new departure, is as follows: CHINO, Cal., January 2, 1893. DEAR SIR: I am pleased to inform you that negotiations with the Chino Valley Beet Sugar Company have resulted in an increase of price for the beets to be delivered at the factory during the year 1893, as follows: For 12 per cent beets, $3.50 per ton and 40 cents per ton for each cent above 12, in place of 25 per cent, as heretofore. This arrangement for increase of price is based upon the provision that the bounty or tariff shall not be reduced below 1 cent per pound, of which I believe there is no danger. Hoping that this arrangement will encourage you to renewed efforts in the perfection of beet culture on the Chino, and wishing you a happy and prosperous New Year, I remain, respectfully yours, RICHARD GIRD. This advance in price will average about fifty cents per ton, or a difference in favor of the farmers for the season's crop amounting to about $20,000. This is sufficient proof, Mr. Gird says, of the Oxnard's faith in the future of the beet sugar industry in Southern California and thus they have not much fear of the sugar county being taken off. This increase may have been caused by the inauguration here of the co-operative beet sugar refinery, which will pay growers who are stockholders $4 per ton for beets polarizing 12 per cent of sugar and fifty cents additional for each extra cent. Our stockholders also share in the profits of the refinery, and get their pro rata of the bounty of two cents per pound paid by the Government for the manufacture of sugar. This, it is estimated, will come, with their interests would be better subserved, and he therefore asked for an order of the Court directing the Sheriff to carry out his instructions in the case. With all duo regard to the gentleman's ability as a lawyer, learned in the jurisprudence and the laws of the commonwealth, we feel ourselves impelled to say, nevertheless, that his contention was particularly weak, and his voluminous citations altogether at variance with the points involved in the case. The Court remarked that the point to be decided was whether the Sheriff had or had not the right to publish the notices entrusted to his care. Before counsel had taken his seat Judge Towner observed that it was quite unnecessary to go into the merits of the case further, and the adjudicant of the Sheriff, together with the argument of his attorney, Mr. F. O. Daniel, were omitted. The Judge then, in a comprehensive, broad and judicially sound opinion, denied the application. He reviewed the bearing of the law upon the case, particularly that part of the statute relating to the duties and responsibilities of the Sheriff. While, the Court hold, that officer might be advised by plaintiff's attorneys regarding the carrying out of the process of the Court, still the matter was entirely discretionary with him, and he was alone responsible for the proper enforcement of the process, as well as the discharge of his duties as an officer. Not only was he bound to respect the rights of plaintiff, but those of the defendant as well, and it was doubtful whether attorney for plaintiff was the proper party to advise him in the premises or in the performance of his duty. Besides, the Court held that publication should be made at the point nearest the reality involved, even though the newspaper so selected had a smaller circulation than the other—which in this case was not the fact. If the interests of plaintiff were placed at hazard by the lack of skill or the culpability of the Sheriff the aggrieved parties could recover by recourse to law. The application was thus, very properly denied. We had too much confidence in Judge Towner's common sense and understanding of the law to believe for a single moment that his decision would be anything else. This, it is estimated, will come, with a favorable campaign, to $200,000 per year. At Chino last season the bounty amounted to something like $150,000, and the season was a short one. Four thousand acres were planted to beets, and in order to increase the coming season's output, the Oxnards, we have it on good authority, have offered Mr. Gird a premium of $10,000 to increase the area contracted for the planting of beets by four thousand acres. Thus, instead of planting five thousand acres of beets the coming season—the acreage at first contracted for—Mr. Gird will put in, under the new management, nine thousand acres, by far the largest area ever set to beets in any country. The Chino refinery will the coming season turn out probably fifteen million pounds of sugar, the bounty upon which will aggregate the comfortable sum of $300,000. With a like amount distributed among the farmers here—and with the successful inauguration of the co-operative refinery there will undoubtedly be as many acres devoted to beets here as at Chino—times will be taking on a lively air, not to speak of the aplendid returns from the growing of the beets and the net profits of the refinery. The sugar industry is destined to become the greatest factor in the industrial development of this southern section. Speed the inauguration of the refinery here. A NOVEL case came up before Judge Towner for adjudication in the Superior Court at Santa Ana last Friday, which possesses no little interest to newspapers in general, in which Mr. Victor Montgomery sought to restrain Sheriff Lacy in the exercise of the prerogatives of his office. Mr. Montgomery is attorney for the Northern Counties Investment Trust, Limited, an English corporation, which has recently assured judgment against John Cadman and others for a large amount of money, and a process was issued out of court requiring sale of property to satisfy the same. The real estate involved is situated near Anaheim, and, following the usual course of procedures in such cases, which very properly provides for the advertising of the sale of the realty in a newspaper published in the neighborhood of the same, the Sheriff selected this journal for the work. Just here we might say parenthetically that this latter "arrangement" would seem to furnish rather an interesting problem in the ethics of journalism. However, the Sheriff ignored Mr. Montgomery's dictation, whereupon the latter gentleman served notice upon him, citing him to show cause in court why he had disregarded the instructions. The whole matter, it seems to us, would make a capital text for one of Gilbert and Sullivan's operas. In his argument before the court Mr. Montgomery said that on all process issued out of court—in writs of attachment, foreclosures, replevin, etc—the attorney for the plaintiff has the right to control all things connected with the case. This right to control extends to the judgment, and he did not see why it should there discountinue. He maintained the right to instruct the Sheriff or other officer of the court in the discharge of his duties, having viewed the best interests of his clients, which he held might be made to suffer through lack of skill in carrying out the order of the court, or in other manner, as through the culpability of the officer, which same the action of the attorney might seek to restrain. In the case at issue he had contracted for the advertising in a daily, although the law requires only a weekly publication, and by this greater degree of publicity, coupled with the fact that it would cost his client no more than a publication once a week, The promptness with which Ayer's Cherry Pectoral stops a hacking cough and induces refreshing sleep is something marvelous. It is astonishing, says the Anaheim correspondent of the Los Angeles Herald, the amount of interest that is being taken in the matter of securing proxies to vote at the coming annual meeting of stockholders in the Anaheim Union Water Company held January 28th. It is charged that some interested parties are working to elect a board of Directors who will "sell out" the company to a syndicate of wealthy capitalists, who will then enpuce take bold of and run our water affairs to suit themselves. So the other side are working like beavers to secure the election of men who are pledged to frown down the scheme. And the light goes merrily on. It is a serious question with some of the stockholders in the water company whether the business could not be better and more economically managed by a private corporation than it has been by the old company.
