The Weekly Gazette. ISSUE EVERY THURSDAY. Henry Kuchel, Charles Kuchel; Kenters and Proctors. THURSDAY JUNE 12, 1890 The report of the partition commission to settle the business affairs of Orange and Los Angeles counties, and strike a balance of the liabilities of each have submitted their report to the Board of Supervisors of both counties. A synopsis of the report will be found in another column. The amount of indebtedness of Orange to Los Angeles is small compared with recent estimates of our liability which placed the probable amount anywhere between $50,000 and $75,000. According to the figures of the commission, we were indebted to Los Angeles on the 11th of March, 1890 in the sum of $15,581, and since then there has been expended for Orange county a further sum of $11,375.42 for the construction bridges, roads, etc. The commission was advised that it could take no organization of total latter sum, but there can be no reason that its legality due Los Angeles. At the end of our school census has been made noticeable foreign comment at the number of children in the district, still that remains that the census shows a decrease in the number of children compared with the last year. While last year the number returned was 670 census residents in the district, there are some other schools children like this year than usual. The reason is that, along with other cities of Southern California, the area of the moving away from our families. Other families are also interested in the districts concerned and the census consequently moves the training off. Last year a centennial celebration was held in June 1, 1890, our beloved brother, George Crockatt Knox; we, the members of Anaheim Lodge, No. 199, I. O. O. F., desire to give expression to the great esteem in which our dear brother was held by each and every member of this lodge; therefore, be it. Resolved, That in the death of our beloved brother our lodge has sustained a great loss. That although he had been separated from us for many years, having removed to the city of Los Angeles, yet we know that his heart was with us, for he had not severed his connection with his parent lodge. That he strictly adhered to and obeyed the tenets of our order, ready at all times to give advice, sympathy and help to any one in need. Resolved, That outside of our fraternal relations his character and conduct as a man in the various responsible positions in public life has been without reproach, his integrity unassailed, courteous in his demeanor, affable to all, and prompt in the performance of the duties required of him. Resolved, That the charter of this lodge be draped in mourning for a period of thirty days. Resolved, That to the stricken widow and orphans and near relatives of our deceased brother we tender our heartfelt sympathy in their sad bereavement, trusting that the omnipresent eye will watch over them and The author will be found a series of examples in mathematics which were asked to grade pupils in the school examinations over the last day. It is the universal notion that the task is unnecessarily difficult, several of the positions being such as scholars being interested in understanding their own position on the course of study and how to use the text books. Of course, a similar task was shown that was less than satisfactory. Why do questions should be presented in this way? It is exceedingly easy to say, but any one look over the paper says whether the County Board of Education have acted wisely or not. The silver bull passed the House on Saturday at 12:30 noon. The prospect that sometime we will be able to rehabilitate the partially disarmed soldier is already sent up its price from 122 cents to 147 cents. The Lady Bug A few weeks ago there was quite a warm dispute between the Los Angeles bug commissioners and some fruit growers at Vernon about the spraying of fruit trees in that section for the red scale. Mr. Cass of Vernon maintained that the red scale was rapidly disappearing from his orchards under the onslaught of a small bug known as the "twisted ladybug." The commissioners—two of them, says the Los Angeles Times, were interested in washes or disinfectants—just as strongly asserted that this was impossible, and that the only remedy was to spray the trees, which they ordered to be done. The Vernon fruit growers, who, like their horticultural brethren in other sections of the State, have learned by bitter experience the fact that sprays and washes are frequently not only useless, but positively injurious, refused to comply with the directions of the commissioners, and the wisdom of their course is made fully apparent in the report which the commissioners have submitted to the Supervisors. From this report we print the following passages: We take great pleasure in rendering to you a report of our personal inspection of the orange orchards in Alhambra, San Gabriel, Llamanda Park and Duarte during the past month. The condition of the oranges in these localities, and all others in the San Gabriel valley, during the last three or four years has been lamentable and alarming, on account of the presence of the red scale insect. As the result of our inspection, we can report that throughout this valley the red scale has become almost annihilated, probably 95 per cent being destroyed by some agency, the origin of which cannot as yet be determined. As the result of this blessing, orange growing has taken a new impetus, and the growers are in a happy and hopeful mood. We found the larvae of the twice-stabbed lady-bug and the lace-wing fly in vast numbers, greater than ever before. Both of these parasites are known to prey upon the red scale, although not confining themselves entirely to this means of sustance; still, appearing in such numbers, we naturally conclude that they have very materially added in reducing the red-scale insect. The months of July and August will determine as to the permanency of the disappearance of this pest, and until such time, on account of the danger of destroying existing He is another correspondent who asks for information. Fiction Gavrine. In 1875 I paid an irrigation tax on land which I owned in Section 36 this county, but from that day to this I am ignorant as to what purpose that so called irrigation tax was imposed, as the land referred to was not benefited by any irrigation that I am aware of, nor have I learned what disposition was made by the amounts collected at that time, or whether said amounts were returned. Whether the tax was continued to land in Anaheim district or to the county generally I am not prepared to say and if you can throw any light on the subject by explaining the matter through your paper I think it would be of interest to some of your readers as it certainly would be to me. Yours very truly, LANPAYER. Anaheim, June 3, 1890. The tax was levied under what is known as the Fush Act, passed by the Legislature in 1873, providing for the promotion of irrigation works. The money was used for the improvement of the district—probably in the construction of the Cajon ditch. The proposed lottery amendment to the Louisiana Constitution embraces a contract between the State and John A. Morris and associates under which for lottery privileges for twenty five years from January 1, 1891, Morris and associates agree to pay the State $25,000,000, or $1,000,000 per annum, payable quarterly. The Parish Commission Promises These Reports to the Supervisors: The printed report of the board of commissioners appointed to adjudicate the matters of liabilities between the counties of Los Angeles and Orange, showing the indistinctness of Orange county to Los Angeles on March 11, 1899, and other matters pertinent to a final adjudication and settlement of the business affairs between the two counties, was presented to the respective Boards of Supervancers of both counties per Monday. The commission was composed of R. Egus, chairman; Charles R. Johnson, James McPadden, commissioners, and John M. Baldwin, Secretary. The board formally organized for business on December 4th at Los Angeles, George C. Knox, since deceased, being them its secretary. The following is a synopsis of the important document, for which we are indebted to the Los Angeles Times. It is not necessary in this report [any the commissioners] to give in extreme the proceedings of the board of commissioners-in-partition at their stated sessions, as a reference to the formal minutes kept by the board will give to any one desiring such information the details of these proceedings, but there were certain questions brought up in the deliberations of the commissioners which could not be determined by them without advice from eminent legal authority. At the stated session of the commission, on the 21st day of March, 1890, it was ordered by the board that A. W. Hutton, Esq., who had been counsel for Orange county in the legal proceedings which had been instituted to determine the constitutionality of the act creating the county, who was thoroughly familiar with all the questions which might arise in the business settlement which was required to be made, be employed to give the board his opinion in writing regard to the questions in controversy. The questions asked Mr. Hutton by the commissioners were as follows: First—Assuring that its division of the assets and liabilities should be made on March 11, 1890, and assuming that its proportion is one-tenth of the whole, should not Orange county pay one-tenth of the expenditures in the several funds which are used by the county as general funds between the dates above given, viz.: March 11, 1889, and August 3, 1889? Second—Is Orange county entitled to one-tenth of all the receipts coming into the several funds above alluded to between the dates above given, viz.: March 11, 1889, and August 3, 1889? To explain more fully the above questions, the board stated that the general funds necessary to run the county, and which were considered to be appropriate for both counties on the same date was $274,734.43. The commissioners next determined by several sets of tables showing the detailed assets belonging to the original county of San Diego县 in Orange County on the same date was $274,734.43. The Board of Patronage Committee when the consideration of public money and relevant costs was reviewed did not consider the following funds in the matter of the settlement between the two countries. The general school fund, under the control of the County Superintendent of Schools, and which can be aggregated by him only into the funds of the several school districts comprising the county. The State fund, belonging to the State, and which at the proper summons is always paid by the County Treasurer to the State Treasurer. The county redemption fund, money paid into the county treasury by partisan lands have been sold by the Tax Collector to private individuals, and which money belongs to the individual purchaser of realty. The State redemption fund, which is a similar fund to the county redemption fund, except that the moneys therein belong to the State. The teachers' institute fund, which is a fund under the control of the County Superintendent of Schools. The estate of the deceased persons' fund, under the control of the Public Administrator. The State tide-land fund, in which the county has no direct interest. The interest and sinking fund of 1875. The amount of money in this fund on March 11, 1889, was a balance which was drawn for one $500 bond, with the accrued interest thereon, said bond having been called in for payment. It was not presented for payment until March 31, 1889, when it was paid. The rebate fund established for the purpose of paying to taxpayers any amounts of money which may have been paid by them in excess of the taxes properly due from them to the county. The school-building funds of the different bonded school districts, the funds of which belong to the holders of the bonds. The road district funds, under the control of the Board of Supervisors, appropriated especially for determined localities. But the commissioners placed on the list of assets that were to be divided between the two counties following funds, which are used by the Supervisors for the current expenditures of the county: The current expense fund, salary fund, general road fund, hospital fund, courthouse and jail fund, interest and sinking fund of 1881, interest and sinking fund of 1882, interest and sinking fund of 1884, interest and sinking fund of 1885, interest and sinking fund of 1887, unappropriated money fund—a part thereof, and delinquent tax fund—a part thereof. The total of these several funds was $244,793.43. The commissioners next determined by several sets of tables showing the detailed assets belonging to the original county of San Diego县 in Orange County on the same date was $244,793.43. It is impossible that Maryland and Washington had acquired from highways. However was a widely impenetrable force. The Aldrich Depot and Wampanoag words are none to English than Sunday's farm name. The salary fund is principally maintained by receipts from the Recorder, from the County Clerk, and from the Sheriff, and it is this fund more particularly that they desired to call his attention and consideration. In reply to the commissioners' queries, Mr. Hatton was of the opinion that the division of the property and assets and liabilities should be made as to the date of March 11, 1889; and that the board should not take into consideration any increase or decrease of the value of property, or in the debts or liabilities of the county of Los Angeles, or any of the expenses of carrying on any of the business of the county since the 11th day of March, 1889; and he thought that Orange county should not be required to pay any part of the receipts coming into any fund of Los Angeles at any time since that date. The Legislature had in effect enacted that Los Angeles county should bear all of such burden, and that Orange county should be deprived of all such benefits. Though unnecessary to be expressed, Mr. Hutton was, however, of the opinion that if the county of Orange was to be charged with any share of the expenses since that date, it ought to receive credit for its proposition of the receipts during the same time. On the 14th day of April, 1890, several banks holding protested unpaid county warrants appeared before the commissioners, in regular session, by counsel, and requested that the board should take cognizance of the fact that certain banks and individuals held liabilities of Los Angeles county, which then due and unpaid. These protested warrants presented to them for consideration and unpaid, ran from 1879 to 1884, and as shown by the treasurer's books, were drawn upon the following funds aggregating the following amounts: Current expense fund $2974.50 Hospital fund $136.00 General road fund $502.00 Various district real funds $14,752.67 School district funds $650.00 School building funds (including two bonds) $2,264.00 Making a total of protested warrants of... $191,319.17 Mr. Hatton, after examining into the matter, reached the conclusion that the warrants were not part of the indebtedness of Los Angeles county, existing on the 11th day of March, 1889. In order to reach the conclusions which are presented in the certificate to the two Boards of Supervisors, as required by law, it was necessary for the commissioners to make an exhaustive and thorough search into all the business affairs of Los Angeles county from the year 1853, when it first set up in business for itself, up to March 11, 1889. They also had to ascertain the assessed two counties the following funds, which are used by the Supervisor for the current expenditures of the county: The current expense fund, salary fund, general road fund, hospital fund, courthouse and jail fund, interest and sinking fund of 1881, interest and sinking fund of 1882, interest and sinking fund of 1884, interest and sinking fund of 1885, interest and sinking fund of 1887, unappropriated money fund—a part thereof, and delinquent tax fund—a part thereof. The total of these several funds was $244.793.43. The commissioners next determined by several sets of tables showing the detailed assets belonging to the original county of Los Angeles, the total liabilities and the balance of assets in excess of liabilities on March 11, 1889, to what amount of said balance of assets Orange county was entitled. Deducting from the value of the assets contained in Orange county, belonging to it in accordance with the terms of the act creating it, the balance of the general assets to which that county is entitled, there remained due Los Angeles county a balance of $15.581 on the 11th of March, 1889. The commissioners in partition after that date expended for Orange county exclusively a further sum of $11.375.42 for the construction of a bridge, divers roads, and the caring of Orange county patients at the Los Angeles hospital, which sum they say is justly due by the sister county. The following is a list of questions in arithmetic asked the eighth grade scholars of the county in recent examinations. They were prepared by the County Board of Education among whom it is said there prevailed considerable discussion as to the advisability of adopting such difficult examples. It is understood that series was made out by Prof. Keran of Santa Ana. The examples are unusually "tough," as will be seen by perusing the list, which is as follows: Arithmetic—Eight grade — Fifty credits; five credits each. These values, being determined, were to form the basis for the proportion to be used in settling the indebtedness between Orange and Los Angeles counties. To obtain these values, the entire assessment roll of Los Angeles county for the year 1888 was carefully gone over, item by item, and showed the total assessed value of Los Angeles county to have been $101,796,099, and the total valuation in the territory set apart for and designated as Orange county, $10,012,334. The proportion, therefore, of the balance between the indebtedness and assets which should be allotted to Orange county was 1 in 10,1671. The total amount of indebtedness of Los Angeles county on the 11th day of March, 1889, consisted of, first, the bonded indebtedness of Los Angeles county, with the accrued unpaid interest of said indebtedness at that date; second, school bonds, which are bonds levied upon certain special portions of the county, designated "school districts," by a vote of the people living in said districts, and the purposes for which the bonds have been issued being to erect schoolhouses in said districts, any unpaid warrants regularly ordered by the Board of Supervisors of Los Angeles county, and legally issued by the Auditor of the county in payment of proper county charges or debts which, on that date, remain unpaid. ASSETS OF THE TWO COUNTIES. Next the real estate owned by Los Angeles and Orange counties, together with the improvements thereon, had to be accorded. This is valued as follows: Los Angeles county ..... $444,600.28 Orange county ..... 1,700.68 Then came the valuation of bridges, a most difficult undertaking, but after very arduous labors the commission determined that the value of bridges standing on March 11, 1889, in the territory at present known as Los Angeles county, was $99,917.43, and A borrowed B $1,000 for one year at 1 per cent per month paying him the interest in advance. At the expiration of the time A wanted the money for another year. "All right," said B "pay me the interest and you can have it." A not having the money gave B a check for $240 and said "give me credit for the balances of the note." What amount should be credited on the note? A tailor sold a suit for $60 and lost 20 per cent.
