Inexamble Waste.
The writer has had occasion recently to travel through a dozen or more of the prominent agricultural counties of the State, and during this trip has noticed two things which go far toward explaining the reason for the claim that the farmers are undergoing a season of depression, or "hard times." First is the waste of manure which may be seen almost everywhere. It is the exception to find any use made of the accumulations about the stable and corral. These are sometimes seen deposited in great quantities in gullies or riven-beds in the effort to get them out of the way with the least trouble possible.
ARBITRATION.
Copy of Agreement Between Captain Wrode and the Arbitration District.
Following is the agreement to arbitrate the water rights of Captain Wrode, mention of which was made last week. As the document pursues unusual interest to all values in the irrigation district, it will doubtless be given a careful personal:
This agreement, made and entered into this 20th day of February, 1890, by and between the Anaheim Irrigation District, a body daily and legally organized and existing under the laws of the State of California, and having its principal plans of business in the city of Anaheim, county of Orange, State aforesaid, party of the first part, and Henry Wrode, a resident of Anaheim Irrigation District, county and State aforesaid, party of the second part.
Witnesseth: That whereas the party of the first part has been daily organized and is now existing under the laws of the State of California, under the provisions of the Act of the Legislature of this State entitled an Act to provide for the organization and government of irrigation districts and to provide for the acquisition of water and other property, and for the distribution of water thereby for irrigation purposes, approved March 7th, 1887, and the several new amendatory thereof and supplementary thereto, for the purpose, among other things, for acquiring lands and waters, water rights and other property necessary for the construction, use, supply, maintenance, repair and improvement of canals, works, reservoirs, for the storage of needful waters, and all noxious appurtenances in said Anaheim Irrigation District for irrigation purposes for the use and benefit of said district and the lands therein situated.
And whereas said party of the second part hereto is the owner or claims some interest in and to certain water and water rights so sought to be acquired by the party of the first part situated within said district and more specifically described as follows,

In many cases great piles of manure are seen, which must have been in years accumulating, but it is the exception to find a farmer who makes the proper use of the means at his disposal for returning to the soil the elements of which it has been deprived by a long-continued course of heavy cropping. Were the manure used steadily, as might easily be done, there would be no such large decrease in the average wheat product as has been noted since agriculture became the leading industry of the State, and as a necessary incidents the profits of the farmer be considerably increased.
The other avenue of loss is the unexcusable carelessness with which farm machinery, often of the most expensive kind, is treated. Preparations are now being made for the coming grain harvest, and on every hand the blacksmith shops are crowded with machinery awaiting repair. In nine cases out of ten those machines show signs of exposure to the storms of winter, and the greater portion of the repairs needed owe their existence to such exposure. The woodwork of headers and other machines is weather beaten and cracked, the iron is rusted and ready to break at the least provocation, and machines which, with proper care, would last ten years are almost worn out in three or four. In many places costly headers and other machines may be seen standing in the open air, some with no other shelter than the branches of a tree, and it is the exception to see farm implements of any kind properly housed.
The result is obvious. There is a constant demand for repairs and for new machines of various kinds which consumes hundreds of dollars annually, and correspondingly decreases the profits of the farmer. Indeed, between the waste of manure and the careless handling of machinery it becomes a matter of wonder that there are any profits at all.—Chronicle.

and whereas said party of the second part hereto is the owner or claims some interest in and to certain water and water rights so sought to be acquired by the party of the first part situated within said district and more specifically described as follows, to-wit: The water right to $0.24 acres, first-class land, Cota tract, Rancho Canon de Santa Ana.
And whereas the parties of the first and second part hereto are unable to agree upon the compensation to be paid by the party of the first part to the party of the second part for the interest, right, title and estate in and to said waters and water rights, but are mutually desirous of determining and adjusting the amount of such compensation without litigation, and by arbitration.
Now, therefore, as parties hereto mutually agree one with the other, and in consideration of the premises, and for the purpose of determining and adjusting the amount of such compensation without litigation and by arbitration as aforesaid, the party of the first part agrees to name one person who shall act as such arbitrator, and the party of the second part agrees to name one person who shall also act as arbitrator, and if these two persons cannot agree as to the sum and amount to be paid by the party of the first part to the party of the second part, as such compensation as aforesaid, then and in that event she said two arbitrators shall jointly name a third person who shall act as an arbitrator, all of whom shall be non-residents of the county of Orange aforesaid. That the first two persons named, or in the event that they cannot agree as aforesaid, then the three persons above named shall constitute a board of arbitration with full power and authority to hear the allegation of the parties, take such evidence as may be presented to hear and determine all questions of damage to the party of the second part, or compensation to be made by the party of the second part for his interest, right, title or claim in and to all waters and water rights within the said Anaheim Irrigation District, county of Orange aforesaid, which might or could be acquired by the party of the first part under the statute in such case made and provided, and to make award thereon and in consideration thereof, it is mutually agreed between the parties thereto that when said award shall have been made and amount of compensation shall have been determined by said Board of Arbitrators as aforesaid, then the party of the first part hereby agrees to pay to, and the party of the second part agrees to receive from the party of the first part the amount so awarded and determined by said arbitrators as aforesaid, as full compensation for the right, title, interest and claim of the party of the second part in and to said waters and water rights owned or claimed by the party of the second part within said Anaheim Irrigation District and subject to condemnation by the party of the first part as aforesaid.
And it further stipulated and agreed that this submission to arbitration shall be filed with the County Clerk of Orange county aforesaid, and be entered as an order to the Superior Court thereof, and that when said arbitrators shall determine the amount of said award, they shall make it in writing, and any decision derived as by said arbitrators or any two of them, shall be filed with the Clark of said Court with their report

And it is further stipulated and agreed that this submission to arbitration shall be filed with the County Clerk of Orange county aforesaid, and be entered as an order to the Superior Court thereof, and that when said arbitrators shall determine the amount of said award, they shall make it in writing, and any decision derived as by said arbitrators or any two of them, shall be filed with the Clerk of Court with their report thenceon, and shall be entered as a judgment of said Superior Court in favor of the party of the second part and against the party of the first part.
And that upon the payment thereof by the party of the first part to the party of the second part of said amount no awarded as aforesaid, the party of the second part agrees to convey to the party of the first part, by good and sufficient conveyance, all of his claim, right, title and interest, in and to the waters and water rights within said Anaheim Irrigation District as are subject to condemnation by the party of the first part for the purposes aforesaid, and especially to the waters and water rights above set forth and described.
It is further mutually agreed by and between the parties hereto that the payment of the amount of compensation and of the award so made as aforesaid shall be made by the party of the first part and received by the party of the second part, as follows:
to-wit: The party of the first part shall at its convenience within ninety days from the date hereof institute proceedings in the Superior Court in the county of Orange aloosemid, against all parties by it deemed necessary or proper for the condemnation to its use of all waters and water rights initiated within said Anaheim Irrigation District including the party of the second part herein.
And the party of the second part hereby agrees that upon each proceedings being instituted, he will forthwith appear in said Court and cannot without the service upon him of summons or other promenna and will submit his claim for compensation upon the request of said Board of Arbitrators; and it is hereby further or mutually agreed by the parties hereto that the awards no made by the Board of Arbitrators to the party of the annual part, and the amount of compensation no fixed and determined by them to be paid by the party of the first part in the party of the second part as aforesaid, shall be and constitute an award and amount of compensation to be fixed and determined by the Court in said case to be paid by the party of the first part in the party of the second part; and further mutually agreed between the parties hereto and when a final

It is further mutually agreed and stipulated that any award made by said Board of Arbitrators, or any of them, shall be filed in the office of the Clark of the county of Orange, and delivered to each of the parties hereunto on or before the 1st day of July, 1800.
In witness whereof, the said party of the first part, the Anahaim Irrigation District, has canned them presents to be signed, excused and delivered in its corporate name, on its behalf, by its President and Secretary, and has caused its corporate seal to be affirmed in attestation thereof, and the said party of the second part has hereunto set his hand and seal the day and year first above written.

We presume the importers will now say they cannot live on three-year-old trees.
The orange season is drawing to a close in Southern California. Shipments to date aggregate over 2,200 carloads, or about 660,000 boxes. There are not over 200 carloads left, which will probably be marketed during May. The total crop of the season aggregated about 800,000 boxes of oranges and lemons, valued at $1,500,000. Over half of the crop, about 1,400 carloads, was produced at Riveraide. The orange groves in Los Angeles county are mostly of the seedling variety, which did not bear heavily this season. The crop of oranges in Southern California for 1891 promises to be 4,500 to 5,000 cars, of which Los Angeles county alone will produce over 2,000 carloads.
Supt. Porter has sent an order to all supervisors of census stating that it has been called to his attention that the city councils and boards of trade of certain western cities have appropriated sums of money to aid their census supervisors in the enumeration of the population. Porter says while it may be urged by some that such proceeding is legitimate and merely intended to help the Government, he is compelled to look upon it as an irresistible temptation to fraud, and consequently endangering to an honest count of the people. Supervisors are warned against receiving any compensation, or allowing subordinates to do so, in any manner except from the Government.
Judge Coffey of the San Francisco Superior Court made an important ruling last week, in reference to a question raised by Harvard University as to the proper construction of a clause in the will of A. C. Whitcomb, who died in Paris, leaving an estate valued at $4,000,000. Whitcomb left to his nephew, Adolphas Darwin Tuttle, and to the latter's son, Charles Whitcomb Tuttle, all interest in the Jimeno rancho in the counties of Colusa and Sutter, Cal., and he recommended to his nephew to leave his portion thereof after his own death and the death of his wife, in trust for said Charles Whitcomb Tuttle and to his children and descendants, if any be alive at the death of his said son; and if there should be none alive, to Harvard College, at Cambridge, Mass. Last month the elder Tuttle applied to the Probate Court for a decree distributing to him absolutely one-half of the Jimeno rancho. Harvard College opposed the application on the ground that Mr. Tuttle was only entitled to an interest in the property. Judge Coffey decided that A. D. Tuttle is entitled to his interest in the ranch absolutely, and his son takes the other half, and is entitled to an immediate decree of distribution.

The Banker's Monthly, which surely would not over-estimate the matter, in speaking of the farm mortgages in six of our best States, gives the amount carried by each as follows:
In this way there could be secured a personality, and a comprehensive idea could be given of the styles, habits and products of each nation, which could not possibly be secured in any other way. California's building and its accompanying example of ancient adobe with its tiled roof, could be approached through avenues of tropical verdure and surrounded by orange and lemon groves for at least a portion of the year. These could be replaced during the cooler season with ornamental trees, vines and fruit trees, realistic gold mines and marble quarries. In the buildings everything from the digger Indian and grizzly bear to the choicest and rarest of our products would be suggestive of California and for the time being one could imagine himself transported to the "fair land of the afternoon." This plan would diffuse the enormous crowds and would save the jam incident upon such occasions. The land to be occupied by the nations and States should be so allotted as to be easy of access by swift transportation. Of course it would be necessary to erect large buildings at some convenient point for the purpose of the National Government exhibit, competitive machinery exhibits, auditorium, music hall, art gallery, etc.
Large and Small Farms
The relative profit of large and small farms, says the National Stockman and Farmer, is one of the matters which bids fair to never be thoroughly settled to the satisfaction of everybody. Like the question of deep and shallow plowing, and the best time to spread manure, this is like to continue to be vexed. Some of our readers are now discussing it in the Stockman, and with the usual non-conclusive result, except so far as defining for each more clearly than before the outcome of his own experience and observation. In theory it would look as though if a small farm could be made to pay a larger one, with the same outfit of tools, the same management, and the same main buildings to be kept up, would pay still better; and with many men of excellent executive ability it undoubtedly does. On the other hand the smaller farm ought to be and certainly can be better tilled, and is usually made more productive per acre, giving an increased product in proportion to the amount of capital invested; besides requiring less taxes, fencing, etc. The popular ideas seem to be that "a little farm well killed" is about the thing. But this is one of the things which very largely "depends."
Capacity of the man has much to do in solving the problem in each particular case.

The Banker's Monthly, which surely would not over-estimate the matter, in speaking of the farm mortgages in six of our best States, gives the amount carried by each as follows: Kansas $235,000,000, Indiana $645,000,000, Iowa $567,000,000, Michigan $500,000,000, Wisconsin $357,000,000, Ohio $1,127,000,000.
Here are mortgages on the farms of only six States aggregating $3,431,000,000, the interest on which at 6 per cent amounts to over $200,000,000.
Now the whole production of gold and silver in the United States per year is not half enough to pay the interest on the farm mortgages of six States. And yet these same bankers are demanding the destruction of treasury notes, the demonetization of silver and the establishing of a gold standard. Nor are the bankers alone in this demand—the boss politicians in both Republican and Democratic parties are trying to bring about the same state of affairs. And the farmer, what is he doing? Well, he is economizing, earning the ring politician and voting the old party ticket.

We seem to have come upon an era of low prices, and there is talk all along the line similar to that heard at farmers' meetings, and there is a struggle among all classes against the reduction of income which the day of small profits has brought with it.
The strong corporations and great trusts which have a temporary monopoly of their particular products are able to sustain prices, but the rest have gone tumbling down and it is only a question of time when trusts must follow. If farmers' products rule low, the profits of others cannot long rule high.
The attempt to prevent it is a struggle against the inevitable. Such period of depression, for they have come again and again in the history of every country, are hardest on the debtor class, whose incomes shrink, while their debts, interest charges and taxes still hold their own, and it takes twice as much labor and twice the quantity of farm and other products to pay a dollar of debts as in the flash times which go with high prices. Those who are out of debt are comfortable in flush times or hard times.
