EVENTS OF THE WEEK.
Demurrer Filed Against the Irrigation District.
The Yorba Again Object to Its Formation—The Hearing Takes Place at Santa Ana Te-Horrow—Sugar Beets Matrimonial—Central City Lande Orange County Valid.
The Board of Directors of the Anaheim Irrigation District met in regular session on Tuesday. Present, President Hunter and directors Zayn and Ryan. The minutes of the previous meeting were read and approved.
The Secretary was instructed to procure an audit of publication of the original petition presented to the Los Angeles Board of Supervisors, calling the election to vote upon the formation of the district; the name to be presented to the Superior Court of Orange County on December 5th. He was also instructed to have all papers and books ready for the inspection of the Court.
The committee appointed to confer with Mr. White, attorney of the Yorba, received having seen Mr. White, who assured that it was his intention to forward all relations between this district and the Yorbas friendly manner as possible.
At the time for bringing condemnation for the acquisition of the property of the Anaheim Water Company and the Yorba, the committee appointed for that purpose reported that the same would be instituted without delay, pending the decision that the court upon the petition now before it, attorney of the district stated to the said that he had been notified by Mr. White that the Yorba would interpose a barrier to the hearing of the petition in the Superior Court at Santa Ana to-morrow. He shunn was unable to say upon what grounds the demurrer is taken, and returned to Los Angeles to give the matter his attention.
Bills were approved and the board ad-venured until next Monday at 10 o'clock.

ORANGE COUNTY IS VALID.
The Legislature Did Not Delegate Its Powers in Calling an Election.
In an opinion rendered on Wednesday of last week, and mentioned in our last week's report in the several cases of The People ex. Graves vs. W. M. McFadden and others.
The People ex rel. Graves vs. the County of Orange, and The People ex rel. Graves vs. the County of Orange and others, the Supreme Court sustained the decision of the lower court, dismissing them on demurrers, as well as the merits of the cases.
The santa, which were of like character and brought by one person, involved the constitutionality of an act of the Legislature of the State of California, approved March 11, entitled "An act to create the County orange, to define the boundaries thereof, to determine the county seat by an election, to furnish for its organization and of officers to classify the county."
The plaintiff contended that the act mentured was a delegation of legislative authority and was therefore void. The Act named provided that it a certain date, specified in an election should be held in the county of Los Angeles to determine whether new county should be formed or not. Would two-thirds of the qualified electors favor the proposed change the act intend into effect; if less than two thirds in favor of the change the act carried any force or effect.
The defendants contended, while acknowledging that the Legislature had no power to enact its authority, that there was no delay of power in this case, and the court would this contention.
The opinion on this point is based upon general decisions of like character already entered and upon Cooley's work on Constitutional limitations, in which the author is not always essential that a legislative action should be a completed statute, which must in any event take effect as a law at the time it leaves the hands of the legislative department.
A statute may be constitutional, and its effect may be made to depend on some subsequent event. Affirmative legislation may in some cases be adopted, of which the parties interested are at liberty to avail themselves or not at their option.
For like reasons the question whether a county or township shall be divided and a county formed, or two townships or school districts formerly one united, or a city matter be revised, or a county seat located at particular place, or after its location removed elsewhere, or the municipality conduct particular debts or engage in a particular improvement, is always a question which with propriety which may with propriety be referred to the voters with municipality for decision.
Other minor points, in which it was conceived that the act of March 11th conflated with various sections of the Constitution, were disposed of in favor of the defenders and Justice Fox's opinion was concurred by Beaty, C. J., Thornton, J., McFarland, Chapstein, J., Works, J., and Paterson, J.

Central City Colony Lands.
Mezzra, G. W. Van Alstine and P. A. Stanton, real estate agents of 12 south Fort street, Los Angeles, made a pleasant call at this office on Monday. They represent a syndicate of capitalists who own 2-600 acres of choice land in the Centralia Colony, embracing sections 6, 7, 8, 17, 18 and 19, and are making active preparations for placing the land on the market, which will be subdivided into 20 and 40-acre tracts and will be sold to actual settlers for from $25 to $65 per acre. These gentlemen who have the exclusive right for the sale of this land, are enthusiastic over the ultimate prosperity of this entire section and will do all in their power for the advancement of the country. They report many inquiries are being made by intending settlers in regard to Anaheim lands, and we may confidently expect a large influx of people here the coming season.
Is the Vine Disease Fast?
Dr. Pfeninger informs us that Mr. H. Wehmeyer has purchased 2,000 grape outings from him and will set them out immediately on his place on West street. Mr Wehmeyer is satisfied the grape disease has run its course, and that all danger from its ravages is past. He is an experienced vineyardist and has studied the wine business for many years. His decision that the disease is a thing of the past is based on the fact that those of the vines in this neighborhood which have withstood the ravages of disease are so inoculated that the poison of the bacteria will henceforth not affect them. This is in conformity with the theory of vaccination to prevent smallpox. More will be said of the matter later.
Board of Supervisors.
The Board of Supervisors met at Santa Ana on Monday and among other things allowed a stove and a hatchack to be placed in the Superior Court room. Supervisors Spurgeon and Smith were appointed a committee to supply the wants of the court. The board was informed of the fact that the Supreme Court had sustained the legality of Orange county.
A demand of Sheriff Harris accompanied by a communication was received. At a previous meeting Harris presented a claim for feeding jurgies at 30 cents each. The board thought the amount too much and reduced it to 25 cents, and approved the claim, with the deduction. Mr. Harris refused to accept the amount in pay for the claim, and threatened to bring suit unless the full amount is allowed. On motion the claim for 30 cents was denied, it not being considered a proper charge.
A petition from the Sheriff asking that four deputy collectors be allowed him was received, and on motion was granted,the depeties to receive $2 per day.
Attention is directed to the management of Rampan Brothers, who tend in another edifice.

Sugar Meets
The hopeless position of our farmers could hardly be more clearly shown than the position they are placed on the sugar-best question here we have presented to our notice most profitable industry, but not only are prevent from building a refinery ours by the knowledge that the sugar trust would crush it out with its overpowering capital, but the trust itself, like the dog in the manger, refuses to build a refinery for it. And then when the refinery is built a market is afforded our sugar beats, the price we get for the beats will bear no relation to the price of sugar or to the profit made by the refinery. Neither will we be allowed to take our beats to the refinery and get the sugar extracted and turned over to us with a reasonable refinery charge deducted. We hope farmers will soon come to realize that their capital is to-day about the only capital employed in productive industry that is engaged in competition. The other capitalists have seen that to live there must combine and, combined they can.
The day-of war between sugar refineries between railways, is over, and we hope the day of war between the farmers will soon be a matter of history. Farmers, Nationalism only resort to escape rein and we hope every farmer about this section will enroll in the list of membership by the Farmer Nationalist Club of Australia. There are no charges of any kind either for citation or for dues. The next week morning will be held in Kraeger's Hall next Saturday at 3 p.m., for the election of officers and discussion of affairs of interest to all, particularly to farmers. We hope the meeting will be largely attended.

Mrs. B. F. Kellogg, who has been visiting lands and relatives in Penderson for several days, returned home Tuesday evening.
Surveyor Wend and Deputy P. D. Brown, accompanied by Joseph and Ralph Blair, are surveying a county road from Tustin to Airport.
Nightwatchman Hilery have been appointed lampfighter for the city. His multifaried duties are making him better looking at more baldheaded every day.
John Everharty had a narrow muzzle the day from being kicked in the face by violence harms. As a consequence John will bear a small plaster over his eyebrow for a few days.
Mrs. Barahart and daughter arrived in town on Monday from Maime. There are natives of J. L. Holley, the Garden Grove make man, and will make the Grove their home.

While Mr. and Mrs. Dr. Cowx were returning home from Los Angeles in their private conveyance one day last week their home became unmanageable and ran away. Both received painful injuries, but are now resting as comfortable as possible.
The wife of J. Y. Anderson of Westminster died on Tuesday of last week, aged 49 years. She was universally known throughout this section, and the stricken family have the heartfelt sympathy of a large circle of friends.
There is a great demand for nursery orange trees at Riverside during the present season. The stock in hand was supposed to be far beyond any possible need, but from the present outlook all the home grown nursery trees are likely to be disposed of before planting time.
G. W. Lang of Texas is now on his way to Anaheim driving 3,000 head of cattle which will be pastured somewhere near here. Mr. Lang was formerly associated with our townman Jacob Everhardy in the cattle business in Washington Territory.
Jose Malendrue, the horse third captured at Bakersfield and brought back here by Constable Landell, was convicted and sentenced to five years imprisonment at San Quentin. It is a great pity that his confederate emptied.
It is said that Mr. Gilman was lately offered $6,000 for his orange crop, on the trees by the Karl frist company. As several other buyers are desirous of purchasing a bid for the crop, no trade was made. The Gilman orchard is one of the finest in the county and their year's crop is specially good.
It is reported here that Miss Amy Rexton, formerly of Anaheim, while on her way to Chima as a missionary met a handsome young gentleman who was on a like mission journeying to Japan. A brief courtship spring up between the two and becoming favorably impressed with each other, they were united in the holy bonds of marriency.

John Landell invited several of his friends to a Thanksgiving dinner at his home at Centralia last Thursday. The party rode out to the colony on horseback and a pleasant day was spent. Among those present were Miss Sophie Rimpins, Miss Lda Everhardy, Miss Edith Glottrier, Miss Kate Centre of San Diego, and Mamra Frank Rimpan, John Snythe, Fred C. 9myths, John Landell and others.
Our job office has been busy this week turning out the yearly pamphlets and prime list of our interesting nursery man, Tim Carroll. His nurseries are the largest in the State, and are presented by the Board of Ring Junction to be free from all insurance benefits. Tim Bellamy in a liberal one of pension hikers and as a natural consequence his name are large. The establishment will be opened to day.
Thanksgiving Day was appropriately observed by our citizens. Business was generally suspended and fugs flouted from the homesites. In the evening the ladies of the Industrial Society spread an old-fashioned New England dinner at Kranger's Hall and many hearty appetites were entertained with the bountiful delicacies with which the tables were spread.
Mrs. Lemans Parker, mother of Rennet Parker of Company pilots cut for a drive in company with her daughter and little grand-daughter; on Friday morning, and with quite an audience. A young man on himself joined them, and their home became bright enough to sign the Chicago Post square this morning. In some regions they had fallen through from windows with visible damage from high winds.
