THE WATER QUESTION. How the Wright Bill Will Affect Us. Advantages to Yorba by Being Included in the District Water Supply Gradually Limiting Probable Action of the Supervisors in the Matter Their Powers Defined Editor Gazette — Last week I showed that we lose twice as much water as we use and this without taking into account the waste in the Yorba ditches, which must be half the water which enters at the head of the ditch. Now, I propose to show the advantages to be derived by the Yorba district by being included in the new district. The Yorba district claims some 470 acres of first-class lands under their ditch, and the court in settling the Yorba estate declared all the water right to be on their first-class lands; and the third class lands, some (290) acres as they claim, being all the sandy land along the river, was by the court allowed only such water as was surplus after the first class had all they wanted, and this was acted upon till our first petition for the Wright bill, when men on the third class lands were in favor of the Wright bill. Then the first-class land owners offered the third-class land owners full share. But how can these men thus dispose of the water of the river? I claim that the surplus water belongs to the Anaheim district quite as much, and more, by prior use than to the third-class lands of the Yorba district. And I affirm that by going in for the Wright bill these 1,990 acres would get a title to their water which they do not at present possess; therefore, the bulk of the Yorba district would be benefited by the Wright bill. Again, there are hundreds of acres of fine land lying in the Yorba district above their ditch and yet less our ditch, which cannot now be irrigated, as it is outside of our district. This could be irrigated and settled and thereby improve this district, which means improving the whole of the individuals of the district and take away that isolation and exclusion from the district which its present narrowness necessitates. Again, I want to show that financially the Yorba district would be improved, apart from the increase of irrigated lands and population. Section 16 of the bill states that "Nothing herein contained shall be deemed to authorize any person or persona to divert the waters of any stream, stream, canal or ditch from its channel, to the detention of system of works. Thus their action was simply maitreating the plain English. The lands not benefited by irrigation which should come under the sentence and for which it was plainly intended, are as follows: (1) Poor river beds, to which irrigation would be no benefit. (2) Hill lands, which though in the district cannot be irrigated. (3) Naturally moist lands, which though in the district boundaries do not require irrigation and are not benefited by it. (4) Artisan lands, where a natural supply of water can be found and where irrigation would not be a benefit. All these lands are to be accepted from the district and from taxation, for the district and the sentences' could not have been put in planner or more easily understood language, and I am surprised at any man of even ordinary intelligence, much less Supervisors putting any other construction upon it. To further show the inconsistency of such a decision, I would ask the supervisors how they knew that, even if their interpretation of the Act was right, the Yorba would not receive even more water than at present! They did not ask us what developments we intended to make; they cannot tell but that we may make a cement dam in the river; they do not know what may and can be done with cement ditches, reservoirs, and it is none of their business. Their business is to see that lands to which our water would not be a benefit be not taxed, and so that all who have land that can be benefited may, by petition, be included here their part of the work begins and ends. The rest is with the voters. If injustice is done any one of the courts are open. The supervisors have no right to sit as judges on our future development of water, and they are distinctly forbidden to take any lands from the district which can be irrigated from the same system of works, for holding exactly what they did, and what we are now, that is two systems (with the consequent lawing and bickering) where there could be one. Again, what would the Supervisors say if I should go before them and protest against my lands being included in this district, saying, as the Yorba does, that I have a nice fat thing and intend to keep that I have forty four shares in the Anaheim Union Water Company and not irrigate more than half the land that I am entitled to; that I am afraid some other man would get a share of the water; and that on whose I would not be improved would they grant my petition? Would they strike out of the district as they did the Yorba? Not a bit of it. They would likely say, Young man, your petition is refused; we arehere to do our duty to the public, and give the greatest good to the greatest dam. This act was not intended to pander to the whims and fancies of everyone one, but to consolidate, develop, and improve the district to which it is applied." Let them say and do to Yorbas, and they will be doing their duty. Our people have law and justice on their side. The spirit of age is advancement and development. Let us not be bound in this manner but in freedom. Now, by this section both the Yorba and the Anaheim Union Water Company would be paid their interest in the ditches at present to use if purchased by the new district, which of necessity they must be. I claim that the Yorba district could pocket a good round sum and still have sufficient water to irrigate the lands provided by the new district. I claim that, as we at present consider them three hundred inches of water, pending a legal settlement, that they would get a greater compensation than we would per acre, but I claim that if they refuse to come in or are omitted from the district till the courts define their water right, such rights will every year decrease, and for the following reasons. When water was plentiful in the river small settlements could take out just as much water as their ditches would carry; could let it run to waste just as they liked. But as civilization advances and population increases the counties settle that only the necessary water shall be used, and it is thus word necessary that I believe in the falling off of such water rights will take place. What was considered necessary twenty years ago will twenty years hence be considered willful waste and will not be tolerated by any court or people, and that in future, and perhaps not far off, the word necessity will mean the necessary water wheels carried in pipes and economically used; and under such a definition the Yorba district could not claim one fourth of the water now turned out to them, even irrigating their third class lands. I claim that now is a time when they could and would get greater compensation than will be allowed in the future. At present they are purging the dog in the manger policy. They will neither use the water themselves nor allow us to use it, but allow three fourths of it to run to waste, which could be saved by piping, while vastly richer and more fertile lands have to do without any waste in recent seasons. Yet another reason, I think, can be given why Yorba would be benefited by being in our district. As settlements increase up the river water will be taken out and gradually lessen the supply, till seen the Yorba district may feel the need of summer water. What will be the result? The Yorba district is too small to prossecute such, and if we in self-defense enter proceedings and give bonds and liberate water just as it comes down, the Yorbas claim prior right and though we took the expense and risk, they claim the water; and as they do now, perhaps sell it to their nearest land owners while we dry out for water of water. The pursuit of such a policy makes the man who prayed "God bless me and my wife, my son John and his wife, my four and no more," etc. The bill we are now considering does away with all these differences, unites all interests, and that in a just and equitable manner, by paying for all interests taken for the public, and thus distributing the water equally all over the district and giving us power to borrow money sufficient to save the water, and make us powerful enough to defend by the Wright hill. Now what I wish is that we of this and surrounding towns contribute enough money to charter a train of ten fifteen cars and bring that many of these people here without any cost to them alive in our beautiful country, and make them all that this is indeed and in truth Anna's house. Let us fill all of the halls with the good and grand things of our towns and surrounding country. County School Superintendent Seamans has issued his yearly report of the schools in the county, which shows a remarkable growth in our public school system during the past year.
