NEGOTIABILITY OF BILLS OF LADING.
A decision has been made by the Supreme Court of the United States which pronounces a doctrine considered novel. It is that a bill of lading in the hands of a third person who may have taken it in good faith and advanced money on it is void if the goods have not been received by the carrier. This destroys the value of its alleged negotiability, and, on principle, a warehouse receipt may be held to a like decision. Indeed, the principle might be extended still further. The decision was in the case of Pollard vs. Valdon, and the opinion of the court was delivered by Justice Miller. Conflicting with the general by accepted opinion on the subject, we present the
From the "Times."
Editor Times—Seeing an article in your paper last week from Arnold Parker, I was impressed with the earnestness with which he appeals to you to continue to enlighten the world in regard to the means by which he was so miraculously cured of rheumatism and hip-joint lameness by using Kendall's Spavin Cure. The article to which he alludes by Dr. Bates, impressed me so favorably with the real merits of this remedy that I tried it also for several blemishes on my horses and found it the most perfect cure I ever tried for spavins and other blemishes, as it completely removes the enlargement in every instance by continuing its use for several days after the lameness has subsided. The perfect success I have always had with Kendall's Spavin Cure led me to use it on my own person, and for all the family with the very best results as a family liniment. While several of the cures made by it have been almost miraculous, none have been more satisfactory than several cures which I made with it of foot rot and also sore teats as well as warts on teats of cows. I consider it a sure cure for sore teats or foot rot in either cows or sheep. With the satisfaction this remedy has always given in every instance, I cannot retrain asking with my friend Parker that you continue to make known to the world this, the greatest discovery of the nineteenth century.
Yours truly, JAMES A. CAMPBELL.
Herkimer, N. Y., Sept. 10, 1881.
The above letter, with one published last week, encourages us in our efforts to make our paper one of the most valuable Journals in the country and to all our patrons, and we now ask others of our readers who have been alike benefitted by the letter published one year ago from Dr. Bates, that they send us for publication, statements which they may wish to make for the benefit of others.

void if the goods have not been received by the carrier. This destroys the value of its alleged negotiability, and, on principle, a warehouse receipt may be held to a like decision. Indeed, the principle might be extended still further. The decision was in the case of Pollard vs. Valdon, and the opinion of the court was delivered by Justice Miller. Conflicting with the general by accepted opinion on the subject, we present the decision from the Federal Reporter as a matter of interest and probable importance to our readers:
"A bill of lading is at once a receipt and a contract; it is an acknowledgement of the receipt of property on board the vessel and a contract to carry safely and deliver. The receipt of the goods lies at the foundation of the contract to carry and deliver, and if no goods are actually received, there can be no valid contract to carry or deliver. The person to whom such a bill of lading is first delivered cannot hold the signer responsible for goods not received by the carrier, as neither the master of the vessel nor the shipping agent has authority to give a bill of lading for goods or cargo not received for shipment. Such a bill of lading is void in the hands of a third person who may afterwards in good faith have taken it and advanced money on it."
INDIAN MARRIAGE LAWS.
A paper on this subject, read by the Rev. J. Owen Dorsey before the American Association, notices some remarkable customs in relation to marriage and kinship as prevailing among the Dhegitha Indians, particularly the Omahass and Poncas. When a tribe is hunting it camps by gentes, or nations, each gens bearing the name of some animal. All the members of one gens are relatives, and marriage between members of one gens is absolutely forbidden. Membership in a gens is by descent in the male line, not in the female. The relations of a man are denoted by colors; for example, black, grandfather or grandmother; blue, father or mother. His connections are denoted by mixed colors, such as a pink head and skirt, with light-blue triangle on the body, for sister-in-law. A

The following are the declarations of the Prohibition Home Protection Party on Temperance and the Sunday-Law:
3d. We declare that the manufacture, sale, and use of alcoholic drinks is the greatest civil of the country and the age; that the traffic enslaves women and degrades children, debases youth and wrecks manhood, corrupts ballots and injures public service, peaches prisons and fills insane asylums, breeds paupers and criminals, imposes enormous burdens of taxation, destroys capital and ruins labor; degrades, impoverishes, and destroys our homes, and now threatens through organized and criminal conspiracies, to subvert law and order.
So believing, we declare the cardinal principles of our party to be prohibition by constitutional amendment, of the manufacture of all alcoholic liquors not demanded for medicinal, mechanical, or scientific use; and the regulation by law, under severe penalties, of the sale of alcoholic liquors for such use, and the absolute and total prohibition of the sale for any other purpose.
5th. We declare that Sunday is an institution so interwoven into our laws, our customs, our civilization, and the very structure of our Government; so intricately and beneficiently connected with our social, business, and moral life that we cannot dispense with it without sacrificing the very best interests of the country and the highest welfare of the whole people.
So believing, we demand the enactment and enforcement of an intelligent and rational Sunday law, and especially do we demand that all saloons or places of business where intoxicating drinks are now licensed to be sold, or permitted to be sold, on secular days, shall be absolutely closed on Sunday.
Vote as you pray, vote for capable, temperance, good and true men, that you may have good laws and reduced taxation, and you can have them in no other way.
Vote the Prohibition Home Protection Ticket.

KENDALL'S SPAVIN CURE
The most successful itemedy ever discovered as it is certain in its effects and does not blister. READ PROOF BELOW.
Saved him 1,800 Dollars.
ADAMS, N.Y., Jan 20, 1882.
Dr. B. J. KENDALL & Co., Gentle Having used a good deal of your Kendall's Spavin Care with great success, I thought I would do as speedy a coil as possible over the cross bar and got fast and tormented his limb all to pieces. I employed the host farriers, but they all said he was spotted. He had a very large thorough pin, and I took two bottles of your Kendall's Spavin Care, and it took the bunch entirely off, and so sold afterwards for $1,800 (dollars). I have issued it for home spravina and wind gals, and it has always curled completely and left the key smooth.
It is a splendid medicine for rheumatism. I have recommended it to a good many, and they all say it does the work. I was in Witherington & Knockland's drug store, in Adams, the other day, and saw a very fine picture you sent them. I tried to buy it, but could not; they said if I would write to you that you would send me one. I whisper you would, and I will do you all the good I can.
Very respectfully, E. S. LEMAN.
KENDALL'S SPAVIN CURE.
Price $1 per bottle, or 6 bottles for $5. All drugs have it or can get it for you, or it will be sent to any address on receipt of price by the proprietors, Dr. B. J. KENDALL & Co., Enosburgh Falls, Vt. Send for illustrated circular.
