Rome, Feb. 21.—The circumstances of the election of the Pope are as follows: At this morning's ballot Cardinal Pecci received 36 votes, which was five short of the requisite two-thirds majority. When the voting was finished and the papers burned, Cardinal Franchi, and those holding views with him, advanced and knelt before Cardinal Pecci. This example being followed by others, Cardinal Pecci's election was accomplished by a method known as "By Adoration." San Francisco, Feb. 21st.—In the case of J. C. Merrill in the Police Court to-day, H. F. Middleton, the supposed companion of Duncan in his attempted flight, was placed on the stand but nothing could be got out of him. He refused to answer questions of counsel on the ground that to give true answers would tend to secure his own conviction of felony. This refusal extended even so far as to refuse to recognize a photograph of his own mother and others. The remarkable course pursued by Middleton and other witnesses in this case has confirmed the belief in the minds of the public that Duncan was attempting to escape by the schooner E. S. McKinnon and that Merrill, Jenks, Redmond and others were his assistants in the attempt. In Kentucky, at the reunion of a Confederate brigade, an old veteran arose to address the meeting, and, as he gazed on the surging throng about the tattered colors, called out, "Boys, I ain't no orator, but there's a sight more of you here than I ever seen in a fight!" The Railroad Commission has cost this State $50,000, so far. It would have been dear at half the money. SATURDAY, MARCH 9th, 1878.
