Ten days to answer, and injunction ordered to be modified in accordance with amendments on file. The order heretofore issued in this case will be and is ordered to be amended and modified as follows: That the defendants heasin be and they are hereby enjoined from making any such division or interference with the waters of the river Santa Ana, situated in the county of Los Angeles, State of California, as shall or may prevent the same from running into plaintiff's ditch, known as the Anaheim Water Company ditch, situate in said county, and in a sufficient quantity to till said ditch, that is, to the full capacity of said ditch, provided that the order does not operate to prevent defendants who irrigate through the Yorba ditch, to wit: Amos Wright, Wm. Rader, Prudencio Yorba, Trinidad Yorba, Marcos Yorba, Vicente Yorba, W. Kalisher, H. Wartenburg; Y. Y. D. Cota and M. L. Wicks from diverting into said ditch for their use, water to the extent of one hundred and twenty-five inches, miner's measurement, but as to any quantity over that they are enjoined in the manner as aforesaid. The land desired is chiefly on the Los Bolsas. -It is said that Indians are much preferable as grape-pickers to Chinamen, whom they have this year supplanted in that occupation.Not only do they pick the vines more thoroughly but they work much faster. -The Republican learns that a large number of sheep are dying in the San Bernardino mountains, and that if rain does not fall soon, the effect will be disastrous in the extreme. -Mr.Graham, of Pasadena, while driving to Los Angeles recently, passed within twelve feet of a large American eagle, with a full grown rabbit in his talons, but having no firearms in his possession, he was unable to secure the bird. -Superintendent Saxon informs us that the County Institute has been set for the 19th of November. Professors Carr, Allen Mrs.Carr and others will be present to grace-the occasion and lend their aid to make it a success. -Rev.G.M.Hubbard, pastor of the Episcopal Church of this place, has tendered his resignation, to take effect on the 1st of December.Mr.Hubbard and his esteemed wife have many warm friends here, who will be pained to learn of their contemplated departure. -Jacob Weitzel,a well known brick mason of Los Angeles, attempted to commit suicide at his residence in that city on last Friday. He first shot himself and then cut his throat, but strange to say, there is every probability of his recovery.Financial difficulties and domestic troubles are supposed to be the cause of the act. This is the second attempt he has made to commit suicide. -The Indian community,the male members of which are engaged in grape picking,imbibed too much fire-water on Sunday last,and as a consequence grew extremely belligerent. There were several sanguinary encounters,and in one of them a knife was used freely.Sufficient evidence,however,could not be got together to convict any of the participants in the row. One Indian was find by Justice Clark for misdemeanor. The Los Angeles Common Council have consented to allow the Southern Pacific Railroad Company to connect the Santa Monica Railroad with the Southern Pacific at the corner of First and Alameda streets. Victor Young of Orange was brought up before Judge Bailey yesterday on a charge of being drunk and disorderly. The judge took his case under advisement and will render his opinion as to about how much he ought to be fined this morning. By reference to our advertising columns it will be seen that a concert will be given on next Saturday evening, under the direction of Prof. Yarndley. The programme, to which we will refer during the week, is a finely selected one. The Herald says that the Section Foreman of the Southern Pacific Railroad at Cucamonga, in making his rounds early on Tuesday morning, saw a herd of forty-four antelope about a mile and a half this side of that station. He says that they had evidently come down from the hills for water. Star: The piece of property known as Temple Block, was sold at Sheriff's sale at noon yesterday, to satisfy the Weil mortgage, amounting to $95,162 99, including costs to date. The purchasers were Newmark & Co., and the price paid $131,000. This firm holds a second mortgage for $27,405 54 on the property, which, added to the first mortgage, aggregates $122,508 53. This leaves a balance of $8,431 47 to apply on the third mortgage, which is held by R. J. Baldwin. The Fairview Base Ball Club has been stimulated to unwonted activity by their defeat at Westminster, which, by-the-way, is made the subject of a communication in another column of this morning's paper. Practice games are played every Saturday afternoon near the Fairview school house, and occasionally a game is played on Wednesday. The club now numbers twenty-three members. A correspondent of the Express classes Anaheim among the list of "jealous towns" who envy Los Angeles the prospective possession of the terminus of Scott's transcontinental road. While the people of Anaheim believe in a glorious destiny for their town, they have never expected it to be made the terminus of Scott's road. So, to quote the exact language of the correspondent alluded to, "stop your foolish gab." The Colton Semi-Tropic of last Saturday has the following: "Who says Colton is not popular? About midnight last night a party of young men went to the Sherman House, where a dance was going on. One of the party, named Sparks, who had been drinking, got into a quarrel with one of the women. He drew a pistol and fired at her. The ball missing the woman, passed through a partition and struck a young man named James Murdock, who happened to be passing, and who stopped to look on. The bullet entered the upper part of his left breast, perforating the lungs. The wounded man is now lying in a precarious state, though there is some hope of his possible recovery. In making the arrest of Sparks the officers were resisted by him and one of his companions, who tried to shoot. They were captured after a desperate struggle, and are now confined in jail to await the Grand Jury. Pardon—The Rocklin Affair. SACRAMENTO, Sept. 21. Governor Irwin has pardoned ex-Harbor Commissioner John J. Marks, convicted of embezzlement of public funds in 1875, and sentenced to seven years in the penitentiary. The Governor has offered a reward for the arrest and conviction of the Chinese engaged in the recent Rocklin tragedy. Warrants have been issued for the arrest of twenty-eight white men engaged in driving the Chinese away from that vicinity. The Governor characterizes Colonel Bee's dispatch asking his interference to put down disorder in Placer county as injudicious and tending to exaggerate in the minds of non-spectators the extent of the disorder prevailing there. He expresses regret at the illegal actions of the whites as tending to prejudice Eastern people against the settlement of the question of Chinese immigration. Schurz Confident. WASHINGTON, Sept. 20. The dress of a little daughter about three years old, having by some means come in contact with the flames, she was burned to death before assistance could be given her.
