SATURDAY... JAN. 22, 1875. THE NEW COURT HOUSE AND JAIL A bill to authorize the Supervisors of the county of Los Angeles to issue bonds to the amount of $150,000 for the erection of a Court House and Jail is proposed by Assemblyman Lamborn, and with commendable good sense is spread before the people for examination through the medium of the Los Angeles Herald. That the county needs the above structures there is no doubt; but whether it is wise to assume so great an indebtedness while the present debt is so large is a serious question. Our present debt is over $525,000. Now, can we afford the luxury of this additional expense, and increase our debt to $875,000? The need of new buildings, of course, is great, but the same principles of economy apply to counties as to families and business houses. It is never wise to increase debt for mere convenience and pride. That the county jail needs renovation, for the sake of humanity, is plain to all, but can we afford so great an outlay just now? To us it seems exceedingly unwise to go into this business, and certainly so great an outlay should not be made, unless the people have a chance to express their opinion by a vote. It is probable the bonds will find sale, for the interest is good and sure. As an investment it may be safe enough, but are the people ready to assume such an increase of outlay as this plan calls for? Let us reduce our present indebtedness at least by $400,000, before we think of adding more. This subject comes in very opportunely now in relation to the question of county division. The citizens of the proposed new county can see now just why the Los Angeles Press and people are anxious to defer division. Fifty thousand dollars out of this end of Los Angeles county is quite an item in this new improvement. We may, by deferring division, secure the opportunity of contributing this sum, and also, when in a few years more division does come, may raise funds for our own county buildings. It may be well asked what effect will this bill have upon our bill for division. If both pass we will doubtless be excluded from the above expense, but the bill for new buildings may have the effect to drive ours to the wall. Let the people speak out plainly, definitely what they want. Let our demands be known at Sacramento, and then there can be no after regrets; but if men hold back, if men do nothing, the fiddling will begin, and the fiddlers must be paid. Santa Ana Items. Regular Correspondence of the Gazette. Fourth street, from West to Ross streets, has been opened through Birch's Addition to the town plat of Santa Ana, thus putting some fifty lots more on the market, giving a free outlet to the Masonic Cemetery and another outlet to the stage road leading to Anaheim. Mr. Kimball, from New York, has bought a lot of ground of T. J. Harlem, and is about to erect a new dry goods and general merchandise establishment, the lumber for which is being rapidly delivered on the ground from McFadden's lumber yard at Newport Landing. Santa Ana and surrounding county is to Newport Landing what Anaheim is to Anaheim Landing. Through the enterprise and pluck of the McFaddens (notably Jas. McFadden) this whole section is being rapidly supplied with building material of all kinds. A visit through Tustin and Santa Ana will attest the truth of the above. Since the opening of the San Joaquin Rancho to the market, Mr. French informs us that over one thousand acres have been sold at fair prices, and strangers are being shown over the ranch every day for the purpose of selecting choice pieces. He shall receive an annual salary of two thousand five hundred ($2,500) dollars payable in the first instance, quarterly, out of the General Salary Fund of the County of Los Angeles; but the amount so paid shall be a charge upon the different irrigation districts organized under this or any previous Act, in proportion to the number of acres of land irrigated within each of them respectively. SEC 4. Immediately after the passage of this Act, the Board of Supervisors of Los Angeles County shall subdivide the county, or the irrigable portions thereof, into irrigation districts, accurately defining the boundaries of said districts by reference to natural objects, or by conforming to lines of Government subdivisions; and each irrigation district shall contain all lands irrigable from one or more sources of supply; provided that the valleys of the San Gabriel and Santa Ana Rivers shall be separated into two districts. Second—The boundaries of said irrigation districts shall be ascertained by a field survey, and shall also be platted on a general map, said map to be kept on file in the office of the Superintendent of Irrigation, subject at all times to the inspection of the public. Subdivisional copies of said map, on an enlarged scale, containing so much of said map as refers to each separate irrigation district, and containing, in addition, subdivisional property lines, with names of owners thereof, shall be made and delivered to the several Boards of Water Commissioners hereinafter provided. Third—For the purpose of making surveys and maps herein provided, the Superintendent of Irrigation shall be allowed such assistants as he may require, and the compensation of said assistants shall be fixed by the Board of Supervisors. Fourth—For the purposes herein provided, the Board of Supervisors as aforesaid shall advance and appropriate, from the — Fund of the treasury of the county of Los Angeles, a sum of money not to exceed five thousand dollars. The amount so advanced and appropriated is made a charge against the construction fund hereinafter provided, of the several irrigation districts and shall be replaced in — Fund of said county by the first moneys received for the sale of irrigation bonds hereinafter provided; each irrigation district. Other pieces of lands, improved, are changing hands every day, varying in size from a town lot to eighty acres, so Judge Humphreys informs us, who has had his hands full of conveyancing since he has opened his real estate office. Mr. Lambkin has purchased lots through him of Birch's Addition for the purpose of erecting a printing office, which he hopes to soon have in operation. Mr. Jacob Ross had a valuable horse stolen night before last. There seems to be an organized band of thieves operating in this section, who do not seek to run them out of the country but to keep them secreted until a reward is offered; when they are returned, and the reward claimed. Mr. Robinson, living just across the river, between here and Westminster, had two valuable horses taken, and they were returned as soon as a sufficient reward was offered. If this state of things continue, our farmers intimate that an adequate remedy will be found and that Judges, Juries and lawyers will not be needed to apply it. BIOX. Santa Ana, Jan. 7, 1876. —The Mutual Aid Association has elected the following Board of Directors for the ensuing year: Thomas A. Garay, Los Angeles; J. E. McComas, Compton; George C. Gibbs, San Gabriel Mission; L. M. Holt, Los Angeles; J. W. A. Wright, Fresno county; N. W. Winton, Santa Barbara; T. H. Smith, Los Angeles; G. H. Dunamoor, Los Angeles; J. J. Morton, Compton; L. K. Smith, Los Angeles; Dr. J. H. Moore, Los Angeles. Fourth—For the purposes herein provided, the Board of Supervisors as aforesaid shall advance and appropriate, from the — Fund of the treasury of the county of Los Angeles, a sum of money not to exceed five thousand dollars. The duties of said Water Commissioners shall be as follows: First—To make such rules as they may deem proper, not inconsistent with the laws of the State of California, relative to the control and management of the business and property committed to their charge, and for the government of their officers and employees. Second—To appoint a Secretary and a District Overseer. Third—To adopt and use an official seal. Fourth—To receive and accept all resignations of members of the Board of Water Commissioners of their district, and to fill all vacancies occurring in said Board. Fifth—To keep an office at some suitable locality within their district, and to hold stated meetings at said office on the third Mondays of January, April, July and October of each year. Sixth—To meet at the call of the President at such other times as he may direct, but at such called meetings no business shall be transacted except as may have been entered upon at the last stated meeting, or to take measures to prevent waste, or to make repairs in time of freight. Seventh—To keep records of their proceedings open at all times for the inspection of any person. Eighth—To cause the Superintendent of Irrigation to make the necessary surveys, estimates, plans and specifications shall be fixed by the Board of Supervisors. And said officers so chosen shall hold office for one year from the first Tuesday in June succeeding such election, or until their successors are duly elected and qualified. Second—In the conduct of said election, and in the case of a contested election, all proceedings must be conducted in accordance with the State laws governing general elections, except as regards the qualifications hereinafter specified, of electors. Third—No person shall be a qualified elector at any election, as provided for in this section, except the owner or legal representative of property paying a tax, or which is liable peals will be received by the Board at their offices, for the purchase of the bonds, until the day and hour united in the resolution. At the time appointed, the Board shall open the proposals and award the purchase of the bonds to the highest responsible bidder, but may reject all bids. Fourth—Said bonds, and the interest thereon, shall be paid by a revenue derived from an annual tax upon the property in the district, and all the property in the district shall be and remain liable to be taxed for such payment as hereinafter provided. Fifth—In the assessment of property in several irrigation districts, each District Assessor shall proceed in the same manner as is prescribed by law for the Assessor of Los Angeles county. Sixth—For the purpose of levying and equalizing the tax herein provided each Board of Commissioners of the several irrigation districts is hereby vested with the same powers and authority as are vested in the Board of Supervisors of Los Angeles county, for the levy and equalization of taxes for State and county purposes; provided that each Board of Commissioners shall convene as a Board of Equalization at a time not less than twenty days and not more than thirty days subsequent to the delivery of the assessment book by the District Assessor. Seventh—In levying the tax herein provided, the Board of Water Commissioners shall levy a tax sufficient to pay the district proportion of the salary of the Superintendent of Irrigation and to pay the annual interest on the outstanding bonds—allowance being made for cost of collection; and at the expiration of ten years after the issuing of the bonds the Board must increase said tax for the ensuing ten years in the follow- Second—In the conduct of said election, and in the case of a contested election, all proceedings must be conducted in accordance with the State laws governing general elections, except as regards the qualifications hereinafter specified, of electors. And such voting precincts shall be defined by the said Board so that no one section of the irrigation district shall have undue representation in the Board of Water Commissioners to be thereafter elected. Fifth—The Water Commissioners when elected as herein provided, shall, before entering upon the duties of their office, and within ten days after receiving official notice of their election, each take and subscribe to the usual official oath, and file an official bond in the sum of two thousand dollars each, with sureties, to be approved by the Board of Supervisors of Los Angeles county. Sixth—The District Assessor and District Tax Collector, when elected as herein provided, shall, before entering upon the duties of their office, and within ten days after receiving official notice of their election, each take and subscribe to the usual official oath,and file an official bond in the sum of two thousand dollars each, with sureties, to be approved by the Board of Water Commissioners of their irrigation district. Seventh—The Water Commissioner shall receive the same per diem and mileage as the County Supervisors, to be paid out of the Current Expense Fund, hereinafter provided, of their respective districts. And the District Assessor and District Tax Collector shall receive such compensation for their services as shall be allowed them by the Board of Water Commissioners. And such compensation shall be paid out of the Current Expense Fund of their district, hereinafter provided. SEC. 7. For the purpose of constructing dams, reservoirs, and irrigating canals, and acquiring the necessary property and rights therefor, the several Boards of Water Commissioners are hereby authorized and empowered to issue and sell bonds to an amount not exceeding ten per cent. of the taxed valuation of property included in their respective districts. Said bonds shall be styled, "Bonds of Irrigation District No. —," of the county of Los Angeles; shall be payable in twenty years, in gold coin of the United States, and shall bear interest at a time not less than twenty days and not more than thirty days subsequent to the delivery of the assessment book by the District Assessor. Seventh—In levying the tax herein provided, the Board of Water Commissioners shall levy a tax sufficient to pay the district proportion of the salary of the Superintendent of Irrigation and to pay the annual interest on the outstanding bonds—allowance being made for cost of collection; and at the expiration of ten years after the issuing of the bonds the Board must increase said tax for ensuing ten years in the following percentage of the principal of the whole amount of bonds then outstanding, to wit: For the eleventh year, five per cent; for the twelfth year, six per cent; for the thirteenth year, seven per cent; for the fourteenth year,eight per cent; for the fifteenth year,nine per cent; for the sixteenth year,ten per cent; for the seventeenth year,eleven per cent; for the eighteenth year,twelve per cent; for the nineteenth year,fifteen per cent; for the twentieth year,a percentage suffileent to pay off said bonds. Eighth—In the collection of the tax herein provided each District Tax Collector shall proceed in the same manner as is prescribed by law for the Tax Collector of the County of Los Angeles, and shall pay over the said tax to the Treasurer of the County of Los Angeles at the same time and in the same manner as is prescribed by law as aforesaid. Ninth—The Treasurer of the County of Los Angeles shall first deduct from the amount paid as above the district proportion of the salary of the Superintendent of Irrigation, which shall be reimbursed to the fund in the county treasury from which the said salary was advanced, and shall place the remainder in a special fund to be styled, "The Interest and Sinking Fund of Irrigation District No. —," of the County of Los Angeles." Tenth—Upon the presentation of matured coupons to the said County Treasurer, he shall pay the same from the fund of the district issuing them. Whenever, after ten years from the issue of said bonds, said funds shall amount to the sum of two thousand dollars,the Board of Water Commissioners issuing said bonds may direct the County Treasurer to pay such an amount of their bonds as the money in their special fund will redeem, at the lowest value at which they may be offered for liquidation, after advertising for three weeks in some newspaper published in the city of Los Angeles for sealed proposals for the redemption of said bonds. Said proposals shall be opened by the Board in open meeting, at a time to be named in the notice, and at the lowest bid for said bonds shall be accepted; provided that no bond shall be redeemed at a rate above par. In case bids are equal,the lowest numbered bond shall have the preference. Eleventh—The tax due upon real property is a lien against the property assessed,and the tax due upon personal property is a lien upon the real property of the owner thereof,from and after the time same becomes delinquent,and such lien is not required for public use,the parties whose ditches are so condemned shall be entitled to water.at the usual water rate,sufficient to irrigate all of their cultivated lands,prior to the division of she water among cultivators who did not have water in actual use at or before the passage of this Act;and provided that such land owners (having lands in Water Districts Numbers One and Two.of Los Angeles county.as constituted prior tothe passageofthisAct)who are not delinquent inthe paymentoftheir irrigation taximposed upon them underthe provisionsofanActentitledanActtopromoteirrigationinthecountyofLosAngeles.approvedMarchtenth,eighteen hundredandseventy-four.shallbeconsideredandshallbepartieshavingwaterrightsinactualuseforirrigationpurposes. SEC. 10. Whenever it can be done without failing to accommodatethe necessitiesandrequirementsofirrition,theBoardofCommissionersmayleasethewaterformanufacturingormillingpurposes;providedthateverysuch leaseshallberevokedatthewillofsaidCommissioners:AndallmoneysreceivedfromleasesofwaterforsuchpurposesshallbepaidtotheTreasurerofLosAngelescounty.tobeplacedtothecreditofthe"InterestandSinkingFund"ofthedistrictmakingthelease. The principal and interest of said bonds shall be payable at the office of the Treasurer of Los Angeles county. Said bonds shall each be in the sum of one hundred dollars; shall be signed by the President and Secretary of the Board of Water Commissioners issuing the same, and shall have the seal of said Board affixed thereto. Said bonds shall be numbered consecutively as issued, and bear date at the time of issue, and coupons for the interest, signed by the Secretary, shall be attached to each bond. Said bonds shall express on their face that they are issued by authority of this Act, stating its title and date of approval. Second—The Secretary shall keep a record of the bonds sold, their number, the date of sale, the price received and the name of the purchaser; and before delivering to the purchaser each bond shall be countersigned by the Treasurer of the county of Los Angeles, who shall also keep a record of the same, with the number, date of issue, and the name of purchaser. Third—Before making any sale, the Board shall, at a meeting, by resolution declare its intention to sell a specified amount of the bonds and the day, hour and place of such sale, and shall cause such resolution to be entered in the minutes and notice of the sale to be given by publication thereof at least twenty days, in a newspaper published in each of the cities of San Francisco and Los Angeles, and in any other newspaper at their discretion. That notice shall state that sealed provisions of this Act, shall be debited to the "Construction Fund" of the irrigation district, and shall be liquidated by the issuance of bonds herein provided, which bonds shall be taken at seventy-five per cent. of their par value. Second—The outgoing Board of Commissioners, to whom these bonds shall be issued, are hereby authorized and empowered to receive the same and to transfer them or their equivalent, to individual land owners holding their tax receipts, paying for such receipts the said bonds at seventy-five percent. Of their par value. And the said outgoing Boards and their bondsmen shall be and are hereby released from any further liability. SEC. 8. Each Secretary of the several Boards of Water Commissioners shall attend all meetings and keep accurate minutes of the proceedings of the Board. He shall keep the seal of said Board; shall file and keep in the office of the Board all records, maps and official papers, and shall perform such other duties as are prescribed by law or by the orders of the Board. Second—The District Overseers herein provided, before entering upon the duties of their office, shall each take the usual official oath and give bonds for the faithful discharge of the duties of his office. In the sum of one thousand dollars, with sureties, to be approved by the Board of Water Commissioners. He shall have control and direction under the Board of Water Commissioners, of all subordinate employees, and the power to suspend them from duty, reporting the same to the Board aforesaid for final action. He shall supervise the distribution of water to the parties presenting orders to the Board of Water Commissioners. He shall have power to arrest any and all persons for unlawful interference with ditches, dams, reservoirs, or other irrigating works; and he shall perform such other duties as may be prescribed by order of the Board of Water Commissioners. Third—The Secretaries and District Overseers herein provided shall receive such compensation for their services as may be allowed them by the Board of Water Commissioners of their respective districts; and said compensation shall be paid out of the "Current Expense Fund," hereinafter provided. SEC. 9. The Boards of Water Commissioners herein provided shall, at their first meeting, choose one of their provisions of this Act, shall be debited to the "Construction Fund" of the irrigation district, and shall be liquidated by the issuance of bonds herein provided, which bonds shall be taken at seventy-five per cent. of their par value. Second—The outgoing Board of Commissioners, to whom these bonds shall be issued, are hereby authorized and empowered to receive the same and to transfer them or their equivalent, to individual land owners holding their tax receipts, paying for such receipts the said bonds at seventy-five percent. Of their par value. And the said outgoing Boards and their bondsmen shall be and are hereby released from any further liability. SEC. 12. The owners of artesian wells in Los Angeles county, when the water therefrom is not used for irrigation, are hereby required to diminish the flow of the same by capping the wells or otherwise, only permitting a flow of water sufficient for domestic purposes, and for watering stock. If notified by the District Overseer to check and regulate the flow from any wells, as contemplated by this Act, any well owner, or his lessee, agent, or representative having charge of the same, shall refuse or neglect to do so, the Board of Water Commissioners shall direct their attorney to bring suit against such person or persons, and when convicted they shall pay a fine of fifty dollars ($50) for the offense. SEC. 13. The cutting or willful damage of ditches, or other irrigation works, or the unauthorized taking of waters from any ditch, dam, or reservoir, holding or carrying water for irrigation purposes, or the drainage of cesspools or other filth into any irrigation ditch, or the obstruction of the flow of water in any irrigating ditch is hereby declared a misdemeanor, punishable by a fine of not less than fifty, nor more than one thousand dollars, or by imprisonment in the county jail not less than five, nor more than thirty days, or by both fine and imprisonment, at the discretion of the Court. SEC. 14. Nothing in this Act shall be construed as applying to the City of Los Angeles, or to the waters of the Los Angeles River, which are hereby exempted from its operation. SEC. 15. Section four requires that the Southern Pacific shall commence work upon the extension of its road as provided in the Act within one year after it shall have completed its road from west of the Colorado river, and shall complete not less than 20 miles per year until connection with the Texas and Pacific Railroad. Section five gives the Southern Pacific the right to bridge with proper draw-bridges such navigable streams as the road may cross; and secures to the company various rights in the construction of its road; provided that such rights are used for purposes of communication, travel and transportation. Section six authorizes the road to construct from some point on its line a road of equal character with the main trunk line of the Southern Pacific Railroad to the Pacific Channel in the Bay of San Diego, and gives the company all the rights and privileges for construiting this portion of the road, as was before granted to the Tascas and Pacific Railroad, requiring it to construct twenty miles of road within two years from the passage of this law and twenty miles each year after, until its completion. The Solicitor-General, after examining the record is furnished by the Interior Department, has advised the Attorney General to comply with the petition of the Southern Pacific Railroad Company asking him to institute proceedings to set aside the patent for the Luanas de Santiago Rancho, in Los Angeles county, on the ground of the fraud practiced in the California Court, which confirmed the grant. The Attorney-General, however, declines to go further unless the Interior Department considers, and has referred the matter to Secretary Chandler for positive recommendation.
