Arise and shine, and be sure you give out warmth as well as light. There will be far less trouble, even with those bad boys who are very often the very raw material of good men, when they habitually know their teacher as a personal friend, to whom they must look up as to a superior, not only in authority and rank, but also in wisdom and kindness. [To be concluded next week.] The City of Anaheim vs. Ashcroft and Pryor. DECISION. The defendants are before this Court for having violated an ordinance of the city of Anaheim. In their defense, it is stated that by a statute approved March 7, 1872, the said city was disincorporated and its charter repealed, and hence cannot enforce any of its ordinances as it has no existence in law. Plaintiffs urge that city is in legal existence, because the repealing act has not been fully complied with by those upon whom certain vital duties were imposed, and that a legal and constitutional disposition of the corporate property has not been made by the repealing act, and that it attacks vested rights. The Court has carefully considered the questions involved in the case. The first section of the Act of March 7, 1872, in plain and un as it has no existence in law. Plaintiffs urge that city is in legal existence, because the repealing act has not been fully complied with by those upon whom certain vital duties were imposed, and that a legal and constitutional disposition of the corporate property has not been made by the repealing act, and that it attacks vested rights. The Court has carefully considered the questions involved in the case. The first section of the Act of March 7, 1872, in plain and unmistakable language, without any qualifications, repeals the act to incorporate the city of Anaheim, approved February 10, 1870. The Legislature had an undoubted right to do this. [2 Kent, 358 (8th edition); 4 Conn., 269; 21 Wend., 679; 3 Story on Const. § 1387; 12 Ill., 1; 9 Cranch., 43; 21 Ill., 451, and numerous other authorities.] If there were no proper limitations in the repealing act, this, at most, left undisturbed the vested rights of citizens in the corporate property; but this fact could not bring Anaheim into a public corporate capacity again, as a legal corporate entity could only be bestowed by a special act of the Legislature of California. The repeal of the charter was effected by the first section of the disincorporating Act. The subsequent sections of the act simply prescribe the mode in which the property of the corporation should be disposed, and how the legal claims against it should be satisfied. The city of Anaheim as a public, political and governmental corporation, ceased to exist when the repealing Act was approved by the Governor. If the Commissioners appointed by the repealing Act to attend to the settlement of the affairs and property of the corporation failed to comply with the duties imposed upon them, within the time and in the mode and manner prescribed by the Act, the Court is of opinion that this neglect did not renew the existence of the corporation. Having been wholly destroyed by the Legislature, who could destroy it, change it, or modify it, legal vitality as a public corporation could only be given by the same power. No omission of the Commissioners, or failure to act as prescribed, could bring to life in all its legal vigor a body which had been legally destroyed. The defendants are not amenable to punishment for not yielding obedience to an ordinance of a public corporation that had no longer a legal existence. They must be discharged, and it is so ordered. Y. SEPULVEDA, legal vitality as a public corporation could only be given by the same power. The sum is probably two dollars and if no better than the majority, the verses, are dear at that,—Oakland Transcript. A painter, being asked to estimate the cost of painting a certain house, drew forth pencil and paper and made the following calculation: "A naught is a naught; three into five twice you can't; I'll paint your house for fifty dollars." An old sailor at the theater said he supposed the dancing girls wore their dresses at half-mast, as a mark of respect to departed modesty. The Western Union Telegraph Company are constructing a telegraph line to Visalia, along the San Joaquin Valley Railroad.
