The News calls our attention to a portion of our last week's Los Angeles letter, relating to the President of the Los Angeles Common Council. We did not regard it at the time, as calculated to bring ridicule upon Judge O'Melveney but rather as a pleasant satire upon times and customs. It is our good fortune to be intimately acquainted with that gentleman and we have the highest regard for him, both as an able lawyer and an honorable man, and would not have permitted anything to be published in this paper which we thought reflected unfavorably upon him. If he regarded it as such, we beg that he will accept this as an amenable honorable. We have received Ross Brown's pamphlet on Reclamation of Marsh and Swamp Lands and Proposed Canals for Irrigation in California. It contains much valuable information upon the subject of reclamation and will well repay a perusal. Haven't seen the San Diego Railroad for a long time. Which is the matter? To the exclusion of a large amount of other matters one public notice in which a copy of the Act may be made within three months, redeem and animal or animals by producing raid action proof of his right to purchase money with interest at the rate of three per cent per month, together with compensation for the keeping said animals at the rate of one dollar per week per head for the time the purchaser has had them in possession. Section 1—The People of the State of California, represented in Senate and Assembly do not follow Section 1. Every order or execution of shall whether it is enclosed with evidence or is unenclosed. Section 2—The expenses of keeping an animal so taken up must be computed in following First, Home, Male, Jack, Male, or Justin, the rate of twenty cents per day. Second if Sheng or Goat as the fate of five bents per day, and if a fifteen cents per day. Third, Cate, the rate of twenty cents per day. Section 3—If the owner of an animal is known and they add to the township they must be forty with personally notified but if greater distance from their respective counties. Section 4—Nothing in this Act shall be construed as to prohibit persons from driving stock through unapparated lands not forced and who may be required to Section 1. The fee of Justices and Constable for services under this Act shall be the same as allowed by the General Fee Bill for similar services in other civil actions in their respective counties. Section 2. Nothing in this Act shall be construed as to prohibit persons from driving stock through unactivated lands not fenced; and who may be required to pass from one county to another from watering said stock at natural watering places on said lands. Section 3. Any person who shall drive stock from lands other than his own or to any lands or possession claims for the purpose of taking advantage of any provisions of this Act shall be deemed guilty of a misdemeanor and shall upon conviction thereof be punished accordingly. Section 4. The owner or occupant of lands, whether enclosed or not upon which damage has been done by any of the animals referred to in Section One of this Act, may instead of pursuing the remedy given in this Act, have an action for damage in any court of competent jurisdiction against the owner of such animals. Section 5. If the owner or occupant of land intends to institute proceedings under the preceding section he must first within ten days after the damage was done, end the same to be viewed and estimated in writing by two residents of the county, competent to be witnesses on the trial of such action. Reason such action shall be brought within one month after the damage was done. Section 6. This Act applies only to the counties of Los Angeles and San Diego, and all that portion of Monterey county lying north and east of the Salinas river. Provided however that no damages shall be recovered in the county of San Diego for any alleged trespass upon lands subject to the provisions of this Act, unless it appear that the plaintiff has actually and in good faith entered upon his land and has been prior to or at the time the action is brought cultivating the same and has suffered or is likely to suffer injury from the trespass committed. Section 7. This Act shall take effect and be in force from and after its passage in the counties of Los Angeles and Monterey, and only from and after the 18th day of May, A.M. 1872, in the county of San Diego. Section 6. When the action is against the property, this summons shall be served by posting a copy of the same conspicuously on the outside of the door of the Justice's office and three other public places in the township and shall be returnable in not less than ten days from posting. The return of the officer certifying to much posting on the affidavit of any person qualified to be juror who did it, shall be evidence of a sufficient service thereof. Section 7. If judgment be in favor of the plaintiff, the property may be levied upon and sold as other personal property issued on execution. If the judgment be for the bad act, the plaintiff shall pay such costs and damages he may be awarded by the Court or jury. Section 8. The officers selling shall give a bill of sale to the purchaser describing the animal or animals said, the price paid therefor, and stating that it or they were sold by authority of this Act. Any overrun of this process of sale after assisting the judge shall be paid by the Justice to the owner of the property upon demand within three months from the date of sale; otherwise it shall at the expiration of time be immediately paid into County Treasury for the benefit of the County School Fund. Section 9. Any owner or owner of any animal used in this Act may take possession of the premises and disable them if the penalties of such unlawful action are imposed.
