Question of Kern County Oil Arises WASHINGTON (UPI) — The U. S. Court of Claims opened a hearing Monday into the question of how former Interior Secretary Harold Ickes—or anyone else—could have known there was oil under a certain section of Kern County, back in 1903. The question was the central issue in a 15 million-dollar claim against the government for taking over 159 acres of land without compensating the owner shortly after World War I. The case recalled the colorful days of California's oil boom. It was brought by the estate of Charles O. Fairbank, and its executor, Charles Fairbank, with the help of his brother, Robert Fairbank, Charles Fairbank now lives in Canada and Robert in Honolulu. The claims court was ordered to hear the case by an act of Congress. The case has been in and out of the courts for 30 years. Specifically, the claims court was called upon to decide whether land owned by the Fairbank family was "known mineral land" at the time title passed to the state of California Jan. 26, 1903. The land was part of a section set aside for school use under the terms of California's Statehood Act. But under the law, if the acreage had known mineral wealth, title would remain with the federal government. California put the land up for sale at $1.25 per acre but found few takers until the Fairbank family took possession in 1910. Oil was discovered nearby in 1919, 16 years after the title passed to the state and nine years after several owners decided to buy up tracts. The Fairbank land eventually became part of the oil rich property known as Naval Petroleum Reserve No. 1 Elk Hills. In 1935, Ickes ruled that the land was known to have contained mineral resources and therefore belonged to the U. S. government. The administrative decision overruled an earlier finding by the commissioner of the General Land Office, following extensive hearings, which held that there was no indication the land contained mineral resources at the time California took title. The government won a multi-million dollar settlement from the Standard Oil Company of California for use of the land. The Supreme Court also refused to review a lower court decision which held that Ickes had the final decision on the question.
