PUC Says Tax Write
SAN FRANCISCO (UPI) —The staff of the Public Utilities Commission has urged public utilities taking fast tax write-offs to pass the savings on to their customers.
The PUC is considering a proposal by some California public utilities that they are allowed to keep money saved from fast tax write-offs.The utilities want the PUC to ignore these savings—which may amount to many millions of dollars—when it sets rates.
The savings would result from a recent federal law allowing utilities to "depreciate" value of assets more rapidly by means of an asset called "tax normalization."
Wednesday's statement of position by the PUC staff,the first since last September,came after presiding Commissioner Ray E.

Undereriner had originally ruled that the staff could not express an opinion. He said the staff could not have had enough facts on which to base an opinion.
An aide of former Attorney General Edmund G. Brown, now governor, sharply criticized Undereriner's ruling. He accused Undereriner of "handcuffing" the staff.
The staff's views were given by Stewart Weier, PUC supervising utilities engineer. He said rates should be based on "actual tax costs" and not upon "speculative future costs."
Appearing as a witness, Weber said utilities would use the savings to buy new equipment on which still more fast-depreciation tax deductions could be claimed in a never-ending process.
The utilities argue that their income taxes in future years will be all the higher if they use up deductions from fast depreciation now. The utilities contend that the write-offs are not really tax savings but in fact are tax deferrals.
The attorney general's office and many cities throughout the state have also come out against the utilities' request.
